GENERAL REQUIREMENTS AND PROCEDURES The following code regarding CUPs should be used in evaluating and weighing the application: 18.28.020.CS. Standards for Approving a CUP: A CUP may only be approved if the Commission makes affirmative findings of fact on each of the following standards. These are addressed by the applicant with the submittal (see attached), section E8 on pages 2 through 4 of the application: 1. The proposed use is conditionally permitted in the subject zoning district and complies with all of the applicable provisions of city code unless modified through the conditional use permit process. 2. The proposed use is generally not in conflict with the goals, objectives, and policies of the adopted Comprehensive Plan. 3. The proposed use is compatible with other existing and permitted uses in the general vicinity. 4. The proposed use is harmonious in scale, mass, coverage, density, and intensity with all adjacent permitted land uses. 5. The proposed use would not place an undue burden on transportation, police, fire and EMS protection, water/sewer, schools, and other public facilities or agencies, in the vicinity. 6. The proposed use, if it complies with all conditions imposed, will not adversely affect other properties or the environment in the vicinity to a materially greater extent than would uses permitted outright by this Code. 18.28.020.C6. Conditions for Approval: To make affirmative findings relating to the standards established in section 18.28.020.C.5, the Commission may condition approval of the permit on compliance, including but not limited to, the following: Conformity to approved plans and specifications. The Comprehensive Plan Future Land Use Map designates the area as Commercial, allowing for both the General and Limited Commercial zones (C-2) and (C-1). Storage units at this location, near an industrial district and removed from any arterial streets, meets several requirements of the Comprehensive Plan, particularly regarding light industrial land uses, and the transportation system. 2. Provision of open spaces, pathways, buffer strips, walls, fences, landscaping, and lighting. The Design Review Clearance included standards to prevent light trespass to residential neighbors, provide landscaping along New Day Parkway, and the solid walls of the storage units 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 CHUBBUCK www.CityofChubbuck.us 1 0 R H 0 will provide a security wall along the east (railroad) and west sides of the project. Security fencing is planned on the north and south sides of the site and in gaps between storage buildings on the perimeter. Minimizing adverse impact on other development. The nearest developments to the project are manufacturing to the north across New Day, and single-family to the east across the railroad. Noise and light are not anticipated to impact other developments. Proximity and height of the buildings may have minimal impact. Buildings in the C-2 zone are allowed to build next to side and rear property lines with no setback. • The 3 buildings on the east side of the project are proposed at or near the railroad property line. The railroad right-of-way is 100 feet wide. • The trail connections to Jerry Rowland Park separate the nearest homes to the railroad property line by approximately 30 feet. This places at least 130 feet of separation between the homes and the storage units. Buildings in the C-2 zone are allowed to build up to 70 feet high. • The maximum height of the storage buildings in the Design Review was under 12 feet. • Homes across the railroad from the project site are all one story high. However, they will be taller than the storage unit buildings. 4. Controlling the sequence and timing of development. Because the project is not building any new street and utilities are stubbed into the property, the sequence and timing should not disrupt traffic or utility service provision. 5. Assuring that development is maintained properly. The development is planned to have fencing and buildings around the perimeter. Landscaping along New Day, and potential damage or defacing the buildings, are the main concerns to the public regarding maintenance. Designating the provision of on-site or off-site public facilities or services. There are no outstanding issues. 7. Requiring more restrictive standards than those generally required by the Code. The development is adhering to higher standards than are normally required in the C-2 zone. Requiring the mitigation of effects of the proposed development upon service delivery to the property by any political subdivision, including school districts. No comments have been received from utilities, the school district, or other political subdivisions. STAFF RECOMMENDATION Based on the Standards for Approving a CUP, and Conditions for Approval above, staff recommends approval of the Findings of Fact and Conclusions of Law, with the proposed use, site plan, and other details of the project as presented. The proposed use also retains more of the Yellowstone Commercial corridor. 3. How is the use compatible with other existing or permitted uses in the general vicinity? Have changes been made to the proposal to enhance compatibility? The proposed use would be compatible with the with the existing and proposed uses adjacent to the property. The property to the east is used as a railroad. Our development would act as an auditory and visual buffer for the properties to the west. The property to the south is intended to be a multi -family use. Our development would be a noise and pedestrian traffic buffer and provide the residents with a nearby location to store items that they do not have room for in their residence. The property to the north is zoned industrial and our proposed use is permitted outright in that zone. The property to the west is intended to be commercial uses such as fast food, gas stations and smaller commercial fronts. Our development would act as a transitory buffer from 4. How is the proposed use harmonious in scale, mass, coverage, density, and intensity with all adjacent permitted land uses? Below are the Design Review Committee (Committee) comments and requirements for clearance for the project. Address all items marked with a • at the appropriate points in the development process. Please contact me if you have any questions. Regards, Don Matson, Planning Manager Phone: 208-239-3252 1 Email: dmatson@cityofchubbuck.us Design Review clearance is not an approval of other required permits or licenses and is only an approval of authorized functions of the Committee per Chapter 18.16 of Chubbuck Municipal Code. Land Use and Zoning All nonresidential developments require Design Review Clearance, addressed in this memo. In the C-2 zone self -storage units are conditionally permitted, and not permitted in R-4. a. A Comprehensive Plan amendment to Commercial is required (in process), followed by a zone change to C-2 and approval of a conditional use permit (CUP): i. CUP: City Code Chapter 18.28.020 Land Use Administration, Chubbuck CUP. All major modifications to an approved CUP require an additional public hearing. ii. Zone change (Title Map Amendment) Idaho Statute 67-6511: Zoning Ordinance. iii. Comprehensive Plan Amendment: City Code Chapter 18.25.050 Plan Amendment. City Code has special requirements for Self-service Storage Units. a. The Committee can consider whether a residential facade or features should be included where project faces homes or residential zone; not required by Committee. b. Maximum 3 acres size and 1500' separation; project meets requirements c. Drive aisles minimum 20' wide; project meets requirements d. Perimeter fences are required and must be at least 6' high, and no ribbon fences or barbed wire fences are allowed. Barbed wire can be above a security fence; project meets requirements. e. A solid fence is required where project faces homes or residential zone. i. Note 5 on site plan indicates that solid fences against residential zones shall be installed by individual property owners. The requirement, per section 18.12.050.D, is for the storage unit facility to provide the fence facing residential zoning. The southern boundary of the site will be adjacent to the R-4 zone which requires a solid fence with the development. Page 1 • Amend the site plan for the CUP application; include sign permit with building permit application(s) and construct fence with building(s). f. Structures can cover no more than 50% of the lot area; the proposal meets requirement. Traffic Study Standards 1. A traffic study has been submitted for all of Legacy Park, as required in City Code, and it meets the requirements in the established BTPO Traffic Impact Analysis Guidelines. Police / Public Safety 1. No concerns. Lighting Standards 1.
