At the meeting, the Commission will consider whether the proposal satisfies the approval criteria in municipal code section 18.28.050.6. Type of Action: Recommendation. (Action item) STAFF FINDINGS: After reviewing the application, Staff finds that it meets the requirements for the Change in Land Use District. • The Comprehensive Plan Future Land Use map designates this area for Commercial land uses and development, which is supported by the General Commercial (C-2) and Limited Commercial (C-2) zoning districts. • Although the existing use is residential, it is underdeveloped at 1 unit per acre in the commercial core of the city and is better suited for future development with the parcel in the C-2 zone. • The applicant has met City Code requirements to be heard for a Change in Land Use District. • Staff recommends approval of the application without conditions. o C-2 zoning complies with the Comprehensive Plan and is not deemed spot zoning. It proposes to bring the entire parcel into one zone. FACTS BACKGROUND: This property includes an older home, detached garage, and other outbuildings. Most of the surrounding properties are residential — single-family (including manufactured housing) and apartments. However, most of the surrounding properties are also in the C-2 zone, which was established decades ago. The apartments south across Chubbuck Rd are in the PUD zone, while the single-family homes and apartments on Lish St are in the R-2 zone. TYPE OF APPLICATION: Quasi -Judicial (Subject to appeal; decisions must be supported by the evidence and by applying law to the facts; decisions shall be based on the standards for approval). The Commission may recommend approval with or without conditions, may table a decision, or may recommend denial of the application. ANALYSIS AND RECOMMENDATIONS SPOT ZONING: As described in the Idaho Supreme Court ruling regarding Evans v. Teton County "a claim of 'spot zoning' is essentially an argument the change in zoning is not in accord with the comprehensive plan. There are two types of 'spot zoning.' Type one spot zoning may simply refer to a rezoning of property for a use prohibited by the original zoning classification. The test for whether such a zone reclassification is valid is whether the zone change is in accord with the comprehensive plan. Type two spot zoning refers to a zone change that /641-0,e\ CHUBBUCK 1 0 R H 0 290 E Linden, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 www.CityofChubbuck.us singles out a parcel of land for use inconsistent with the permitted use in the rest of the zoning district for the benefit of an individual property owner." The proposal does not meet either of the definitions of spot zoning. The proposal: 1. Complies with the Comprehensive Plan. The General Commercial (C-2) zone supports the Commercial designation on the Future Land Use Map. Does not single out a parcel for development inconsistent with allowed uses in the zone to benefit an individual property owner. The purpose of the General Commercial (C-2) zone is to "provide for a broad variety of business establishments." (Title 18.08.10.1-1.). The proposed zone does not meet the definition of type two. A proposed use of the property is not part of this application. STANDARDS REVIEW: The Commission must determine if it is in the best interest of the City of Chubbuck and adjacent landowners to recommend a Title Change to the Land Use (zoning) Map. See additional standards in Exhibit 2B. STAFF RECOMMENDATION Staff recommends approval of the application. • It complies with the Comprehensive Plan and is not deemed spot zoning. Di 290 E Linden, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 CHUBBUCK www.CityofChubbuck.us 1AAHA STANDARDS FOR APPROVAL: CITY CODE SECTION 18.28.050.8A POLICY 1 The proposed map amendment would be in the community's best interest. RESPONSE Yes. The Chubbuck Rd corridor from this area to beyond Yellowstone Ave are designated for Commercial zoning districts. POLICY 2 The list of uses permitted by the land use ordinance would blend with surrounding land uses and the uses permitted in the proposed zoning district would be harmonious in terms of their scale, mass, coverage, density, and intensity with adjacent land uses. RESPONSE Surrounding properties on three sides, as well as the majority of this parcel, are already in the General Commercial (C-2). There is a mixture of commercial uses and mixed residential densities along Chubbuck Rd. POLICY 3 The subject site is suitable for the type and intensity of land uses permitted under the proposed zoning district. RESPONSE There is only one access point and Chubbuck Rd is an arterial street. However, the size of the parcel, less than one acre, prevents the development of a very intense use. POLICY 4 The subject site would be adequately served by transportation routes, police, fire and EMS protection, water/sewer, schools, and other public facilities and services, or agencies, to serve the public health, safety, and general welfare under the proposed zoning district RESPONSE All utilities and other services are available at or near the site, with capacity to accommodate development. POLICY 5 The proposed map amendment is generally not in conflict with the goals, objectives, and policies of the adopted Comprehensive Plan. LUDC and Council shall have discretion in interpreting exact boundary locations of the future land use map designations when considering map amendment requests. RESPONSE The proposal furthers to goals, objectives, and policies of the Comprehensive Plan. More information can be found in Exhibit 3B. STAFF RECOMMENDATION Staff recommends approval of the application. • It complies with the Comprehensive Plan and is not deemed spot zoning. Di 290 E Linden, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 CHUBBUCK www.CityofChubbuck.us 1AAHA • It proposes to bring a parcel into one zone and resolve the multiple zone issue. Currently, approximately 80% is in C-2 and 20% is in R-2. • Although the existing use is residential, it is underdeveloped at 1 unit per acre in the commercial core of the city and is better suited for future development with the parcel in the C-2 zone. • Recommended conditions: none. How is the proposal in the community's best interest? If this request is granted the existing house and outbuildings on the property would be demolished and replaced with several townhouse units. The results would be much more aesthetically pleasing, it may increase the value of surrounding property over time. The local economy will benefit from the new construction and the local tax base will increase. 2. How do the list of uses permitted by Chubbuck Municipal Code section 18.08.040 for the requested zone blend with surrounding land uses? Manufactured Homes, Single Family Dwellings and an apartment complex can all be found within 200 feet of the applicant property. The Applicants proposed Townhouses provide less density than an apartment complex and would improve the look of the neighborhood while remaining congruent with the existing land uses of the neighborhood. 3. How are the uses permitted in the proposed zone harmonious in terms of scale, mass, coverage, density, and intensity with adjacent land uses? There is an existing R4 zone within 300 feet of the applicants property which is the same zone the applicant is requesting. The density will be slightly more that the nearby manufactured homes and less than the nearby apartment complex. The Nearby land use is almost entirely residential except for an electrical supply store. The Applicants proposal is in harmony with the existing land uses of the neighborhood. 290 E.
