HomeMy WebLinkAbout1999-005 Moratorium on Commercial Cell Phone Towers CITY OF CHUBBUCK, IDAHO RESOLUTION NO. 5- 9 9 A RESOLUTION OF THE CITY OF CHUBBUCK, IDAHO, SETTING FORTH IN WRITING THE REASONS FOR ADOPTING A MORATORIUM ON COMMERCIAL CELL PHONE TOWERS AND SETTING FORTH THE TIME LIMIT FOR SAID MORATORIUM. FACTS A. The City of Chubbuck has one commercial cell phone tower within its city limits at present, which tower is 300 feet in height. B. The City Council anticipates that with the growing use of cellular telephones, there will be applications for more towers within the city limits. C. The Chubbuck City Council makes the findings and takes the action set forth below. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: 1. Finding. The Chubbuck City Council finds that it is not in the best interest of the public health and safety to have a proliferation of cellular telephone towers within the City Limits. Since the City of Chubbuck currently has no governing ordinances in place, the City Council finds it is in the best interest of the public to avert an iminent peril to the public's health and safety to enact a moratorium on applications to place additional cellular telephone towers within the city limits. 2. Direction to Staff. The City Council directs city staff to research and propose to the Land Use and Development Commission and the Council proposed ordinances that would address cellular telephone towers, and specifically address the following issues: a. Requiring co-location by different users upon towers. b. Addressing the types of towers including possible coordination of the towers into the landscaping whether in buildings or by design. 3. Duration of Moratorium. This moratorium shall expire 60 days from August 24, 1999, unless extended. 4. Hearing Procedure. Due to the relatively short period of time that the Council anticipates this moratorium will be in effect, the Council believes it not necessary to separately RESOLUTION NO. ehubbuck09.023 provide for notice and hearing with respect to this moratorium, but simply to address the same when the proposed ordinances come on for hearing before the Land Use and Development Commission.
