CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON APRIL 22,202S
SUMMARY
DESCRIPTION: An application for initial designation of property into the Limited Residential P (R -
2P) and General Commercial (C-2) Land Use Districts (zones) that is proposed to be annexed
into the City of Chubbuck. The subject property of approximately 36 acres is located west of
Yellowstone Avenue and north of Bringhurst Street and Noah Street. At the meeting, the

The applicant has met City Code requirements to be heard for initial placement in a
land use district.
The Comprehensive Plan Future Land Use map designates this area along Yellowstone
for Commercial land uses, which is supported by the Limited Commercial (C-1) and
General Commercial (C-2) zones, and the bulk of the property designated for Low
Density Residential development, which is supported by the Single -Family Residential
(R-1), Limited Residential (R-2) and Limited Residential P (R2 -P) zoning districts.
o The boundary between Commercial and Low Density Residential land uses on
the Future Land Use Map are reflected in the proposed zoning boundary
between General Commercial (C-2) and Limited Residential P (R -2P).
There is an abandoned sliver parcel for an irrigation ditch running behind the homes
facing Noah St, bordering the parcels purchased by the applicant. The applicant is
working to acquire the parcel as part of this annexation. It is included in the proposed
zoning and annexation boundaries.
• The area proposed for initial zoning and annexation is currently outside the Urban
Service Boundary. The boundary was created to indicate areas where the City has the
capacity to provide services, particularly water and sewer. Although the parcels are
outside the boundary, the is available capacity in
RECOMMENDATION:
Staff recommends approval of Limited Residential P (R -2P) and General Commercial (C-2 as
the initial zoning districts on the property with the following condition:
• The zoning designation will not take effect until:
o The annexation is complete
o The sliver parcel for an irrigation ditch is acquired by the applicant, and
o The property has been platted to divide the Commercial properties from the
Residential.

ANALYSIS AND RECOMMENDATIONS
SPOT ZONING:
As described in the Idaho Supreme Court ruling regarding Evans v. Teton County "a claim of 'spot
zoning' is essentially an argument the change in zoning is not in accord with the comprehensive
plan. There are two types of 'spot zoning.' Type one spot zoning may simply refer to a rezoning of
property for a use prohibited by the original zoning classification. The test for whether such a zone
reclassification is valid is whether the zone change is in accord with the comprehensive plan. Type
two spot zoning refers to a zone change that singles out a parcel of land for use inconsistent with
the permitted use in the rest of the zoning district for the benefit of an individual property owner."
The proposal does not meet either of the definitions of spot zoning. The proposal:
1. Complies with the Comprehensive Plan. The R -2P zone supports the Medium Density
Residential designation on the Future Land Use Map, and the C-2 zone supports the
Commercial designation on the map.
2. Does not single out a parcel for development inconsistent with allowed uses in the zone to
benefit an individual property owner. The purpose of the R -2P zone is "to provide for
neighborhoods of single household dwellings, class I production buildings, and abutting
zero lot line residences" (Title 18.08.10.D.). The purpose of the C-2 zone is "to provide for a
broad variety of business establishments serving Municipal or regional markets" (Title
18.08.10.H.). The proposed zones, and proposed uses of the property, do not meet the
definition of type two. City code also includes certain standards for C-1 parcels that abut
residential parcels (Title 18.12.060).
STANDARDS REVIEW:
The Commission must determine if it is in the best interest of the City of Chubbuck and adjacent
landowners to recommend a Title Change to the Land Use (zoning) Map. See additional standards
for approving a zone change in EXHIBIT 2B and additional relevant Comprehensive Plan policies in
EXHIBIT 3B.
STANDARDS FOR APPROVAL: CITY CODE SECTION 18.28.050.8A
POLICY 1
The proposed map amendment would be in the community's best interest.
RESPONSE
Residential development in the R -2P zone will help alleviate some of the housing
shortage in the City. The C-2 zone along the Highway will act as a buffer between
the residential area and Highway noise and activity.
POLICY 2
The list of uses permitted by the land use ordinance would blend with surrounding
land uses and the uses permitted in the proposed zoning district would be
harmonious in terms of their scale, mass, coverage, density, and intensity with
adjacent land uses.
RESPONSE
The single family homes to the south are in the R-1 zone. R -2P also focuses on
single family development, but can allow smaller lots and zero lot line
development (twin homes, townhomes).

Phone 208.237.2430
www.CityofChubbuck.us
POLICY 3
The subject site is suitable for the type and intensity of land uses permitted under the
proposed zoning district.
RESPONSE
The parcels in this proposal are generally flat and suitable for development.
POLICY 4
The subject site would be adequately served by transportation routes, police, fire and
EMS protection, water/sewer, schools, and other public facilities and services, or
agencies, to serve the public health, safety, and general welfare under the proposed
zoning district
RESPONSE
The site is fully adjacent to the city limits where police, fire and EMS protection
are provided. Water and sewer lines are adjacent to the site and have the
capacity to serve the proposed development.
POLICY 5
The proposed map amendment is generally not in conflict with the goals,
objectives, and policies of the adopted Comprehensive Plan. LUDC and Council
shall have discretion in interpreting exact boundary locations of the future land use
map designations when considering map amendment requests.
RESPONSE
The proposal furthers the goals, objectives, and policies of the Comprehensive
Plan. More information can be found in EXHIBIT 3B.
STAFF SUMMARY AND RECOMMENDATION
SUMMARY:
• It complies with the approval criteria found in section 18.28.050.8.a of City Code.

