0390 Municipal Code Lot Ratio 1993• n CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 390 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ADDING SECTION 18.08.040(C) TO THE CHUBBUCK MUNICIPAL CODE TO ESTABLISH THE MAXIMUM RATIO OF LOT DEPTH TO LOT WIDTH; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18.08 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Intent. Over the years lots have developed in Chubbuck that have been very deep in relation to the lot frontage. Generally these lots have initially provided space for livestock, however, as the owners have aged or moved away, the lot has not been used as originally intended with a resulting large area in the rear of lots not being kept up and free of weeds without enforcement from the City. This results in a diversion of City personnel to enforce weed ordinances and results in inefficient use of land within the City. The City Council believes it to be in the interest of the City and its citizens to not allow deep lots but to instead establish a maximum depth in relation to the lot frontage. Section 2. New Section 18.08.040(C). The following Section 18.08.040(C) shall be added to the Chubbuck Municipal Code: 18.08.040(C). Lot Depth to Width Ratio. The maximum ratio .of lot width to lot depth shall be: Zone Ratio A 1:5 R-1* 1:2 R-2* 1:2 R-3 1:3 R-4 1:3 C-1 1:5 C-2 1:5 I 1:5 *Lots in excess of is acre, lots 3a acre or under, no applicable ratio. Ordinance - Page 1 dsc chbbck02.141 The lot depth is measured at the furthest point the rear lot line is from the front lot line. The lot width is measured at the point of the front yard set back, and, in the case of a corner lot, the shortest line of the two sides bordering a street shall be used. For tracts that are on hillsides, irregularly shaped, or that have unusual conditions, drainage, easements or other such matters, which may make these ratios unworkable, the city building official and other applicable city officials shall work with the owner to devise a plan for such a lot that is workable. Any deviations from the above ratios shall be subject to approval by the Land Use and Development Commission either at the preliminary plat stage or upon special application to the Commission. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 18.08 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
