Subject: Exception for putting in sidewalk 4850 spraker st.
Hello,
My name is Tray Mitton and me and my wife Hope recently purchased 4850 spraker street lot. We are building a new
home and have received our permits for building. In reviewing our permits there is a condition that all new builds have
to put in a sidewalk in front of the property. Since our lot is in a neighborhood that is already established it does not
have any sidewalks in the neighborhood and so I am requesting that we can get an exception so that we do not have to
put a sidewalk on our property. I think this will help our house to blend into the rest of the neighborhood.
would like this to be brought up in the public hearing on July 3rd 2024. Let me know if that will be a possibility.
Thank you,
-Tray

Re: Request for Waiver of Sidewalk Improvements
• Chubbuck Municipal Code Section 8.28.030: Owners Duty To Construct, Repair Or Replace
Curbs and Sidewalks requires the owner to provide sidewalk along the street frontage of
their real property to provide safe, all weather passage for pedestrians.
• Per city policy, sidewalks are required for all new developments and improvements.
• Historically the city has made rare exceptions for areas that:
o Have no existing sidewalks and;
o The road is unimproved without curb and gutter.
• Spraker Street does not have sidewalks; however it is currently paved full width and
includes curb and gutter.
• The city recognizes that sidewalk installed at this location will not connect to any other
sidewalk until future improvements or redevelopment occurs in the area.
• As an alternative, installation could be delayed to a future date, at the property owner’s
expense, per a recorded development agreement.
