STAFF MFMT3ERS PRESENT: Mayor Kevin England, City Attorney Ryan Lewis, Public Works Director Bridger Morrison, Community Services Director Devin Hillam, Parks Manager Aaron Schilhabel, Development Services Manager Scan Harris, Police Chief Nick Sasser, Fire Chief Merlin Miller, Human Resource Director Scott Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers. APPROVAL OF MINUTES. November 15, 2023. Councilmember Evans motioned for approval of the Council Meeting minutes. Councilmember Hernandez seconded motion for approval of minutes. Roll Call: Heiner -yes, Evans -yes, Hernandez -yes, Reece -yes, motion passed. GENERAL 13USTNESS: 1. Approval of Cascade Falls Preliminary Plat and the findings, facts and conclusions of law. (Council will discuss the application and if it meets City code). Applicant Ryan Satterfield presented a 6 lot Preliminary Plat for commercial building lots in the Cascade Falls at Harvest Springs Subdivision, Division 1, and requested to defer the secondary pressure irrigation pump station to a future division. Mr. Satterfield asked about staff's recommendation for development agreements between adjacent property owners. Mr. Satterfield also stated that this application included a temporary permanent access (Bluff Point Rd.) that will become a secondary access once the property to the south is developed which will allow Harvest Springs Blvd to connect to New Day Parkway. Development Services Manager Scan Harris stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval with conditions. Councilmember Reece motioned to approve Cascade Falls Preliminary Plat including the findings, facts and conclusions of law with conditions as presented by City Staff. Councilmember Heiner seconded motion for approval. Roll Call: Evans -yes, Hernandez -yes, Reece -yes, Heiner -yes, motion passed. 2. Approval of Philbin Crossing Preliminary Plat and the findings, facts and conclusions of law. (Council will discuss the application and if it meets City code). Jason Linford from Sunrise Engineering represented the applicant. Mr. Linford presented a 5 lot Preliminary Plat for commercial building lots in the Philbin Crossing Subdivision. Development Services Manager Sean Harris stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval with conditions. Councilmember Evans motioned to approve Philbin Crossing Preliminary Plat including the findings, facts and conclusions of law with conditions as presented by City Staff. Councilmember Hernandez seconded motion for approval. Roll Call: Hernandez -yes, Reece -no, Heiner -yes, Evans -yes, motion passed. 3. Acceptance of Offer of Dedication for Academy Campus. (Council will discuss if all city requirements have been inspected and completed). General Business item #3 was removed from the agenda 4. Acceptance of Offer of Dedication for Yellowstone Village. (Council will discuss if all city requirements have been inspected and completed). Development Services Manager Sean Harris stated that all city requirements had been inspected and completed and recommend approval. Councilmember Reece motioned for acceptance of offer of dedication for Yellowstone Village as presented. Councilmember Heiner seconded motion for acceptance. Roll Call: Reece -yes, Heiner -yes, Evans -yes, Hernandez -yes, motion passed. 5. Approval of Concord Corner Short Plat and the findings, facts and conclusions of law. (Council will discuss the application and if it meets City code). Jason Linford from Sunrise Engineering represented the applicant. Mr. Linford presented a 4 commercial building lots and 1 common lot short plat. Development Services Manager Sean Harris stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval with conditions. Councilmember Heiner motioned to approve Concord Corner Short Plat including the findings, facts and conclusions of law with conditions as presented by City Staff. Councilmember Reece seconded motion for approval. Roll Call: Evans -yes, Hernandez -yes, Heiner -yes, Reece -yes, motion passed. 6. Adoption of Ordinance 866 Idaho Power Franchise Fee Renewal. (Council will discuss granting Idaho Power a 25yr extension). Councilmember Hernandez motioned for the waiver of three readings, including the reading of one time in full for Ordinance 866. Councilmember Evans seconded motion for waiver. Roll Call: Hernandez -yes, Heiner -yes, Reece -yes, Evans -yes, motion passed. Councilmember Heiner motioned for adoption of Ordinance 866 as presented. Councilmember Hernandez seconded motion for adoption. Roll Call: Heiner -yes, Reece -yes, Evans -yes, Hernandez -yes, motion passed. Adoption of Resolution 2023-10 Administrative or Ministerial Claims. (Council will discuss administrative and ministerial claims against the City). City Attorney Ryan Lewis presented a resolution to set up a procedure to process claims against the City when there is no Council Meeting scheduled. The Council added wording that would allow any Councilmember to remove a claim until the next scheduled meeting. Councilmember Reece motioned for adoption of Resolution 2023-10 with modifications. Councilmember Hernandez seconded motion for adoption. Roll Call: Reece -yes, Evans -yes, Hernandez -yes, Heiner -yes, motion passed. 8. Review Parks Capital Improvement Plan Proposal and Possible Approval for the Mayor to enter into a contract for services with J -U -B Engineers. (The Council will Discuss and Possibly Authorize the Mayor to Enter into a Contract). General Business item #8 was removed from the agenda 9. Review Miller Park Master Plan Proposal and Possible Approval for the Mayor to enter into a contract for services with J -U -B Engineers. (The Council will Discuss and Possibly Authorize the Mayor to Enter into a Contract). General Business item #9 was removed from the agenda 10. Acceptance of 2023 Election Results. (Council will discuss the official election results from the county) Councilmember Hernandez motioned for acceptance of the 2023 Election Results. Councilmember Heiner seconded motion for approval. Roll Call: Evans -yes, Hernandez -yes, Heiner -yes, Reece -yes, motion passed. 11. Discussion about the December 20, 2023 Council Meeting. The December 20, 2023 Council Meeting will be canceled. CLAIMS: City of Chubbuck claims for December 6, 2023 as presented to Mayor England and Council. Councilmember Reece motioned to approve the City of Chubbuck Claims as presented.
