CHUBBUCK 1 0 A H 0 Community Services Department Planning Services Division 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us APPLICATION FOR A TITLE MAP AMENDMENT (ZONE CHANGE) FROM SINGLE FAMILY RESIDENTIAL (R-1) TO LIMITED RESIDENTIAL (R-2) CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION REGULAR MEETING ON MARCH 12, 2024 SUMMARY DESCRIPTION: An application for a Title Map Amendment from Single Family Residential (R-1) to Limited Residential (R-2) on approximately 3.55 acres located at 5450 Cole Street in Chubbuck, Idaho. At the meeting, the Commission will consider whether the proposal satisfies the approval criteria in municipal code section 18.28.050.B. Type of Action: Recommendation. STAFF FINDINGS: After reviewing the application, Staff finds that it meets the requirements for the Change in Land Use District. • The Comprehensive Plan Future Land Use map designates this area for Low Density Residential land uses and development, which is supported by the R-1 and R-2 zoning districts. • The applicant has met City Code requirements to be heard for a Change in Land Use District. • Two story homes may cast a shadow that impacts properties to the north • See additional information below and in the attached exhibits. • Staff recommends approval with one condition: o Position future homes to minimize winter shadow impacts on existing homes to the north. FACTS BACKGROUND: This property was farmed until 2016 was previously owned by the Church of Jesus Christ of Latter-day Saints and planned for a future church building. Plans changed for the church and the site was sold to Scott and Beau Harris in 2023. The Copperfield Landing PUD borders the property on the north and east (PUD zone), and Copperfield Landing Division 1 to the west and Homestead Estates Division 4 to the south (R-1 zone). TYPE OF APPLICATION: Quasi -Judicial (Subject to appeal; decisions must be supported by the evidence and by applying law to the facts; decisions shall be based on the standards for approval). The Commission may recommend approval with or without conditions, may table a decision, or may recommend denial of the application. APPLICANT: OWNER: Scott Harris Scott Harris and Beau Harris 4555 Burley Dr 4555 Burley Dr Chubbuck, ID 83202 Chubbuck, ID 83202 LOCATION: The site is located at 5450 Cole St, between McKay St and Dell Rd. It comprises Bannock County parcel number RCLDS000100. Bordering the property are 5 homes to the north on McKay St, 4 to the east on Lucy Ave, and 4 to the south on Dell Rd. Homes on the north and east have 20' deep back yards against the property line. Homes to the south on Dell Rd have rear yards that range from 70' to 85' feet deep, and 3 of the 4 have garages in the back yards. Both the R-1 and R-2 zones have a height limit of 35' and a rear setback requirement of 20' minimum. At the winter solstice the ridge of a house (its highest point) of approximately 18' will cast a shadow of 40' to the north at midday. If the ridge of such a house was 20' south of the property line, the shadow could potentially shade the entire backyard of a home north of the property line. Homes to the east do not have the same shadow impact, the back yard is in full sun at midday. POLITICAL SUBDIVISION/AGENCY COMMENTS: No written comments were received as of this report. ANALYSIS AND RECOMMENDATIONS SPOT ZONING: As described in the Idaho Supreme Court ruling regarding Evans v. Teton County "a claim of 'spot zoning' is essentially an argument the change in zoning is not in accord with the comprehensive plan. There are two types of 'spot zoning.' Type one spot zoning may simply refer to a rezoning of property for a use prohibited by the original zoning classification. The test for whether such a zone reclassification is valid is whether the zone change is in accord with the comprehensive plan. Type two spot zoning refers to a zone change that singles out a parcel of land for use inconsistent with the permitted use in the rest of the zoning district for the benefit of an individual property owner." The proposal does not meet either of the definitions of spot zoning. The proposal: 1. Complies with the Comprehensive Plan. The R-2 zone supports the Low Density Residential designation on the Future Land Use Map. 2. Does not single out a parcel for development inconsistent with allowed uses in the zone to benefit an individual property owner. The purpose of the R-2 zone is to "...provide for neighborhoods of single household dwellings, class 1 production buildings, and abutting zero lot line residences..." (Title 18.08.10.C.). The proposed zone, and proposed use of the property, do not meet the definition of type two. STANDARDS REVIEW: The Commission must determine if it is in the best interest of the City of Chubbuck and adjacent landowners to recommend a Title Change to the Land Use (zoning) Map. See additional standards in EXHIBIT 2B. STANDARDS • • • •VAL: CITY CODE SECTION POLICY 1 The proposed map amendment would be in the community's best interest. RESPONSE This parcel has been vacant since farming ceased in 2076. It is completely surrounded by single-family development and is an infill parcel — all utilities and streets already serve the property. Market conditions have changed since the neighboring homes were built so R-2, with slightly higher density, is proposed. POLICY 2 The list of uses permitted by the land use ordinance would blend with surrounding land uses and the uses permitted