RESOLUTION #7-94
WHEREAS, the Idaho Transportation Department, Division of Highways,
hereafter called the State, has submitted an Agreement stating obligations of
the State and the City of CHUBBUCK , Idaho, for the
]f~K~RK~ PURCHASE OF A STREET SWEEPER THROUGH THE CONGESTION
MITIGATION/AIR QUALITY (CMAQ) DEVELOPMENT PROGRAM.
; and
WHEREAS, the State is responsible for obtaining compliance with
laws, standards and procedural policies in the development, construction and
maintenance of improvements made to the Federal-Aid Highway System when there
is federal participation in the costs; and
WHEREAS, certain functions to be performed by the State involve the
expenditure of funds as set forth in the Agreement; and
W}{EREAS, the State can only pay for work associated with the State
Highway System; and
WHEREAS, the City is fully responsible for its share of project
cos ts; and
WHEREAS, it is intended that the project shall be developed and
constructed so as to receive federal participation;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Agreement for Federal-Aid Highway Project
CM-0300(114) is hereby approved.
2. That the Mayor and the City Clerk are hereby authorized to
execute the Agreement on behalf of the City.
3. That duly certified copies of the Resolution shall be furnished
the Idaho Transportation Department, Division of Highways.

Street Sweeper

Gentlemen:
The City of Chubbuck has requested permission to purchase a street sweeper through
the Congestion Mitigation/Air Quality (CMAQ) Development Program. The City is
hereby authorized to purchase a vacuum-type or vacuum-assisted street sweeper to
assist in sweeping 25 miles of streets, under the following conditions:
1. The City will pay to the Idaho Transportation Department the sum of five
hundred dollars ($500), estimated to be the total expense for the incidental services to
be provided by the Department on the City's behalf. Upon project completion, if the
estimated expense does not reflect the true cost of the work performed by the
Department, an adjustment will be made accordingly.
2. The City will submit to the Department for approval specifications of the
equipment to be purchased, and will advertise and administer competitive bidding
procedures to comply with federal requirements.
3. Upon purchase of the street sweeper, the City will provide the Department with
an abstract of all bids received, along with a statement and receipts documenting the
actual cost of the purchase. The Department will then reimburse the City for the
purchase of the equipment, not to exceed a maximum of $170,000, at the federal
participation match of eighty (80) percent.
4. If, in the event, application is made for title to the street sweeper, the City will
name the Idaho Transportation Department as lienholder.
5. If the equipment is sold within five (5) years from the date of purchase, eighty
(80) percent of the proceeds from the sale will revert to the Department, or at the
Department's discretion, the proceeds m~y be applied to another City CMAQ project.

6. Upon purchase of the street sweeper, the City will certify that the equipment
meets or exceeds the bid specifications, and will write an inspection and acceptance
letter to the supplier, with a copy of the letter to the Department.
7. The City will establish a schedule of equipment use above what currently exists
in order to reduce the quantity of PM- 10 material from re-entrainment during periods
of the calendar year when PM- 10 levels tend to be in excess of allowable levels. This
schedule of use will be consistent with the efforts established in the state air quality
implementation plan when it is completed in order for the City to reduce PM-10 levels.
8. The City agrees that if it fails to use the street sweeper in accordance with the
State Air Quality Implementation Plan or the provisions of this Agreement the
Department may reposess the equipment. If the equipment is destroyed or damaged,
the City further agrees to replace it, or the Department is to receive insurance
proceeds or the fair market value of the destroyed or damaged equipment.
If you accept the foregoing conditions, please sign both enclosed originals and return
one with your check or warrant in the amount of $500.
