HomeMy WebLinkAbout2024-03 Professional Service ContractsCITY OF CHUBBUCK RESOLUTION 2024-.03 A RESOLUTION OF THE CITY OF CHUBBUCK AUTHORIZING RESPECTIVE DEPARTMENT HEADS AND AUTHORIZED PURCHASING DEPARTMENT PERSONNEL TO ADOPT GUIDELINES FOR SELECTION OF PROFESSIONAL ENGINEERING, ARCIIITECTURAL, LANDSCAPE ARCHITECTURE, CONSTRUCTION MANAGEMENT, AND PROFESSIONAL LAND SURVEYING SERVICES ON THE BASIS OF QUALIFICATIONS AND DEMONSTRATED COMPETENCE, AND TO UTILIZE PROFESSIONAL JUDGMENT AND DISCRETION IN SELECTING QUALIFIED PROFESSIONALS, AND TO NEGOTIATE ASSOCIATED CONTRACTS WHEREAS, the Idaho Code, including Idaho Code § 67-2320 requires that public agencies and political subdivisions of the state of Idaho make selections of professional engineering, architectural, landscape architecture, construction management, and professional land surveying services on the basis of qualifications and demonstrated competence, and shall negotiate contracts or agreements for such services; and WHEREAS, Idaho Code § 67-2320(3) allows political subdivisions to adopt their own guidelines for selection of the above professional services for contracts anticipated to be less than under $50,000 based on demonstrated competence and qualifications to perform the type of services required, followed by negotiation of the fee at a price determined by the political subdivision to be fair and reasonable after considering the estimated value, scope, complexity, schedule, and nature of services required; and WHEREAS, the City of Chubbuck is a political subdivision of the state of Idaho and the City of Chubbuck wishes to adopt its own guidelines for procurement of the aforementioned services for contracts anticipated to be under $50,000. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIiUBUCK AS FOLLOWS: Pursuant to Idaho Code § 67-2320, the City of Chubbuck, through its respective Department heads and authorized purchasing department personnel, is authorized to adopt guidelines for selection of professional engineering, architectural, landscape architecture, construction management, and professional land surveying services for contracts anticipated to be less than $50,000.00 on the basis of qualifications and demonstrated competence for these professional services; and 2. In exercising this discretion, Department heads and authorized purchasing department personnel, shall consider the estimated value, scope, complexity, schedule, and nature of services required; and RESOLUTION 2024- 3. Further, Department heads and authorized purchasing department personnel, shall be authorized to use their respective professional judgment and discretion to identify professionals' qualifications and demonstrated competence. To identify professionals' qualifications and demonstrated competence, the Department heads and authorizing purchasing department personnel should consider: a. Whether the professionals have experience with the type of project being considered by the City; b. Whether the professional has done business for the City of Chubbuck; c. What the reputation of the professional is, whether the professional has done business in the state of Idaho, and whether the professional is licensed to do business in Idaho; d. Whether the professional can meet expected deadlines, deliverables, and other needs of the City of Chubbuck; and e, Whether based on interactions with the professional, if the purchasing department or division could interact effectively with the professional. 4. In the event that there are multiple qualified professionals, the Department head and/or authorized purchasing department personnel shall have discretion to select the professional they believe is most appropriate for the needed work. 5. Once a professional is identified, the Department head and/or authorized purchasing department or division shall be authorized to negotiate a fee at a price determined to by the Department heads and/or authorized purchasing department personnel to be fair and reasonable after considering the estimated value, scope, complexity, schedule, and nature of services required.
