Re: Preliminary Plat — Copperfield Landing Division 7
Applicant: Concordia Development Group
901 Pier View Drive, Ste. 204
Idaho Falls, ID 83402
Professional Services: RMES
600 E. Oak St.
Pocatello, ID 83201
Application: Copperfield Landing Division 7, approximately 11.7 acres
with 144 residential building lots, 1 club house lot, and 2
common area lots. Located in the NWNE'/4 of Section 4,
Township 6 South, Range 34 East, of the Boise Meridian,
on the south side of W. Siphon Road, west of Trueman
Street. Generally located at the 800 block of W. Siphon
Road.
Existing Zoning: Planned Unit Development (PUD)
Existing Land Use: Vacant
Staff Report: The preliminary plat for Copperfield Landing Division 7 is compliant with
the City Code Titles 16, 17, and 18 and the City's Comprehensive Plan. Specifically:
16.12.020: Public streets have been provided in accordance with the comprehensive
plan. Narrower private drive isles with no parking allowed are being proposed
within the development.
17.12.080.C: The preliminary plat application was determined complete and
comments were addressed by the applicant.
17.12.080.F: Representatives from City departments, other affected agencies, and
public utilities reviewed the plat and provided comments.
17.12.100.6.5: The Public Works Director / City Engineer has determined that this
development will result in significant traffic impacts in accordance with the
Subdivision Approval Criteria No. S. Therefore, a Category "A" Traffic Impact
Analysis is required to be submitted for review.
18.20.050: On August 17, 2021, the Public Works Director determined the currently
approved PUD plan was effective and no amendment was needed for the
proposed development.
18.20.060.A: The plat falls within the comprehensive plan future land use
designations of Mixed Use.
18.20.070.6.2: The proposed development is utilizing height and density as buffering
adjacent to lower density developments.
The Land Use and Development Commission (LUDC) recommended approval of the
preliminary plat at its regular meeting on April 11, 2023 after reviewing the criteria of
section 17.12.100 of City Code.
The following concerns from neighboring citizens with this proposed preliminary plat
have been presented to City staff:
• "Sanich and Melody Drives do not meet the minimum right-of-way width of 50 feet.
The plat also includes 2 extremely narrow un -named dead ends with no turnaround
on the west side of Cole St."
o Sanich and Melody Drives are both private drive isles internal to the development
with no parking allowed.
o The narrow un -named dead ends are actually common, private driveways for rear
load garages.
• "This plat does not seem to follow the guidelines of a PUD which are to be construed
liberally in the public interest."
o The preliminary plat for Copperfield Landing Division 7 falls under the approved
PUD plan that was approved under the previous PUD code section in 2014 and the
amended PUD plan in 2020. This development meets the requirements of the
previously approved PUD plan and amendment as determined by the Public Works
Director on August 17, 2021.
• "Why was there no public hearing for this plat?"
o A public hearing is not required to be held, Pursuant to section 17.12.080.E of City
Code, any affected person may, if no public hearing has been held, petition to hold
a public hearing in accordance with the standards and procedures found in the
same section of code.

208.237.2430
www.CityofChubbuck.us
• "Has an adequate buffer zone between SFR and HDR been provided?"
o The development is utilizing low and medium density residential as a buffer to
existing single family residential.
• "The area is zoned low density and mixed use but there is no low density."
o The subject property is zoned PUD which allows the uses proposed.
• "The size of multiple lots in the proposed development do not meet the minimum
lot size requirements and side yard setbacks."
o This development is proposed in the PUD zone which allows deviation from typical
lot size requirements. The minimum side yard requirement is being met and will be
verified at time of building permit.
• "How do you know you have provided enough storm water disposal?"
o A storm water report is required to be submitted with the construction plans that
meets the requirements of Portneuf Valley Stormwater Design Manual (PVSDM).
• "Is enough right-of-way being dedicated for Siphon Road?"
o 60' of right-of-way is being dedicated for the developments half of the Siphon Road
right-of-way, which when dedicated on the north side of Siphon Road will be a
total of 720' o f right-of-way.
• Staff Recommendation:
o Recommend approval
o If approved, recommend approval of Findings of Fact and Conclusions of Law.
• Recommended Condition(s) if approved:
o Submit a Category A Traffic Impact Analysis and review fee for review and
approval prior to submittal of the final plat.

impact fees will be collected
❑ Public parks/park land are proposed that will benefit more than just this development, parks impact fees may be adjusted only by
agreement between the city and the developer prior to construction, fund, or contribution based on the present value of system

