HomeMy WebLinkAbout1990-007 Lot 12 Hiway Acres Subdivision RESOLUTION NO. 7-90 A Resolution of the City Council, City of Chubbuck, Idaho, a municipal corporation, authorizing the taking of certain private lands owned by the Parrish Company and legally described as Lot 12, less the West seven feet thereof, Hiway Acres Subdivision to the City of Chubbuck, Bannock County, Idaho for public use of expansion of the City office building, expansion of the city shop building and for use by the City of Chubbuck in conjunction with the real estate owned immediately to the north of the property sought to be condemned and the property upon which the city offices sit, a resolution further authorizing a reappraisal of the property sought to be condemned, the making of an offer for purchase of said property not to exceed $54,000 and further authorizing the filing of a condemnation action to seek condemnation of said property. WHEREAS, the City of Chubbuck, an Idaho municipal corporation, has purchased certain property in Bannock County, Idaho legally described on the attached Exhibit #A#. WHEREAS, the City of Chubbuck anticipates a future need to expand the Chubbuck City office building and to construct a shop building upon additional property; and, WHEREAS, the property currently owned by the City is inadequate and insufficient and inefficient for said expansion; and, WHEREAS, the property immediately north of the city offices and south of the property described above that was purchased by the City sometime ago is deemed necessary for said public use by the City of Chubbuck; and WHEREAS, the City of Chubbuck has previously had said property appraised for the purposes of seeking a value; and, WHEREAS, the City of Chubbuck last had an appraisal of said property at $30,000 but offered to purchase the property from the Parrish Company, owners, for the sum of $54,000; and WHEREAS, the City of Chubbuck has been unable to arrive at a satisfactory price upon the property; and WHEREAS, the City of Chubbuck feels the property is necessary for the public use and should be acquired by condemnation if it cannot otherwise be purchased. RESOLUTION - Page 1 dsc chbbck08.24d NOW THEREFORE, be it resolved by this City Council of the City of Chubbuck as follows: 1. The City Council declares that fee simple title to the property described as Lot 12, less the West seven feet thereof, Hiway Acres Subdivision to the City of Chubbuck, Bannock County, Idaho is necessary for the public use of the City of Chubbuck, Idaho and specifically for future expansion of the city office building and construction of a shop building as well as other public use in conjunction with the city offices as well as property lying immediately north of the property sought to be condemned which is owned by the City. 2. The Chubbuck City Council does herewith declare that the aforementioned property is necessary to the City of Chubbuck for the public uses described. 3. The City has been unable to negotiate a satisfactory purchase of said property. The City Council authorizes the city officials to obtain an updated appraisal of said property and to submit another offer to purchase said property to the Parrish Company in a sum not to exceed $54,000. 4. If said offer to purchase is not accepted, the City Council authorizes the City to proceed with a condemnation action, seeking to condemn said property.
