Land Use and Development Commission
Regular Meeting
February 13, 2024

Board Members Present: Chair Jason Mendenhall, Darell Stewart, Mike Schwartz, Carrie Holm,
Adam Thayer, Brett Hiltbrand, and Bryson Smith. Staff Members Present: Attorney Ryan Lewis,
Planning Manager Don Matson, Development Services Manager Sean Harris, and Community
Services Director Devin Hillam.
Mendenhall called the meeting to order at 6:OOpm.
Mendenhall asked if any commissioners had a conflict of interest with the items before the
board. None were reported.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF THE MINUTES: January 9, 2024.
Mendenhall entertained a motion to approve the minutes as emailed. Schwartz moved to accept
the meeting minutes of January 9, 2024 as emailed; Thayer seconded. The full commission
approved.
GENERAL BUSINESS
1. Discussion on the Comprehensive Plan Update.
Planning Manager Don Matson gave an update on the Comprehensive Plan update.
2. Discussion on Application Materials and Desired Content for Commission Review.
Planning Manager Don Matson went over application materials and desired content by
the Commission for review.
Board Member Roles and Responsibilities, Types of Applications, and Decision -Making
Training.
Community Services Director Devin Hillam and Attorney Ryan Lewis went over roles
and responsibilities, types of applications, and the statutory framework governing
Legislative and Quasi -Judicial decisions in Idaho.
Attorney Ryan Lewis stated that the Commission should make their decisions for
approval or denial on Quasi -Judicial applications on the information within the proper
established record and not outside information. If any Commission member receives
information outside of the proper established record they should not consider that
information when making a decision, and are required to disclose that information or
conversation during the meeting and before making a decision. If any information
outside of the established record effects their decision or causes them to change their
decision which should only be based off the information within the established record
that is available to everyone, then they should recuse themselves from making a decision
on that business item. Because the applicant is entitled to a decision based on the proper
record.
