COUNCIL MEETING MINUTES
February 13th, 2007
Minutes of a regular meeting held at the Chubbuck City Council Chambers, February 13th, 2007.
Present: Mayor Steven M.England, Council members Leroy S. Quick, Kent Kearns, Dennis
Stoddard, Richard Morgan, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor England.
PLEDGE ALLEGIANCE TO THE FLAG was led by Councilman Richard Morgan.
INVOCATION was given by Pastor John Robinson, Gate City Christian Church.
APPROV AL OF MINUTES - Mayor England asked for corrections or additions to regular
meeting minutes of January 23M, 2007.
Councilman Stoddard moved to approve the regular meeting minutes of January 23rd,
2007 subject to, noting Councilman Stoddard was not present at the January 9t\ 2007
Council Meeting and did not vote on approval of minutes, Councilman Quick seconded.
All council members voted in favor of motion.
PUBLIC HEARING - An application by Rodney Burch, 333 Briscoe Road, Chubbuck, Idaho for
a preliminary plat.fof 60ttagePark 2nd Addition. Location is south of Siphon Road and
east of Hawthorne Road.
Rodney Burch, 333 Briscoe Roadpresented the Cottage Park 2nd Addition Preliminary
Plat. Mr. Burch stated he builta bridge across the canal last year. Mr. Burch stated he is
asking for approval of the remaining 26 lots. Mr. Burch stated he is working with
Chubbuck Fire Department and Asst Planning Director Larry Kohntopp.about the process
of changing street names. Mr. Burch explained there will be a City Park in the Cottage
Park 2nd Addition.
Mayor England declared the public hearing open, there being no comment, Mayor
England declared the public hearing closed.
Councilman Morgan moved accept the Land Use & Development Commission's
recommendation to approve the Cottage Park 2nd Addition Preliminary Plat as presented,
subject to the street being renamed to comply with Emergency Services concerns,
Councilman Kearns seconded. All council members voted in favor of motion.

PUBLIC HEARING - An application by Pheasant Ridge Development, Inc, 535 Gary Street,
Pocatello, Idaho for a preliminary plat for Mallard Subdivision. Property is located at
north side of Mallard Drive.
Jared Bragg, Harper-Leavitt Engineering, 800 West Judicial, Blackfoot, Idaho presented
the Mallard Subdivision Preliminary Plat. Mr. Bragg stated this plat is a re-plat from the
original plat that was approved in 2004 as a Commercial PUD. Mr. Bragg stated this
proposed plat is four individual commercial lots.
PWD Smart suggested the strip of land on the north side be platted as a lot so when it is
transferred, it will be clear. PWD Smart stated the Land Use & Development
Commission expressed concern about buffering at the time there is a definite proposal.
Mayor England declared the public hearing open, there being no comment, Mayor
England declared the public hearing closed.
Councilman Kearns moved to accept the Land Use & Development Commission's
recommendations to approve the application by Pheasant Ridge Development, Inc for
Mallard Subdivision Preliminary Plat, subject to; 1) the lot north of residential between
current residential and Pheasant Ridge be assigned a lot number, 2) any Commercial that
develops complies with required buffering, Councilman Quick seconded. All council
members voted in favor of motion.
PUBLIC HEARING - An application by Phoenix Development, Darris Ellis, 44 70 Wasatch,
Chubbuck, Idaho 83202 for a preliminary plat for Park Meadows 10th Addition
Subdivision. Property is located south of Galena and west of Pine wood.
Joel Dixon, Rocky Mountain Engineering presented the Park Meadows 10th Addition
Subdivision. Mr. Dixon stated this is another series of twin homes. Mr. Dixon stated they
will work with Fort Hall Irrigation on fencing behind the twin homes.
Mayor England declared the public hearing open.
Darris Ellis, 4470 Wasatch, Chubbuck explained future development on the property.
There being no further comment, Mayor England declared the public hearing closed.
Councilman Kearns moved to accept the Land Use & Development Commission's
recommendatiOl1lQ~~ve the Park Meadow lOth Addition Subdivision as presented,
Councilman SfMdard'seconded. All council members voted in favor of motion.

