STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Ryan Lewis, Public Works Director Bridger Morrison, Public Works Operations Manager Kami Berger, Community Services Director Devin Hillam, Planning Manager Don Matson, Development Services Manager Sean Harris, Police Chief Nick Sasser, Human Resource Director Scott Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers. DISCLOSURES OR CONFLICTS OF INTEREST ON ANY AGENDA ITEMS: Councilmember Heiner recused himself from general business items #3 and #4. APPROVAL OF MINUTES: September 18, 2024. Councilmember Reece motioned for approval of the Council Meeting minutes. Councilmember Evans seconded motion for approval of minutes. Roll Call: Evans -yes, Reece -yes, Heiner -yes, Hernandez -recused, motion passed. GENERAL BUSINESS: 1. The Swearing in of Chubbuck Police Officers. Chief Nick Sasser presented Officer Sant. Officer Sant was sworn in by Mayor England and then had his badge pinned on by a family member. 2. Discussion and Possible Adoption of Ordinance XXX for the Annexation of approximately 3.12 acres of land, and Specify the Zoning Single-family Residential (R-1), located at 12260 Hiline Rd (Action Item) (Council will discuss the annexation of 3.72 acres into the City limits). General Business item #2 was removed from the agenda. 3. Approval for a Title Map Amendment from Agriculture (A) to Single-family Residential (R-1) on approximately 4.47 acres of land located at 5110 Tree Valley Rd. (Council will discuss the application and if it meets City code). Brady Smith from Avyant represented the applicant. Mr. Smith presented a Title Map Amendment from Agriculture (A) to Single-family Residential (R-1) on approximately 4.47 acres of land located at 5110 Tree Valley Rd. Planning Manager Don Matson stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval. Councilmember Hernandez motioned to approve a Title Map Amendment from Agriculture (A) to Single-family Residential (R-1) as presented by City Staff. Councilmember Reece seconded motion for approval. Roll Call: Evans -yes, Reece -yes, Hernandez -yes, Heiner -recused, motion passed. 4. Approval of the Casa Del Tree Valley Subdivision Preliminary Plat and the findings, facts and conclusions of law. (Council will discuss the application and if it meets City code). Brady Smith from Avyant represented the applicant. Mr. Smith presented a 5 lot preliminary plat for 5 residential building lots in the Casa Del Tree Valley Subdivision. Which included improving the east half of Tree Valley Road, providing access off of Tree Valley Road and extending water and sewer services to each lot. Planning Manager Don Matson stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval. Community Services Director Devin Hillam gave some history on Tree Valley Road. Attorney Lewis stated that the development of the remainder of Tree Valley Road is not part of this application. Councilmember Reece motioned to approve the Casa Del Tree Valley Subdivision Preliminary Plat, including the findings, facts and conclusions of law as presented by City Staff, and conditional upon the owner construct the east half of Tree Valley Road or provide cash in lieu for the future construction as directed by city staff. Councilmember Hernandez seconded motion for approval. Roll Call: Reece -yes, Hernandez -yes, Evans -yes, Heiner -recused, motion passed. 5. Acceptance of Offer of Dedication for Concord Corner. (Council will discuss if all city requirements have been inspected and completed). Development Services Manager Sean Harris stated that all city requirements had been inspected and completed and recommend approval. - Councilmember Hernandez motioned for acceptance of offer of dedication for Concord Corner. Councilmember Heiner seconded motion for acceptance. Roll Call: Heiner -yes, Reece -yes, Hernandez -yes, Evans -yes, motion passed. 6. Approval to Appoint Oliver Ibarra to the Chubbuck Development Authority Board. (The Council will discuss an appointment to the Chubbuck Development Authority (CDA)). Mayor England presented Oliver lbarra to serve on the Chubbuck Development Authority Board. Councilmember Heiner motioned to approve the appointment of Oliver lbarra to the Chubbuck Development Authority Board. Councilmember Reece seconded motion for approval. Roll Call: Reece -yes, Hernandez -yes, Evans -yes, Heiner -yes, motion passed. 7. Resolution 2024-05 Approval of Records for Destruction. (Council will discuss the destruction of City records). Councilmember Hernandez motioned for adoption of Resolution 2024-05 as presented. Councilmember Heiner seconded motion for adoption. Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, Reece -yes, motion passed. 8. Consideration of equal value land exchange of City property on New Day Parkway for land north of Capell Park, and declaring a value. Community Services Director Devin Hillam presented an exchange of City property on New Day Parkway for private land north of Capell Park, which would allow for future park expansion. Councilmember Evans felt like the property on New Day Parkway had more potential than the proposed land north of Capell Park. Councilmember Reece moved that finding the exchange to be in the public's interest, by making a declaration of intent for the consideration of equal value land exchange of City property on New Day Parkway for private land north of Capell Park, and declaring a value of $445,000 for 2.05 acres of property as presented by City Staff. Councilmember Hernandez seconded motion for approval. Roll Call: Evans -no, Heiner -yes, Reece -yes, Hernandez -yes, motion passed. CLAIMS: 1. City of Chubbuck claims for October 16, 2024 as presented to Mayor England and Council. Councilmember Heiner motioned to approve the City of Chubbuck Claims as presented.