3. The subdivision proposal complies with all applicable zoning requirements of the underlying zoning district, applicable
overlays, and other applicable development standards.
4. All public facilities including streets, sidewalks, curbs, gutters, secondary pressurized irrigation, water, sewer, fire
protection, and sanitation services can be provided to the newly created lots and accommodate future extension to
adjacent land. The use of a "control strip" intended to control or prevent the future extension of public facilities or
development of adjacent land is prohibited.
5. If city public works determines that the proposed subdivision will result in significant traffic impacts then a "traffic impact
study" will be required as part of the commission's review. A significant traffic impact is generally defined as occurring
when:
a. A proposed development or redevelopment of a site will generate 100 or more new peak hour trips; or
b. The added volume is equal to 1,000 vehicles per day.
6. The proposal provides for a continuation of a connected transportation system unless topography or natural features
prevents a connection to abutting streets or property.
7. The proposed subdivision provides for bicycle and pedestrian transportation routes and amenities in accordance with
Bannock Transportation Planning Organization's adopted bicycle and pedestrian plans.
8. Public utilities are provided to the newly created lots in public rights of way or in appropriately sized easements.
E5. If the development contains area with any FEMA or City of Chubbuck designated floodplains, the following must be
submitted:
1. If the development, either within a single phase or as part of a larger planned development, contains more than 50 lots or
5 acres, whichever is less, base flood elevations shall be determined prior to filing an application for a preliminary plat
and said determinations must be submitted with the application package.
2. If the development, either within a single phase or as part of a larger planned development, contains more than 50 lots or
5 acres, whichever is less, evidence must be submitted demonstrating that a CLOW application has been filed with
FEMA.
E6. Traffic Impact Analysis — Category A, Category B, or Statement. Follow the Traffic Impact Analysis Guidelines as adopted from
Bannock Transportation Planning Organization.
E7. Because every application is different, rules and regulations may differ and staff may require additional information or
submittals before an application can be deemed complete and ready for the review process beyond staff level.

Copperfield Landing Division No. 7 - Preliminary Plat Narrative
1. The subdivision proposal complies with the applicable provisions of this title. The current project as
proposed meets the applicable provisions of this title.
2. The subdivision proposal complies in principle with all applicable City design standards and
development regulations. All lot sizes, rights -of way, roadways, utilities etc. have been designed to
comply with the city standards and development regulations.
3. The subdivision proposal complies with all applicable zoning requirements of the underlying zoning
district, applicable overlays, and other applicable development standards. The current project is located
within an approved PUD within the city and will follow the same parameters and guidelines as the
previous phases.
4. All public facilities including streets, sidewalks, curbs, gutters, water, sewer, fire protection, and
sanitation services can be provided to the newly created lots and accommodate future extension to
adjacent land. The use of a "control strip" intended to control or prevent the future extension of public
facilities or development of adjacent land is prohibited. The current layout of the project allows for
continuation of public facilities to the north of Cole Street. There are no areas within this develop that
prevent or control access to adjacent lands.
5. If city public works determines that the proposed subdivision will result in significant traffic impacts
then a "traffic impact study" will be required as part of the commission's review. A significant traffic
impact is generally defined as occurring when:
a. A Proposed development or redevelopment of a site will generate 100 or more new peak hour
trips; or
b. The added volume is equal to 1,000 vehicles per day.
We have prepared a traffic impact analysis for this project and is being included in the preliminary
plat application. Please see this document for the traffic count details for this project.
6. The proposal provides for a continuation of a connected transportation system unless topography or
natural features prevents connection to abutting streets or property. As stated in item #4, the proposed
layout will allow for continuation of the roads to the north along Cole Street. There are no natural
features or topography that will prevent future connections.
7. The proposed subdivision provides for bicycle and pedestrian transportation routes and amenities in
accordance with Bannock Transportation Planning Organization's adopted bicycle and pedestrian plans.
The proposed subdivision will have sidewalks connected throughout the project that will tie into
previous phases of the neighborhood. This will provide adequate transportation routes for both
bicycle and pedestrian traffic to circulate throughout the neighborhoods.
8. Public utilities are provided to the newly created lots in public rights-of-way or in appropriately sized
easements (Ord. 773, 2018) The proposed project will have new water, sewer and irrigation utilities
provided within the right-of-way as well as a 15' public utility easement provided within the platted
subdivision for public utilities i.e. phone, cable, power and gas, to install their infrastructure to
provide services to the new townhomes that will be built.

DH,
After reviewing the detailed site layout current provided by the applicant, I agree with your
recommendation. The detailed plan appears to be in conformance with the previously approved PUD's
(including amendments).
The proposed site layout does NOT trigger the requirement to file an updated PUD plan as defined in
18.20.050.

