Chubbuck Rd Zoning Development Agreementlaot\ CHUBBUCK 1 A A H A Memo To: Mayor and City Council Community Services Department Planning Services Division 290 E Linden Ave, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us From: Don Matson, Planning Services Manager Date: March 6, 2024 Re: Armstrong Trust Draft ZDA — 14330 W Chubbuck Rd At the Council meeting on January 17, 2024 the potential annexation and initial zoning for 14330 W Chubbuck Rd, owned by the Lamar Armstrong Revocable Living Trust. The item was presented to the Council with a recommendation for approval with a Zoning Development Agreement (ZDA). A ZDA includes not only zoning approval but a defined site plan that must be followed. The applicant expressed a willingness to enter into a ZDA with the City, which would place the property in R-3(ZDA) and R-4(ZDA) zones. Staff has been working with Knudsen Engineers, representing the Trust, regarding details of the agreement and accompanying site plan. There are two items in the agreement that staff would like to discuss with Council before completing a draft for consideration and approval. Restriction for Owner vs Rental Homes At the Council meeting on January 17, 2024 the issue of owner -occupied vs. renter - occupied homes was discussed. The applicant's representative said it was not the intent of the Trust to develop the property as a rental neighborhood, and stated the units would all be owner -occupied. Staff seeks input from the Council on this restriction as a condition of the ZDA. The question of owner- vs renter -occupancy will likely recur in the future, so long-term guidance on the matter will be helpful. Height Limits In neighborhoods that have predominantly single -story houses, the height of homes or other buildings in adjacent developments can be a concern. Applicant offers that the development would adhere to the 35 feet height limit in R -21P zoning, which is the same as the neighboring R-1 zone. (The LUDC recommended R -21D zoning.) In the future there will undoubtedly be commercial and residential developments proposed in Chubbuck with heights over 35 feet and next door to low density/1-2 story neighborhoods. A number of cities require "wedding cake architecture" to mitigate impacts on lower density neighbors. This approach requires that buildings over 2 stories are designed with tiers that step away from the neighbors with a pre -defined height and distance for each tier.
