APPLICATION FOR AN AMMENDMENT TO A CONDITIONAL USE PERMIT
FOR A SCHOOL IN THE GENERAL COMMERCIAL (C-2) ZONE
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON NOVEMBER 14, 2023
SUMMARY
DESCRIPTION: An application for an Amendment to a Conditional Use Permit for a school in the General
Commercial (C-2) zone. The Amendment would allow for expansion of the school building. The subject
property of approximately 9.6 acres is located at 4200 Hawthorne Rd, Chubbuck, Idaho. The application
will be reviewed against criteria in section 18.28.020.C.5 of City Code. Type of Action: Decision.
STAFF FINDINGS: After reviewing the application and related materials, staff finds that it meets the
standards established by the City for a Conditional Use Permit (CUP) and has met requirements for
the application to be heard by the Commission.
• Schools are conditionally permitted in the General Commercial (C-2) zone.
The Design Review Committee has reviewed the site plan against technical requirements of the
City as required by city code and requested revisions from the developer; the committee's
recommendations are reflected in the site plan included with this report. The Committee did
not approve the use and only reviewed technical requirements:
o The committee directly reviews and approves such details as parking, landscaping, access,
utility services, and sanitation.
o The Land Use and Development Commission may approve other or more stringent
conditions on the proposal.
• Staff recommends approval of the proposed CUP and Findings of Fact and Conclusions of Law.
FACTS
BACKGROUND: In 2022 the LUDC granted a CUP for Pocatello/Chubbuck School District 25 to convert the
former Allstate building at 4200 Hawthorne Rd into a school — the Portneuf Valley Technical Education
Campus. The District received a grant to expand the campus to accommodate all of the Certified
Technical Education (CTE) programs offered. The building, used as a school, functions under a CUP and
any change such as an expansion requires an amendment to the CUP.
TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the
evidence and by applying law to the facts; decisions shall be based on the criteria and standards for
approval per section 18.28.020.C.5 of City Code). The Commission may approve with or without
conditions, may table a decision, or may deny the application.

Conditional Use Permit Amendment Application
E8. Explanation of how the use meets the Standards for Approving a CIDP (use additional sheet if
necessary):
2. How is the proposed change be in conformance with the goals, objectives, and policies of the
adopted Comprehensive Plan?
School District #25 will bring approximately 250 students and staff at varying times through -out
the day to study and learn inside this building. This number will be achieved with the added building
that will house Welding, Construction, and First Responders courses.
3. How is the proposed change compatible with other existing or permitted uses in the general
vicinity? Have changes been made to the proposal to enhance compatibility?
Gem Prep school Is located within 300' of this building but has its own dedicated parking. Home
Depot is located directly north of this site, again it has its own dedicated parking. Home Depot has
partnered with the Pocatello / Chubbuck School District CTE programs in the past and this location
would hopefully strengthen this partnership. The addition of this building will allow this and other
partnerships with Chubbuck employers.
4. How is the proposed use harmonious in scale, mass, coverage, density, and intensity
with all adjacent permitted land uses?
Original uses of the facility and parking lot was approved for 500-r staff and learners during the
day. The school district originally anticipated only using about one-half of the amount of individuals
at this building and parking lot throughout the entire day. We have noticed that many students
choose to ride the bus provided by the School District. This addition will eliminate approximately 50
parking stalls. It should also be noted that the school district, being a good community partner, has
allowed the INL to use the West parking lot for their shuttle service to their site. However, we can
regain many of these parking spots by giving them 90 days notice.
5. Are there any elements of the proposed use which could create undue burdens on
transportation, police, fire, EMS protection, water/sewer, schools, or other public
agencies or facilities in the vicinity? If so, how are the impacts being mitigated?
The new addition would not create undue burdens on the City of Chubbuck's agencies.

eastern entrance of the building is accessible it requires accessible parking and the 2

CHAPTER 9: NATURAL RESOURCES
GOAL 9.3 PROTECT AIR FROM POLLUTION
OBJECTIVE
9.3.1 Help citizens reduce reliance on automobiles and the number of daily vehicle miles traveled
POLICY
d. Provide a mix of land uses, a more -connected street network, and alternative modes of
transportation, including buses and shuttles
COMMENT
Locating a technical school at the site brings a mix of uses and visitors to the area and may result
in more transit use to the area.
CHAPTER 13: SCHOOL LOCATION AND TRANSPORTATION
GOAL 13.2 SUPPORT
THE MAINTENANCE AND ENHANCEMENT OF THE PUBLIC EDUCATIONAL SYSTEM
OBJECTIVE
13.2.1 Support efforts of the school district to ensure that adequate school sites are provided
