The site plan approved by the Land Use and Development Commission (via a CUP) at the September 10, 2024 meeting; placed the northern wings of the building 33 feet and 25 feet, respectively, south of the north property line. In construction, the building foundation was placed 28 feet and 20 feet, respectively, from the north property line. Planning Manager Don Matson stated that this application had been reviewed by City Staff and does appear to meet all the standards of Titles 16, 17 and 18 of City Code, as presented with conditions. The minimum setback within the Limited Commercial (C-1) zone is ten feet. Mendenhall declared the public hearing open for public comment. Resident David Hall, was Neutral. Mr. Hall suggested adding a taller fence and a few more trees to the north for privacy. Mr. Hall was concerned about light pollution. Resident Shawn Beckman, was Neutral. Mr. Beckman suggested adding a few more trees to the north for privacy. Resident Saundra Frasure, was Opposed. Mrs. Frasure was concerned about privacy and suggested adding a few trees. Due to no more public comment Mendenhall closed the public hearing. Ward stated that the current landscaping included 7-8 trees along the northern property line. Mendenhall asked about the fence height. Matson stated that city code would only allow for a 7ft fence, the current fence is 6ft. Ward didn't think a 7ft fence would add any additional privacy due to the elevation difference between the properties. The Board also discussed light pollution. Matson stated that commercial properties are required under city code that light pollution must be shielded downward and be maintained within the property. Byrd asked resident Shawn Beckman if he felt like a 7ft fence would add any additional privacy. Mr. Beckman did not feel like a 7ft fence would add any additional privacy. Holm asked if as a surrounding neighbor and after listening to the discussion during tonight's meeting if Mr. Beckman would be in favor of a 7ft fence or additional landscaping. Mr. Beckman suggested the additional landscaping as discussed. Hiltbrand motioned to approve an amended Conditional Use Permit for an Assisted Living Facility in the Limited Commercial (C-1) zone located at 5820 Senator Way, and the findings, facts and conclusions of law (FFCL) with the stated conditions. The Applicant is required to coordinate with City staff to develop a new landscape plan that includes up to 3 additional trees on the north side of the property to increase privacy for neighbors. Staff may receive input from neighbors [to the north] on tree placement. Staff will have discretion on final determination of tree placement, and applicant will be required to comply with staff determinations as to the new landscape plan.
