In follow-up to your question about disposing of surplus property, AIC has
providing the following guidance.
Idaho law does not mandate a specific process for disposing of surplus
city -owned personal property (e.g., police cars, trucks, computers, desks,
etc.). The personal property does need to be declared surplus by
motion or resolution of the city council and the motion or resolution
should direct the method of diap_Q_W ion: sale for a set minimum price,
sale by sealed bid or online auction, sale, or donation to another unit of
government, donation to a charitable organization, disposal in the landfill,
etc.
Property that is usable and has some residual value should be offered for
sale or donated to another local government or charitable organizatio.

without consideration or payment when it is in the best interest of the public
in the judgment of the governing body of the granting unit." Prior to
conveying the properly, the local governments must make a written
agreement outlining the terms of the transaction.
However, for real or personal property valued at more than
$10,000, a summary of the proposal and the date, time, and location that
the governing body will consider the matter must be published twice in the
official newspaper at least 12 and 5 days prior to the meeting by both units
of government. Although Idaho Code does not specifically require the local
governments to hold public hearings on the proposed 'transaction, hearings
are strongly encouraged. After the public hearing, the written agreement
must be approved by two-thirds vote of the governing boards of both
government entities (no such approval is required from the federal
or state government). -
