DESCRIPTION: An application for initial designation of property into the Limited Residential P (R -

The Comprehensive Plan Future Land Use map designates this area in three separate

but adaptable regarding property lines, aiding in Chubbuck's development
compliant with the Comprehensive Plan.

nearby properties are in the Single Family Residential (R-1), Limited Residential (R-2),
and R -2P zones.

property with the following conditions:
The zoning designation will not take effect until the annexation is complete.
The zoning designation will not take effect until the plat is approved defining parcel
boundaries, street dedications, etc.
• If the parcel will be platted with a density greater than 6 units per acre a Design
Review is required, per 18.16.010: Design Review Criteria: Applicability; Purpose.

ANALYSIS AND RECOMMENDATIONS
SPOT ZONING:
As described in the Idaho Supreme Court ruling regarding Evans v. Teton County "a claim of 'spot
zoning' is essentially an argument the change in zoning is not in accord with the comprehensive
plan. There are two types of 'spot zoning.' Type one spot zoning may simply refer to a rezoning of
property for a use prohibited by the original zoning classification. The test for whether such a zone
reclassification is valid is whether the zone change is in accord with the comprehensive plan. Type
two spot zoning refers to a zone change that singles out a parcel of land for use inconsistent with
the permitted use in the rest of the zoning district for the benefit of an individual property owner."
The proposal does not meet either of the definitions of spot zoning. The proposal:
1. Complies with the Comprehensive Plan. The R -2P zone supports the Low Density, Medium
Density, and Mixed Use designations on the Future Land Use Map.
2. Does not single out a parcel for development inconsistent with allowed uses in the zone to
benefit an individual property owner. The purpose of the R -2P zone is to "provide for
neighborhoods of single household dwellings, class I production buildings, and abutting
zero lot line residences" (Title 18.08.010 sections C and D). The proposed zone, and
proposed use of the property, do not meet the definition of type two.
STANDARDS REVIEW:
The Commission must determine if it is in the best interest of the City of Chubbuck and adjacent
landowners to recommend a Title Change to the Land Use (zoning) Map. See additional standards
for approving a zone change in EXHIBIT 2B and additional relevant Comprehensive Plan policies in
EXHIBIT 3B.

SUBJECT: Brookstone, LLC Property — Initial Zoning Narrative
609 West Maple Street
Pocatello, Idaho 83201
knudsen-eng.com
PURPOSE
The intent of this narrative is to provide answers to the initial zoning application for the Brookstone, LLC
property.
INITIAL ZONING NARRATIVE
The proposed zoning is in the community's interest because it provides a more complete and
continuous residential community. The zoning of the property to R -2P permits the construction of
residences which are desired in the current housing market. This zoning of the property would
generate additional tax revenue for the City to invest in essential services such as schools, roads,
and parks which would ultimately benefit the community in multiple ways.
2. The proposed R -2P zoning would perfectly integrate with the adjacent R -2P zoning that is
adjacent to the proposed zoning area. The proposed R -2P zoning would enable the existing R -2P
zoning to continue and form a more complete neighborhood.
3. The uses permitted in the proposed zone are harmonious to the adjacent land uses, because they
would be the same permitted land uses. The proposed zoning area would be a continuation of the
surrounding residential development.
4. The site's convenient location adjacent to Chubbuck Road ensures that it would have adequate
transportation capacity to support the proposed R -2P zoning. Additionally, the existing
infrastructure within Lamar Street, Angela Street and Robinson Lane would allow the addition of
utilities to the proposed property, ensuring that it would have access to needed services such as
water, sewer, electricity, and natural gas. Furthermore, the proximity to existing police, fire, EMS
stations, and schools guarantees that residents would have prompt access to these critical services.
Overall, the site's characteristics and location make it well-suited for the proposed R -2P zoning,
and there are no foreseeable obstacles that would prevent the development from receiving the
necessary public services and infrastructure.
The proposed R -2P zoning aligns with the Chubbuck Comprehensive Plan in several key aspects.
Firstly, it is consistent with the designated land use for the area, which is medium density and low
density residential. This aligns with the comprehensive plan's goal of promoting a mix of housing
configuration options. Secondly, the proposed R -2P zoning directly contributes to the
City of Chubbuck — Development Services Division
Brookstone — Initial Zoning Narrative

achievement of the comprehensive plan's objective of providing more affordable housing options.
The residential configurations permitted in R -2P allow for the creation of more affordable single
family dwelling units. The continuation of the R -2P zoning enhances the long-term vision of the
comprehensive plan.
