RE: An application for annexation approximately 37.6 acres west of Yellowstone Avenue
and north of Bringhurst Street and Noah Street in Bannock County, ID. The
application will be reviewed against criteria in section 18.28.060.G of city code. (Action
Item)
SUMMARY
DESCRIPTION. The City has received an application for annexation of approximately 37.6 acres
west of Yellowstone Avenue and north of Bringhurst Street and Noah Street. The land is
proposed to include 4.23 acres of General Commercial (C-2) zoning along Yellowstone Ave
and 33.39 acres of Limited Residential P (R -2P) zoning for the bulk of the area. The proposal
conforms to the Future Land Use Map in the Comprehensive Plan, which designates
Commercial activity for lands within 300 feet of the highway and Low Density Residential on
the remaining area.
FINDINGS. After reviewing the application, staff finds that it meets the description and
requirements for an Annexation with Consent.
• It is contiguous to the City boundary and within the Urban Service Boundary.
• Utilities are available for connection in the neighboring Paradise Acres subdivision.
• The owner has consented to the annexation.
• Development of the site may help fill a gap for additional housing in the City.
• The Land Use and Development Commission has recommended a zoning district for
the subject property (approval of the zoning district is a separate item on this
agenda).
o The recommended zoning districts are General Commercial (C-2) and Limited
Residential P (R -2P).
• The Comprehensive Plan Future Land Use map designates this area as Commercial
and Low Density Residential.
o The zones support the Comprehensive Plan established land use areas.
There is an abandoned sliver parcel for an irrigation ditch running behind the homes
facing Noah St, bordering the parcels purchased by the applicant. The applicant is
working to acquire the parcel as part of this annexation. It is included in the proposed
zoning and annexation boundaries.
The area proposed for initial zoning and annexation is currently outside the Urban
Service Boundary. The boundary was created to indicate areas where the City has the
capacity to provide services, particularly water and sewer. Although the parcels are
outside the boundary, there is available capacity in the water and sewer systems
serving the area.
RECOMMENDATION:
Staff recommends approval of annexation of the property with the following conditions:
• The sliver parcel for an irrigation ditch is acquired by the applicant, and
• The property has been divided to separate the Commercial property from the
Residential to accommodate the approved zoning designations.
FACTS
BACKGROUND: The properties have been farmed by two families and were recently sold to the
applicant. Two residences and several outbuildings remain on the premises for the time being.
TYPE OF APPLICATION: Legislative (Subject to request for reconsideration; decision should
be based on the standards for approval). The Council may approve, table a decision, or
deny the application.