in the proposed zoning district would be harmonious in terms of their scale, mass, coverage, density, and intensity with adjacent land uses. RESPONSE Neighboring lots to the north and east (in the PUD zone) average .2 acres or 8,700 square feet. The minimum size is 7,000 square feet in R-7, 6,000 square feet in R-2. The 2 zones have the exact same height limits and setback requirements. The list of uses is very similar and focuses on lower -density residential development. See EXHIBIT 3C for a comparison between the two zones. CHUBBUCK 1 0 A A 0 290 E Linden, Chubbuck, ID 83202 Phone 08.237.2430 www.CityofChubbuck.us STANDARDS FOR APPROVAL: CITY CODE SECTION 18.28.050.8A POLICY 3 The subject site is suitable for the type and intensity of land uses permitted under the proposed zoning district. RESPONSE The site is flat and utilities are available; it is suitable for the uses permitted in R-2. POLICY 4 The subject site would be adequately served by transportation routes, police, fire and EMS protection, water/sewer, schools, and other public facilities and services, or agencies, to serve the public health, safety, and general welfare under the proposed zoning district RESPONSE All streets, public services, public and private utilities, and other agency services are already serving the area. POLICY 5 The proposed map amendment is generally not in conflict with the goals, objectives, and policies of the adopted Comprehensive Plan. LUDC and Council shall have discretion in interpreting exact boundary locations of the future land use map designations when considering map amendment requests. RESPONSE The proposal furthers the goals, objectives, and policies of the Comprehensive Plan. More information can be found in EXHIBIT 3B. See additional standards in EXHIBIT 2B. Information on how the proposal relates to the Comprehensive Plan can be found in EXHIBIT 3B. EXHIBIT 2C provides a comparison of the permitted and conditionally permitted land uses in the R-1 and R-2 zones. Uses that may be conditionally permitted would include a public hearing before the LUDC with public notices, etc. per Title 18.28.010 and Idaho Statute §67-6509. STAFF RECOMMENDATION Staff recommends approval of the application. • It complies with the approval criteria found in section 18.28.050.8.a of City Code. • It complies with the Comprehensive Plan and is not deemed spot zoning. • The intended zone is appropriate for the neighborhood, allowing very similar land uses having the same setback minimums and height maximums. Development of the property will be required to follow standard procedures in Title 16 Land Improvement and Title 17 Land Development, including a traffic study. Recommended condition: o Position future homes on site to minimize winter shadow impacts on existing homes to the north. How is the proposal in the community's best interest? The said property was previously owned by The Church of Jesus Christ of Latter -Day Saints with the intention of constructing a church building, but their plans changed. The development of this current bare land with R-2 limited residential building is aligned with the Chubbuck Comprehensive Plan's Regional Vision Statement by "encouraging infill development within existing urban areas". 2. How do the list of uses permitted by Chubbuck Municipal Code section 18.08.040 for the requested zone blend with surrounding land uses? Surrounding properties directly West and South are in the R-1 single family residential zone, while properties directly North and East are in a Planned Unit Development zone. 3. How are the :uses permitted in the proposed zone harmonious in terms of scale, mass, coverage, density, and intensity with adjacent land uses? The R-1 zone allows for single household dwellings and class I production buildings, while the Planned Unit Development zone allows for a maximum choice of living environments. The land uses allowed in the proposed R-2 zone are similar to R-1, but have a lower minimum lot area requirement. Both R-1 and R-2 zones are allowable in the Future Land use Designation of Low Density. . 290 E. To you knowledge, is there anything that would prevent the site under the proposed zoning from being served by transportation routes, police, fire, EMS protection, water/sewer, schools, and other public agencies or facilities? There does not appear to be anything that should prevent the zoning change as this area has been developed with adequate roads, utilities and schools to service the area. 5. How is the proposed map amendment supported by the Chubbuck Comprehensive Plan? Please cite specific goals, objectives, and policies, including the future land use map, which relate to your proposal. The proposed change to R-2 zone is aligned with the Chubbuck Comprehensive Plan through the following points: -Chapter 4:Vision Statement: "encourage infill development within existing urban areas" -Chapter 4 Goal 1: "Direct urban growth to urban infill areas." -Chapter 4 Objective 1.2: "Take advantage of the existing investment in infrastructure by encouraging infill development" -Chapter 4 Objective 1.3: "Make investment in infill more attractive than sprawl" -Chapter 4 Objective 2.1: "Improve the appearance of residential areas." -Chapter 10 Objective 1.1(a): "Plan for a variety of housing types." -Chapter 10 Goal 2: "Encourage the development of a variety of housing types that are responsive to market conditions within the community." February 12, 2024 Land Use & Development Commission 290 E. Linden Avenue Chubbuck, ID 83202 Re: Submittal requirement ES "Conceptual Development Plan" Cole Street Dear Land Use & Development Commission: We are looking forward to developing the property along Cole Street that was previously planned for a church building for The Church of Jesus Christ of Latter Day Saints. It is understood that the current zoning for this property is R-1, which allows for single family residential. Properties directly North and East are zoned into a Planned Unit Development. On this application, however, we are asking for a zoning of R-2, which allows for land uses that are similar to R- 1, but have a lower minimum lot area requirement. Both R-1 and R-2 zones are allowed in the Future Land Use Designation of Low Density which this property is within. Given the affordability of land and housing, we deem it plausible for such zoning. The final proposed development plan will be in accordance with the approved Land Uses as outlined in the Chubbuck, ID code for R-2 single household dwellings. We believe this development is strongly aligned with the Chubbuck Comprehensive Plan, as it focuses on infill development of an existing area that is currently developed with adequate facilities, and will be a nice addition to the city. There are only two differences between them, permitted or conditionally permitted housing types, and minimum lot size requirements. • Duplexes are not permitted in R-1; to be built in R-2 it would need a public hearing and Conditional Use Permit (CUP) • Zero lot line homes are conditionally permitted (by a CUP) in R-1. In R-2 they may permitted by the City Council without a CUP only under certain conditions; if not they require a CUP. Zero lot line means the home is against the property line, each unit has it's own property, such as twin homes or townhomes — each is individually owned. • The minimum lot size in R-1 is 7,000 square feet. If a twin home is built in R-1, 11,000 square feet are required for the two units. In R-2 6,000 square feet is the minimum size for a single home. Twin homes in R-2 must share at least 8,500 square feet. Special accommodation. We are against this proposal. People build homes in that area assuming that their will be ONLY single dwelling homes there. Land use Sue Burton <dsburton07@outlook.com> Sun 3/3/2024 9:59 AM To:Don Matson <dmatson@cityofchubbuck.us> Homestead subdivision has been a single family housing development since before we moved here. In 2018 (?) the City allowed multi family townhouses on Siphon rd, I'm not sure how many are going in but they will generate more traffic, way more parking issues and once they're sold, they'll probably be rented unless measures have been addressed. Addressing the single family will be very difficult and parking will be so much worse for us and Siphon rd. There's no/very little off street parking. The ONLY way to change to R-2 on Cole st. would be for owner occupied single family homes or twin home with an off street parking lot included in plan. Single family is what the rest of the subdivision is so let's keep it that way, we don't want a bunch of rentals. Thanks James and Deanna Burton 834 Wendy st. As I mentioned, I am very interested in and concerned about the future of the land at 5450 Cole Street in Chubbuck. Our home backs up to the north side of the property with our main living space facing south. One of my biggest concerns with allowing the rezoning from R1 to R2 is that the property could eventually be approved to allow multi -story townhomes which could block a significant amount of sunlight from the main living space of our home. One thing that caught our attention when we bought our home last year was the living space is bright, sunny and cheerful. Having a home in the shadow of a community of townhomes could have a negative impact not only on the value of our home but also on the health and well-being of ourselves. There are numerous reports stating that natural sunlight plays a key role in mental well-being, physical health and sleep health. In my opinion, single family homes would be less dense and possibly single -story, if they are built comparable to the homes surrounding the property, and therefore would not block as much of the sunlight as a cluster of townhomes would block. Our home's main living space currently enjoys a beautiful mountain view; we knew when we purchased the property that this view would change but also were aware it was zoned for single family homes. Another concern is the effect the community built on that property would have on the current value of our home. I expect that the City of Chubbuck will respectfully consider the current residents' investment and help us to maintain the value of our homes. Thank you for your time and consideration of our concerns. Sincerely, Eileen and James Krammen 3/5/24, 7:48 AM Mail - Don Matson - Outlook R-1 to R-2 3.55 acres of land, 5450 Cole St, Chubbuck Ashlie Evans <tybug3506@hotmail.com> Mon 3/4/2024 9:46 PM To:Don Matson <dmatson@cityofchubbuck.us> To whom it may concern, In regard to the property that is located at 5450 Cole 5t in Chubbuck, my husband and I are in opposition of the proposal to change the zoning from Single Family Residential (R-1) to Limited Residential (R-2). We feel that the living structures that should be built on this land should remain consistent with the rest of the homes in our neighborhood, and by allowing the change from R-1 to R-2 