Subject: Copperfield Landing- PUD amendment or not under the criteria? - Decision sought
Good afternoon, Rodney -
As the PWD with interpretation discretion in the new PUD code, I need your decision for the Copperfield
PUD's more detailed plan as to whether you'd consider it an "amendment" or just a modification that
works within the approved PUD plan already.
In my view, the PUD proposed by the new developer conforms with the currently approved PUD as well
as conforms with the PUD vision as was originally established in 2014. The residential areas in the new
plan match residential use areas in the currently approved plan and the mixed use areas that are shown
on the currently approved plan were designated that way to allow for commercial or residential uses
depending on the market. After reviewing the attached documents, my recommendation is that we
treat the PUD plan under the new developer as essentially the same plan as is approved and that it not
be deemed an amendment. I believe that we can process plats under the current PUD plan such as is
shown/proposed throughout the life of the project. I've attached the original PUD Plan from 2014, the
current PUD plan, the proposed PUD under the new developer, the amendment criteria, as well as the
complete plat/PUD application submitted by RMES for the new developer for your consideration.
Can you please let me know what you think?
Thanks,

GENERAL BUSINESS
1. An application for a preliminary plat for the Copperfield Landing Subdivision, Division
7. Applicant proposes to subdivide 11.7 acres into 145 residential lots. Property is in the
NW/NE 1/4 of Section 4, Township 6 South, Range 34 East of the Boise Meridian,
Idaho, generally located at 800 block of West Siphon Road, west of Truman St. and
south of W. Siphon Rd., Chubbuck, Idaho. Current zoning designation on the property
places it in the Planned Unit Development (PUD) land use district. The Comprehensive
Plan Future Land Use map designates this area as Low Density/Mixed Use. Application
will be evaluated against standards found in municipal code section 17.12.100. Type of
Action: Recommendation.
Brady Smith from Rocky Mountain Engineering represented the applicant. Mr.
Smith presented an application a 147 lot Preliminary Plat for 144 residential
building lots, 1 club house lot, and 2 common area lots in the Copperfield Landing
subdivision, Division 7.
Mendenhall asked if the two private drives Melody and Sanich would be built to
City standards in case they are ever turned over to the City in the future. Smith stated
that the developer would not be granting public right of way along those private
drives to the City, so he did not see who they could ever be turned over to the City in
the future.
Development Services Manager Sean Harris stated that this application had been
reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of
City Code, and recommended approval with conditions.
Thayer asked if the developer had received permission from the previous developer
to keep the name (Copperfield Landing) as found in Idaho Code 50-1507. Smith
stated that the previous developer was aware and had given consent.
Mendenhall stated that he was approached before the meeting from a couple
community members that asked if they could address some concerns with the Board.
Attorney Ryan Lewis stated that the Board can ask for comment from those in the
audience. But since this was not a public hearing they were not required to take public
comment. There is a process within City Code that allows the public to petition for a
public hearing.
The Board decided since there was already a process within City Code to follow
that process, so to not set a precedence for public comment in the future.
Ayre motioned to recommend approval of the Copperfield Landing Div. 7 Preliminary Plat as
presented to the City Council. Conditional upon secondary irrigation facilities be required to be
designed and constructed in accordance with section 16.12.230 of City Code, which will include
a pump station, preliminary plat recommendations are conditional upon City Council approval of
Copperfield Landing Division 7, and submit a Category A Traffic Impact Analysis and review
fee for review and approval prior to submittal of the final plat. Hiltbrand seconded.
With all commission members understanding the motion they voted.
Roll Call Vote: Mike Schwartz, Yes; Thais Ayre, Yes; Darell Stewart, Yes; Carrie Holm, Yes;
Jason Mendenhall, Yes; Brett Hiltbrand, Yes; Adam Thayer, Yes; Motion carried.
ADJOURN: Mendenhall adjourned at 6:14.

