Re: Tree Valley Road Improvements
A Preliminary Plat has been approved for the Casa del Tree Valley subdivision on about 4.5 acres at the
north end of Tree Valley Rd. Per the plat approval, the owner must “construct the east of the east half of
Tree Valley Road or provide cash in lieu for the future construction of the east half of Tree Valley Road
as directed by the City.”
However, the west half of the road has not been built and a complete street is needed for residents, as
well as to meet various City goals, such as reducing dust and managing stormwater runoff.
Parcels on the west side of Tree Valley Road have 25’ wide access and utility easements for a planned
future public road as shown on the recorded plats of Tree Valley Subdivision and Beech Subdivision. It
appears that road improvements could be constructed across the easements without right-of-way
acquisition.
City staff and Councilman Heiner have contacted all but one property owner on Tree Valley Road to
discuss the potential of building a paved road. The exception is the property at the northwest end of
the street. The home has been abandoned and may be in foreclosure. Even though this property may
not be needed to complete the road, all other property owners are willing to enter into agreements with
the city to dedicate a portion of their property in exchange for the city completing construction of the
street.
Council direction is needed in several areas:
Does the Council wish to keep Tree Valley as a potential through street or designate as a dead-
end/cul-de-sac? The Comprehensive Plan shows this street as a collector and is designated as a
future through street.
Potential options to consider with developer of Casa Del Tree Valley Subdivision (each option
would require a Development Agreement):
o Developer contributes cash-in-lieu and the City designs and constructs the street in the
future.
o Developer designs and constructs the entire street and the City pays our portion. The
developer is currently designing the east half of the street and would need to include
the west half of the street, including stormwater design.
What method does the Council wish to use to fund the City’s half of the street design and/or
construction? The City has received cash-in-lieu from developers near the intersection of Tree
Valley and Garden Drive for completion of that portion of the street. This portion of the street
would still require design by the city/consultant or the Casa Del Tree Valley developer’s
engineer if they are willing to include it in their design, likely at a city cost.
If deeds for right-of-way will be required, does the Council wish to move forward and have City
Attorney Lewis draft the deeds?