SUBJECT: Lyn Yost Properties — Initial Zoning Narrative
609 West Maple Street
Pocatello, Idaho 83201
knudsen-eng.com
PURPOSE
The intent of this narrative is to provide answers to the initial zoning application for the Lyn Yost Properties.
INITIAL ZONING NARRATIVE
1. How do you believe that the proposed zoning is in the community's best interest?
The proposed zonings of R -2P and C-2 for the Lyn Yost properties is in the community's best
interest as it supports growth that contributes to the community. The R -2P zoning offers more
housing options to address housing demands in the area. The C-2 zoning fosters commercial
development along the Yellowstone Avenue corridor, generating additional tax revenue. These
two zonings will provide a seamless expansion of the City while benefitting the City as well as
those who occupy the residential and commercial properties.
2. How do you believe the list of uses permitted by Chubbuck Municipal Code section 18.08.040 for
the requested zone blend with surrounding land uses?
The list of uses permitted under Chubbuck Municipal Code Section 18.08.040 for the requested
R -2P and C-2 zones for the subject properties blends well with the surrounding land uses by
supporting a practical and complementary expansion of the area. For the R -2P zone, permitted
uses such as single-family homes and accessory structures align naturally with the existing
residential subdivision to the south. This land use would provide a continual residential character
while allowing growth in housing options. For the C-2 zone along the Yellowstone Avenue
corridor, permitted uses like retail stores, offices, and service establishments fit seamlessly with
the commercial activity along the Yellowstone Corridor, enhancing accessibility to goods and
services for nearby residents. Additionally, the church located south of the C-2 zoning and
northeast of the current residential neighborhood further enhances this blend, as churches are
permitted in both residential and commercial zones. The presence of the church acts as a unifying
element, bridging the residential and commercial areas and reinforcing the balanced integration of
these zonings.
3. How are the uses permitted in the proposed zone harmonious in terms of scale, mass, coverage,
density, and intensity with adjacent land uses?
The uses permitted in the proposed R -2P and C-2 zones are harmonious with adjacent land uses
in terms of scale, mass, coverage, density, and intensity, ensuring a balanced fit with the
surrounding area. For the R -2P zone, permitted uses like single-family homes match the scale and
mass of the existing residential subdivision to the south. Thus, maintaining a congruent
neighborhood profile with comparable lot and house characteristics. For the C-2 zone along the
Yellowstone Avenue corridor, uses such as retail stores, offices, and service establishments align
with the corridor's commercial nature. Moderate -scale buildings and higher -intensity activity are
typical for the zone. The church south of the C-2 zone and east of the existing residential area
City of Chubbuck — Development Services Division

further ties these uses together, as its scale and lower -intensity presence, permitted in both zones,
softens the transition between residential and commercial. This thoughtful combination of zoning
supports smooth integration with adjacent land uses.
4. To your knowledge, is there anything that would prevent the site under the proposed zoning from
being served by transportation routes, police, fire, EMSprotection, water/sewer, schools, and
other public agencies or facilities?
There is not anything preventing the subject properties from being served by essential services
under the proposed R -2P and C-2 zoning. Transportation routes are readily available. Access is
provided through Ruth Street, Bringhurst Street/Eden Street, and the existing entrance off
Yellowstone Avenue. Police, fire, and EMS protection can be provided by these accesses. Water
and sewer services are accessible via Ruth Street or Bringhurst Street/Eden Street, which tie into
the city's established utility systems. Schools and other public facilities are within reach of the
future development. Local districts and city agencies can support the area's needs. The
properties' proximity to current infrastructure ensures these services can be provided without
significant issues.
5. How do you believe the proposed zoning supported by the Chubbuck Comprehensive Plan?
Please cite specific goals, objectives, and policies, including the future land use map, which
relate to your proposal.
The current land use designation from the City of Chubbuck Comprehensive Plan for the subject
properties is Low Density Residential (LDR) and Commercial (C). The requested R -2P and C-2
zonings comply with the Comprehensive Plan land use map since both zonings are allowed in the
respective land uses. The R -2P zoning supports Goal 2, "Improve residential neighborhoods and
ensure their orderly and financially sound development," and Objective 2. 1, "Improve the
appearance of residential areas." It extends the existing residential subdivision northward,
fostering an orderly development that enhances the neighborhood's completeness. The C-2
zoning aligns with Goal 3, "Provide convenient commercial service locations and limit their
adverse impacts on transportation systems, residences, and visual integrity," promoting
commercial growth along the major corridor of Yellowstone Avenue. Objective 3. 1, "Adopt
appropriate commercial zoning to allow for a variety of commercial goods and services at
community centers within walking distance of residents," is fulfilled by situating C-2 zoning near
the existing and future residential subdivisions, improving access to businesses. This zoning mix
complies with the City of Chubbuck Comprehensive Plan and ensures balanced and beneficial
development.