PUBLIC HEARING - An application by Tailwind Development, LLC, 500 Michael Ave,
Pocatello, Idaho for a preliminary plat for Dove Tail Subdivision. Property is located at
end of Industry Way, east side of road.
Joel Dixon, Rocky Mountain Engineering presented the Dove Tail Subdivision. Mr.
Dixon stated this is a re.;.plat of the Northside Subdivision, Lot 1, Block 3.
Mayor England declared the public hearing open, there being no comment, Mayor
England declared the public hearing closed.
Councilman Stodpanillltwedto accept the Land Use & Development Commission's
recommendation to approve the Dove Tail Subdivision Preliminary Plat as presented,
Councilman Kead'l$$e,Conded. All council members voted in favor of motion.
FINAL PLAT - GROVE.;. DIVISION NO. 1 - Mitch Greer, Rocky Mountain Engineering
presented the Grove Division No. 1 Final Plat.
PWD Smart stated the construction plans are not quite completed. PWD Smart stated
Staff is working ona development agreement with the developer.
Councilman Kearns moved to approve the Grove Division No.1 Final Plat subject to;
1) Approval of aU construction drawings and plans by City Engineer, 2) Successful
execution of a development agreement with developer, Councilman Quick seconded. All
council members voted in favor of motion.
CHILD CARE FACILITY BUSINESS LICENSE APPLICATION - Suzy Rausch, 117 Stuart
has applied for a cl1ild care facility business license to operate a child care facility at her
residence, 117 Stuart Ave.
Suzy Rausch explained her plans for a child care facility at her residence.
Councilman Stoddard moved to grant Suzy Rausch a child care facility business license
to operate a child care facility at 117 Stuart Ave, Councilman Kearns seconded. All
council members voted in favor of motion.
ORDINANCE #632 - Adopting Chapter 5.36 Behavioral Mental Treatment Clinics.
Attorney Holmes read Ordinance #632 by title only for the third reading.

Councilman Morgan movedtodi~pense with the rule of reading Ordinance #632 in full,
Councilman Keams seconded. Roll Call Vote: Quick, yes; Kearns, yes; Stoddard, yes;
Morgan, yes.
Councilman Kearns moved to adopt Ordinance #632 as read, Councilman Stoddard
seconded. Roll Call Vote: Quick, yes; Kearns, yes; Stoddard, yes; Morgan, yes.
ORDINANCE #633 .. Adopting a new Section 06.04.070 and amending Section 6.04.190 to
provide that all day care licenses shall be issued by the City Clerk upon approval by the
Police, Fire and Building Departments with appeal for any denial to be to the City
Council; amending Section 6.04.120 (G) to make it consistent with the existing
requirements of ~ Idaho Administrative Code.
Attorney Holmestead Ordinance #633 by title only for the third reading, one of which
was in full.
Councilman Morgan moved to adopt Ordinance #633 as read, Councilman Stoddard
seconded. Roll Call Vote: Quick, yes; Kearns, yes; Stoddard, yes; Morgan, yes.
AUTHORIZE SPRING LOAD LIMITS - PWD Smart stated State Code 49-1005 states City
Councils shall authorize Spring Load Limits in the City.
Discussion about enforcement of the Spring Load Limits.
Councilman Kearns moved to authorize installation of Spring Load Limit Signs in the
City, Councilman Quick seconded. All council members voted in favor of motion.
CLAIMS - Computer print..out claims presented to Mayor Cotant and Council.
Councilman Stoddard moved to approve computer print-out and hand check claims as
presented, Councilman Quick seconded. All council members voted in favor of motion.
GENERAL DISCUSSION -
1. Mayor England stated the City of Chubbuck is partnering with Idaho State University
to allow the ISU Girls Softball Team to use a Capell Park Softball Field for home
games, end of March through the end of April. Mayor England stated ISU will bear the
costs of preparing the fields.

GENERAL BUSINESS - (cont.)
2. Association of Idaho Cities Conference will be held in Coeur d' Alene, Idaho,
June 13th-15th; 2007.
3. PWD Smart reported on City of Chubbuck contract with Snake River Sanitation.
Council mem~ stated they have not receive many complaints since last summer.
PWD Smart gave areport on what it would take if City wanted to take on collecting
sanitation in the City. Discussion about possibility of a revenue bond in the future.
4. PWD Smart stated Water Rights Issues are still an issue. PWD Smart gave a report
on where the City is on water rights issues. Discussion about wells in service, and not
in service in th~City. Discussion about proposed ordinance requiring secondary
irrigations systems.

5. PWD Smart stated the City submitted a pre-application to DEQ early January, 2007 for
a State Revolving Fund Loan in the amount of $21,000,000. PWD Smart reported on
how the $21,000,000. will be spent if approved. PWD Smart stated he felt the City has
a good chance. ()f receiving the Loan.
6. Mayor Englap,&tJta.te<i,the Joint Powers Agreement is in process, Bannock County
and City of POOatello will participate the agreement.
At 9:00 p.m, CouncilmadMorgan ffi()ved, Councilman Quick seconded, with full council
approval to adjoummeeting.

WEIGHT, SPEED AND TIRE REGULATIONS
49-1005. SPECIAL REGULATIONS AND NOTICE. Whenever in the judgment of the
board or authorities in charge of, or having jurisdiction over a highway, the
operation on any highway or section of highway of vehicles of sizes and
weights at rates of speed permissible by law which will cause damage to the
highway by reason of climatic or other conditions, or will interfere with the
safe and efficient use of the highway by the traveling public, the board or
other authorities in charge of, or having jurisdiction over a highway have
authority to make regulations reducing the permissible sizes, weights or
speeds of vehicles operated on that highway for any periods as may be
necessary for the protection of the highway or for public safety. Signs
designat.ing those. regulations shall be erected and maintained at each end of
the highway or section and at intersections with main traveled highways.