to happen, this could allow townhouses or duplexes to be built. Another concern that we have is our decreased home value based on what will eventually be built on the land. Lastly, the developer could build with the intention to rent out whatever is built on the land, which of course could increase the chances of getting some questionable tenants, which could further drive down the surrounding home values. Thank you, Greydon Wright March 5th, 2024 5450 Cole Street Rezoning Hearing Dear Land Use and Development Commission, I am writing in opposition to rezone the property at 5450 Cole Street from R-1 to R-2. Reasons for this opposition include why we moved here, the aspects of the neighborhood, traffic concerns, and the money to be made by the Developer and the City. I understand and support infill development when used correctly. Changing the zoning to accomplish this in a developed area is not right. This lot is surrounded by single-family homes that fit the definition of R-1. When we first looked at houses in the neighborhood 5'/z years ago it was planned that the lot at 5450 Cole would be a church, the lot behind our house would have a couple of rows of single-family homes, apartments along Siphon, and a large park at the end of McKay by the City water tank. Looking at the zoning and development in the area at the time, that seemed logical and was OK with us. This plan at the time was one of the reasons we moved into the area. Now fast forward 5'/z years and the lot behind our house sold and the lot at 5450 Cole sold and plans have changed. We are now getting mult- plexs and apartments behind our house, no park at this time, and the lot at 5450 Cole will not be a church anymore. We are not against it not being a church. When it sold we figured with the zoning it would be just single-family homes as required in R-1 zoning. With this rezoning it will not be the single- family homes but, zero lot line residences with townhouses or duplexes more than likely. If these are anything like what they are building on Truman Street, they are compact, 2 -story, ugly buildings right in the middle of an R-1 zoning with single-family houses. Not very appealing for those of us in the neighborhood or those looking to buy one of the houses here (Not an improvement to the residential area). This is a quiet neighborhood where kids play in the streets and the traffic is light. In the neighborhood you have kids out playing in the street, people walking in the street (the sidewalks are hardly used), and light traffic. People who drive here live here and expect this. This rezoning will add more traffic in an area not built for what could come. The lot at 5450 Cole could fit approximately https://outlook.office.com/mail/inbox/id/AQMkADdjMT14NWE3LTA5YzMtNDIlYS1 hOTY1 LW13MjcwNTlkNjFhMABGAAADcJQCoBEPgE6%2F6bAnxYl... 1/3 3/5/24, 5:05 PM Mail - Don Matson - Outlook 10-12 single-family homes that will generate around 10 trips a day per home. Probably not much more or the same as a church, just not all on the same day. The lot at 5450 Cole could fit over 20-24 townhouses. That is over double the traffic in an area that sees little law enforcement. A stop sign was installed at Cole and McKay Street (right next to this rezoning) and nobody stops, not even the City employees. Now with adding this much more traffic someone is bound to not stop at hit someone or something. These residential streets are not made for this traffic. With Cole not a thru street to Siphon (Cole is in poor shape by Chubbuck Road too), you are sending this traffic down narrow streets that are barely wide enough for 2 -way traffic and parked cars. When it comes right down to it the only ones that get any benefit from this deal are the City and the Developer, not the neighborhood. The Developer stands to make a lot of money with the rezone, considering he only spent $10.00 for the lot when it was on the market for a lot more than this. By allowing the zoning change both the City and the Developer can double their money. (taxes for the City and selling homes/lots for the Developer). This is great for them, but bad for the neighborhood because we have to live with the additional traffic, eye sore from the townhouses, and the mistakes that the City makes when they allow development to run the City. I am in opposition to the rezoning of the property from R-1 to R-2 at 5450 Cole Street for the above reasoning. Lastly, the rumor mill flies in the neighborhood and I hope that this one is not true. I have heard that the developer is related to someone on the City Council and so this rezoning is a done deal before it even started. I would hope that if the rumor is true this individual would do the right thing and abstain from voting when the time comes and not push their agenda and think about who voted them in. The City and Planning and Zoning are there to represent us, the citizens, and do the right thing. Not there to push an agenda, fill the City coffers, or let development run them. I do not understand how this rezoning would be a "nice addition" to the city as stated in the application. It is only a "nice addition" to those who stand to make money and don't live in the neighborhood. A bunch of zero -lot line residences does not make a nice addition surrounded by a bunch of single-family homes. The only good to come from this rezoning is that the property will finally be developed and not the local dirt track and dust bowl in the summer anymore.
