PUBLIC HEARING 1. An application for a Conditional Use Permit for a duplex at 200 Stuart Drive in the Limited Residential (R-2) zone in Chubbuck, Idaho. The site comprises approximately .25 acres of land, designated by the Comprehensive Plan Future Land Use Map for Medium Density Residential development. The application will be reviewed against criteria in section 18.28.020.C.5 of City Code. Type of action: Decision. Applicant Tonya Nield presented an application for a Conditional Use Permit for a duplex in the Limited Residential (R-2) zone on approximately .25 acres of land located at 200 Stuart Drive. The current residential home has two separate driveways for each unit and will have separate entrances for each unit. Planning Manager Don Matson stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval. The Board did have some concerns about parking, but felt like having two separate driveways and space available to expand one of the driveways if needed addressed those concerns. Mendenhall declared the public hearing open for public comment. Resident Scott MacDonald, was Opposed. Mr. MacDonald read a letter in opposition to the application and gave a history about the neighborhood. Mr. MacDonald was also concerned that the zone change would allow the property owner to build an apartment complex in the future. Due to no more public comment Mendenhall closed the public hearing. Attorney Ryan Lewis stated that this application was not for a zone change but for a conditional use for a specific use, and any other changes would require another application and public hearing and would not allow the owner to build an apartment complex under this permit. Schwartz motioned to approve a conditional use permit for a duplex at 200 Stuart Drive in the Limited Residential (R-2) zone; including the findings, facts and conclusions of law as presented. Hiltbrand seconded. With all commission members understanding the motion they voted. Roll Call Vote: Adam Thayer, Yes; Jason Mendenhall, Yes; Brett Hiltbrand, Yes; Mike Schwartz, Yes; Motion carried. GENERAL BUSINESS 1. Commission may discuss and ask questions regarding a memo sent on 9/7/23 regarding compensation for the Commission. Section 50-210 of Idaho Code deals with the establishment of "boards, commissions, or committees" and it contains express language prohibiting compensation for members of such entities while allowing compensation for "actual and necessary expenses", if allowed by ordinance of the City. Upon reviewing the section of code with the City Attorney, to comply with the law, the City of Chubbuck can no longer compensate members of City boards, commissions, and committees, including the Land Use and Development Commission (LDDC) for attendance at meetings. ADJOURN: Mendenhall adjourned at 6:33. Jason Mendenhall, Chairperson Joey Bowers, City Clerk
