Minutes ofa regularllleeti6g: held at the Chubbuck City Council Chambers, March 27th, 2007.
Present: Mayor Steven.M.>England, Council members Leroy S. Quick, Kent Kearns, Dennis
Stoddard, Rich_.Morgan, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor England.
PLEDGE ALLEGIANClTO THE FLAG was led by Councilman Richard Morgan.
APPROV AL OF MINl.J1'ES . Mayor England asked for corrections or additions to regular
meeting minutes. ClffMarch 13th, 2007.
Councilman Kearns moved to approve the regular meeting minutes of March 13t\ 2007
as read, Councilrna.l1Stoddardseconded. All council members voted in favor of motion.
RESOLUTION #3.2007;"Dell Road. FWD Smart explained Resolutions #3-2007.
Attorney Holmcs.teadResolution #3-2007 in full.
Councilman Morpnmoved to adopt Resolution #3-2007 as read, setting a public hearing
date for ApriI24~,.2007,Councilman Stoddard seconded. All council members voted in
favor of motion.
HOMESTEAD ESTATBS,DIVISION NO.3 & DIVISION NO.4 FINAL PLAT - PWD Smart
stated we receivetl~onstruction drawings for Homestead Estates, Divisions 3 & 4. PWD
Smart stated everytlt.ing is in order except for the construction drawings do not include
any provisions.fof a pressurized irrigation system as required. PWD Smart recommended
the HomesteadE~..tes, Division 3 and 4 Final Plat be tabled until the City receives the
complete set of cOnstruCtion drawings, including a pressurized irrigation system that will
serve all four di'ViJi~s>in Homestead Estates Subdivision. PWD Smart stated he has
given pressurein'lgation system standards to Rocky Mountain Engineers that will be
applicable. PWD$mart stated the pressure irrigation system should be designed so that if
the City Council so chOoses, the City can take over maintenance and operation of the
pressure irrigatioJil.system.
Mitch Greer, RM!;2043 E. Center Street agreed the construction drawings do not
include a pressurtil'rigation~ystlm1. Mr. Greer stated he is working on putting together a
pressureimgati()Jl~~~temrOl";'Hornestead Estates' Subdivision. Mr. Greer suggested the

ACCEPTANCE OF OFftER OF DEDICATION - FRASURE INDUSTRIAL PARK 3RD
ADDITION - PWD Smart presented the Frasure Industrial Park 3rd Addition Acceptance of
Offer and Dedication.urecommended approval.
Councilman St04dardmovedto approve the Acceptance of Offer of Dedication for
Frasure Industrial Park 3nl Addition, Councilman Quick seconded. All council members
voted in favor ormation.
ORDINANCE #637 .. Adgptirtg Chapter 5.36, Temporary Vendors.

Councilman Qui#kn;roved to adopt Ordinance #637 as read, Councilman Morgan
seconded. RollCall Vote: Quick, yes; Kearns, yes; Stoddard, yes; Morgan, yes.
ORDINANCE #638 -Atiding Section 6.04.230 to provide clarification as to what violations of
the Chubbuck~eare Ordinance shall constitute a misdemeanor and providing
penalties; Amen4ing Sectioti6.04.050 to clarify when licenses are required.
Attorney Holmeiread Ordinance #638 in full for the third and final reading.
Councilman Kearns moved to.adopt Ordinance #638 as read, Councilman Stoddard
seconded. RollCtdlVote: Quick, yes; Keam.s, yes; Stoddard, yes; Morgan, yes.
PROPOSED LIGHTIN~{)lU>INANCE DISCUSSION - Councilman Kearns explained why he
would like the'CjtyCQuncil develop a lighting ordinance in the City.
Councilman KeatJ1$ ttlOved to send information on a proposed lighting ordinance we
have receivedf<l:tJ1e Land Use & Development Commission for their review and
recommendationS, Councilman Morgan seconded. All council members voted in favor of
motion.

Councilman Stoddatdseconded. All council members voted in favor of motion.
