CHUBBUCK 1 0 A H A Community Services Department Planning Services Division 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us APPLICATION FOR A CONDITIONAL USE PERMIT FOR AN ASSISTED LIVING FACILITY IN THE LIMITED COMMERCIAL (C-1) ZONE CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION REGULAR MEETING ON SEPTEMBER 10, 2024 SUMMARY DESCRIPTION: An application for a Conditional Use Permit for an Assisted Living Facility with 61 beds in the Limited Commercial (C-1) zone on approximately 2.73 acres of land. Subject property is located approximately 265 feet north of Chubbuck Rd and 200 feet east of Philbin Road at 5820 Senator Way, a future street. The application will be reviewed against criteria in section 18.28.020.C.5 of City Code. Type of Action: Decision. STAFF FINDINGS: After reviewing the application and related materials, staff finds that it meets the standards established by the City for a Conditional Use Permit (CUP). • Assisted living facilities are conditionally permitted in the Limited Commercial (C-1) zone. • The Design Review Committee has reviewed the site plan against technical requirements of the City as required by city code and requested additional information from the developer; the committee's recommendations and questions are reflected in the site plan and other exhibits included with this report. The Committee did not approve the use and only reviewed technical requirements: o The committee directly reviews and approves such details as parking, landscaping, access, utility services, and sanitation. o The Land Use and Development Commission may approve other or more stringent conditions on the proposal. The applicant has met City Code requirements to be heard for a CUP. Staff recommends approval of the proposed CUP and Findings of Fact and Conclusions of Law. Recommended conditions: o A final landscaping plan be submitted and approved as part of the building permit review process and that the landscaping and all other requirements of this CUP and Design Review Committee be inspected and approved prior to issuing a certificate of occupancy. o The "use commencing" as the term is used in section 18.28.020.F TERM OF APPROVAL shall mean having obtained a building permit and having the entire footings and foundation poured for the assisted living facility. o The screening along perimeter residential properties shall be maintained in perpetuity. o All lighting shall be shielded downwards from the nighttime sky and from trespass off of the property. No lighting shall exceed fifteen feet (15') in height. FACTS BACKGROUND: The subject property is the northeast part of a 9.6 -acre parcel that was annexed in 2020 and placed in the Limited Commercial (C-1) zone. This complied with the Comprehensive Plan Future Land Use Map designation of Mixed Use (MU). The property is bordered on two sides by different divisions of Bilyeu Estates Subdivision. Earlier this year the Commission approved a CUP for a convenience store at the corner of Philbin and Chubbuck on part of the original 9.6 -acre parcel. TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the evidence and by applying law to the facts; decisions shall be based on the criteria and standards for approval per section 18.28.020.C.5 of City Code). The Commission may approve with or without conditions, may table a decision, or may deny the application. APPLICANT: Legacy Assisted Living LLC 203 S. Chapter 10.2 of the Comprehensive Plan is "Encourage the development of a variety of housing types that are responsive to conditions within the community." The proposed assisted living facility is consistent with the housing chapter of the comprehensive plan by providing housing to the elderly, a need within the community. 3. How is the use compatible with other existing or permitted uses in the general vicinity? Have changes been made to the proposal to enhance compatibility? The comprehensive plan designates the Chubbuck/Siphon Rd intersection as mixed use. The area consists of single and multi -family residential, churches, and a convenience store. The use as an assisted living facility is a residential use that is compatible with the existing and permitted land uses in the area. The exterior finish and colors have been designed to fit with the surrounding area. Exterior lighting will be shielded downward without trespass off-site. 4. How is the proposed use harmonious in scale, mass, coverage, density, and intensity with all adjacent permitted land uses? The assisted living facility will be harmonious with all adjacent permitted land uses. The location of the proposed facility is offset 25 feet from the rear property boundary, 36 feet from the west property boundary and 25 feet from the east property boundary. The closest existing structure is approximately 60 feet from the proposed building location to the north. There is an existing 6 -foot solid vinyl fence on the north and east property boundaries providing a buffer between the assisted living facility and the single-family homes. All sides of the property will be landscaped with a variety of trees, plants, and flowers. 5. Are there any elements of the proposed use which could create undue burdens on transportation, police, fire, EMS protection, water/sewer, schools, or other public agencies or facilities in the vicinity? If so, how are the impacts being mitigated? The location is a lot in an existing subdivision which will access off Senator Way, a designated local street with a 55 -foot right-of-way. A traffic impact study was completed for this site with a trip generation similar to what was included in the study. The lot is currently stubbed for water, sewer and irrigation services and can be adequately served by public facilities. The building will contain fire sprinklers. Ward, PLS Dioptra 4880 Clover Dell 208-237-7373 Chubbuck, Idaho 83202 DIOPTRA Legacy Assisted Living Traffic Impact Statement Prepared by: Stewart K. Ward, PLS Dioptra LLC Assisted LivingFacility The 2023 Traffic Impact Study for Chubbuck & Philbin Commercial Site includes the analysis of our subject property. The study indicates our site would be 20 Low -Rise Multifamily Housing Units (ITE Code 220). This use generates 6.74 trips per unit for a total of 135 trips, with an A.M. peaking factor is 0.40 and a P.M. peaking factor is 0.51. The proposed use has changed to a 61 Unit Assisted Living Center (ITE Code 254). This use generates 2.6 trips per unit for a total of 159 trips, with an A.M. peaking factor of only 0.18 and a P.M. peaking factor of only 0.24. Although the proposed use has changed, the generated traffic remains almost the same, with only a 2% increase in ADT, but a significant decrease in AM and PM peaking factors. Future Office Space The 2023 Traffic Impact Study indicates the site would include 7,500 GSF of small office space (ITE Code 712). This use generates 14.39 trips per 1,000 GSF. Our proposed building is 8,150 GSF for an increase of 650 GSF or an increase of 9 trips, with the same A.M. peaking factor of 1.67 and a P.M. peaking factor of 2.16. The addition of 9 trips does not change the level of service for this development. 4880 Clover Dell 208-237-7373 Chubbuck, Idaho 83202 CITY OF CHUBB UCK WASTEWATER DISCHARGE PERMIT APPLICATION FOR FOOD SERVICES City of Chubbuck Pretreatment Office P.O. Traffic Statement The 2023 Traffic Impact Study for Chubbuck & Philbin Commercial Site includes the analysis of our subject property. The study indicates our site would be 20 Low -Rise Multifamily Housing Units (ITE Code 220). This use generates 6.74 trips per unit for a total of 135 trips, with an A.M. peaking factor is 0.40 and a P.M. peaking factor is 0.51. The proposed use has changed to a 61 bed Assisted Living Center (ITE Code 254). This use generates 2.6 trips per unit for a total of 159 trips, with an A.M. peaking factor of only 0.18 and a P.M. peaking factor of only 0.24. Although the proposed use has changed, the generated traffic remains almost the same (only a 15% increase) as the 2023 Study. The fee will be paid today or Monday.
