0415 Design Review Committee 1994CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 415 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 18.16.040 TO CHANGE THE PERSONNEL ON THE DESIGN REVIEW COMMITTEE; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18.16 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Amended Section 18.16.040. Section 18.16.040 of the Chubbuck Municipal Code is amended as follows: 18.16.040 Design Review. All uses in districts with which the design overlay district is combined shall be required to obtain design review clearance prior to obtaining building permits. All applications shall be accompanied by appropriate architectural and site development plans to scale which shall show structure locations, landscaping plans (including the landscaping materials to be used and the location of landscape areas), permanent existing trees, ground treatment, fences, off-street parking and circulation, location and size of adjacent streets, north arrow and property lines, drawings of major exterior elevations showing building materials and proposed color scheme, existing grade and proposed new grades. All such drawings and plans shall be reviewed by the design review committee, eensisting of the mayef, e4y efigineef, member- of the eity's land use aad development Go Qr- �LAI'Q-p 18.16.050 Design Review Committee. The design review committee. for urvoses of Title 16. 17 and 18 of the Chubbuck Municipal Code. shall be composed of the ma oar, city engineer, building officiallfire chief, city attorney, police chief and the chairman of the Land Use Commission or the chairman's designee. The city clerk shall be ex -officio secretary of the committee: Any decision by the committee is subject to review by the city council at the next city council meeting, with notice to affected parties and an opportunity for the affected parties to explain their position to the city council. The council may reverse, affirm or modify any decision of the committee. The committee shall meet from time to time at the call of the city clerk. Ordinance - Page t dsc chbbck03.235 ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 18.16 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