Joey Bowers, City Clerk
Concerns with Copperfield Landing Division 7 Preliminary Plat
Sanich Drive and Melody Drive do not meet the required minimum street width of 50 ft, creating
safety hazards, difficulties for emergency vehicles and sanitation vehicles, inadequate access to
mailboxes, difficulties with snow removal, and parking shortages. Neither street includes the
required pedestrian walks on both sides of the street. The plat also includes two extremely narrow
unnamed dead -ends with no turnaround space on the west side of Cole St.
Public streets or streets intended by the developer to be "private" have the same standards 17.04.020
The definition of a street is vehicular traffic for more than 3 households 18.06.350
Rules for construction of streets: 16.12.020
A- Provide convenience and safety
C- Shall in NO CASE be less than 50 feet (depends on the street type, but 24 ft is an alley and is
unacceptable)
D- A cul-de-sac must end in a roundabout or other suitable turnaround
E- Dead end streets shall be avoided
Q- Pedestrian walks are required on both sides of the street
Sanich and Melody Drive are both 24 ft wide. These streets are not safe. This 24 ft wide alley services 94
households (almost 200 vehicles) on Melody, and 32 households on Sanich. Lots 72-94 will be backing
out of their garage directly onto this narrow road and they do not have a driveway to back onto first and
will therefore not be able to see oncoming traffic. Twin homes are required to have direct street access,
and 24 ft does not constitute a street. If a resident would like to invite guests over, where are they going to
park? There is absolutely no room for safe parking on the street and most lots do not have a driveway.
There is also nowhere for residents to park while they access their mail on the north side of Sanich Dr. or
in the parking lot of the condos.
While a PUD allows standards to be modified if requested, the PUD process is not intended to skirt
development rules nor result in a detrimental impact on the surrounding community through its
implementation. 18.20.030. These narrow roads do not bring value, openness, convenience, or safety to
the neighborhood. They simply allow the developer to cram as many units as possible into a small space,
increasing profits for the developer and tax dollars for the city but not providing for the best interest of the
community.
This plat does not seem to follow the guidelines of a PUD which are to be construed liberally in
the public interest and used as a prescription of minimum land use standards. 18.04.030
• How does it show innovation and special features? 18.20.010
• How does it emphasize pedestrian and bicycle modalities when there is less
sidewalk than in a normal residential area? 18.20.010 (B.3)
• How does it provide diversity in design and use of common areas? All common
areas are to be used simply as storm water collection. 18.20.070 (G.3)
• How have you incorporated pocket parks, courtyards, and similar common areas
for internal use so as to convey a sense of openness and community within the
neighborhood? 18.20.070 (G.3.b)
Why was there no public hearing for this plat?
The Commission shall hold a public hearing before forming a recommendation to the Council.
PUD Amendments include but are not limited to an increase in the number of dwelling units or total
Concerns with Copperfield Landing Division 7 Preliminary Plat
square footage or height, or a decrease in the amount of approved open space or landscaping.
18.20.050
This plan is significantly different from the both plans submitted by Darris several years ago. Such
a significant difference should have required a public hearing. The current posted sign is difficult to see
and lists no date for the meeting. No written notice was given to residents about the preliminary plat, and
meeting minutes were not posted until April 4, giving residents insufficient time to petition a public
hearing. The neighborhood is prepared to petition a public hearing as well as take legal action if
necessary.
Have you provided an adequate buffer zone between the SFR and HDR?
There is no buffer zone between the Merzlock residence on the north side of Cole and the adjoining town
homes. Also, will the twin homes on the south side of Sanich provide enough a buffering by being single
level and have enough space between the back of the structure and the the back of the property line?
18.20.070. (B.2)
This area is zoned Low Density and Mixed Use but there is no Low Density. What are the
conditions for allowing the Medium and High Density Residential in the Mixed Use?
There is no R1- Single Family (Low Density)
Twin Homes are conditionally allowed under LD R- what are the conditions?
Apartments are not allowed in LD R and conditionally allowed in MU- what are the conditions?
All housing in plat is either MDR or HDR which is conditionally allowed in a MU PUD
18.20.060 (B)
The size of lots 95-114 does not meet minimum code of 1000 sq ft, and side yards are not
adequate between lots 104-105 and around the entire condo units.
Minimum lot area per household dwelling for R-4 is 2400 sq ft for the first, and 1000 sq ft for each
additional unit. Lots 95-114 are only 968 sq ft. 18.08.042
Side yards must be at least 10 ft. There is virtually no side yard between units 104 and 105, it is like
walking through a slot canyon. 18.08.042
There is not the required 4 ft side landscaping strip between the condos and the sidewalk / parking area
on the East and West sides. 18.20.080. (B.5.a)
How do you know you have provided adequate storm water disposal?
At least 75% of the plat is buildings or pavement. How do you know you have provided adequate
storm water collection to safeguard the adjoining lots?
Have you left enough space for the expansion of Siphon road in the future?
It is 75 ft from the north side of Siphon right up to the north edge of the condo buildings. This is
not adequate for either a major (100 ft) or a minor (80 ft) arterial street. Also, the expansion of Siphon
would eliminate nearly all green space and possibly the multi -use path. The only other option is to expand
northward which requires burial of the canal.