be part of the platting discussion.
OBJECTIVE
5.1.4 Encourage higher densities and site designs that support transit
POLICY
a. Phase public service extensions over time to protect prime agricultural land and
increase development densities to a level that will support transit service
COMMENT
This extension of city boundaries and services has been "phased" over time — the
adjacent Paradise Acres Subdivision was platted in 1975.
CHAPTER 7: GOVERNMENT SERVICES
GOAL 7.6 WORK WITH THE CITY OF POCATELLO TO PLAN AND DEVELOP EFFECTIVE PUBLIC

CHAPTER 10: HOUSING
GOAL 10.1 RESPOND TO HOUSING NEEDS
OBJECTIVE
10.1.1 Assure an adequate supply of land for residential development
POLICY
a. Plan for a variety of housing types
COMMENT
The R -2P zone is often single family development, but it will be possible for zero lot
line development such as twin homes and townhouses.
OBJECTIVE
10.1.2 Protect residential property values
POLICY
a. Use a combination of zoning, development standards, site planning guidelines, and
transportation routes to protect residential property values — they will be used to
create the highest level of compatibility between adjacent uses possible while retaining
a synergistic mix of uses within neighborhoods and communities
COMMENT
While a denser development will likely occur on this property, it will have it's own
access street to Yellowstone. This may reduce trips through Paradise Acres, and
Paradise Acres residents will have the option for another access to Yellowstone.
OBJECTIVE
10.1.3 Encourage the development of affordable housing
POLICY
d. Encourage residential infill and redevelopment in target areas
COMMENT
The R -2P zone is often single family development, but it will be possible for zero lot

CITY
OBJECTIVE
3.2 Encourage more dense residential developments, generally meeting the following
criteria, in all areas of the city
POLICY
a. Single-family attached: Structures such as townhouses or rowhouses. Generally
acceptable anywhere a single family residential unit is permitted
COMMENT
Duplexes, townhouses/rowhouses and twin homes are conditionally permitted in the
R -2P zone.
CHAPTER 11: ECONOMIC DEVELOPMENT
GOAL 11.2 CENTRALIZE COMMERCIAL EFFORTS
OBJECTIVE
11.2.2 Identify future potential commercial in areas of future growth and development
POLICY
a. Allow future commercial growth to occur within new neighborhoods in a manner
that is consistent with the community design principles defined in Chapter 6:

CHAPTER 14: AREA OF CITY IMPACT AND GROWTH MANAGEMENT
GOAL 14.1 COOPERATIVELY MANGE REGIONAL GROWTH TO IMPLEMENT THE COMMUNITY
VISION SET FORTH BY THE OUR VALLEY OUR VISION PROJECT
OBJECTIVE
14.1.4 Use urbanization policies to guide annexation within USBs
POLICY
a. Within the USB, annexation shall be required before new development is permitted
COMMENT
Annexation and zoning of this property are underway and will be completed before
any development is permitted.
POLICY
b. For land within the USB, annexation may be granted when essential urban services
can be delivered to the subject property
COMMENT
The project is partially within the USB; city water and sewer infrastructure have the
capacity to serve the entire project area.

2. Following an 18 -month public process, the City of Chubbuck has prepared "Chubbuck 2045:
Comprehensive Plan" for consideration by the Land Use and Development Commission. The
City's current Comprehensive Plan was last updated in 2002, Chubbuck's Future Land Use and
Urban Service Area maps were updated and adopted by Chubbuck City Council in 2010. For
several years the city prepared to draft a major plan update, when funding was available, that
would establish new goals, objectives and strategies into the year 2045. In 2023 the City budget
included funds for updating the plan, and the City was awarded a grant from the Blue Cross of
Idaho Foundation for Health to support including various health aspects in the planning process.
The geographic extent of the plan extends beyond the city limits to include an Area of City Impact
administered with Bannock County. The plan is organized into eight chapters beginning with an
introductory chapter summarizing the purpose of the plan, the preparation process, and the plan
contents. Chapter 2 introduces the reader to the City of Chubbuck, its setting, history, and
demographics. Chapters 3 through 7 include numerous plan components, as required by Idaho
Code Section 67-6508: Natural Environment, Built Environment, Public Services and Quality of
Life. The Community Health discussion appears in the Quality of Life section. The Future Land
Use Map appears in the Built Environment section. Chapter 8 presents an Implementation
Program derived from the plan strategies organized to provide guidance to realize community
priorities. Appendices with supporting documentation may be found at the end of the plan,
including documentation of all public outreach associated with the planning process.
