Chubbuck Road (Action Item) In accordance with Section 18.16.040.H of City Code, an appeal of a Design Review Committee Decision has been filed for review by the City Council. At issue primarily is the southern -most proposed access onto Branson Drive, a classified local street. The applicants for the design review committee clearance already proposed a full access onto Branson due north of the desired second access and the second access (the access in question with this appeal) has been proposed to be either a full access into the development, or an access for just tractor trailer loading/unloading and city sanitation for dumpster removal. Chubbuck's code require that the BTPO Access Management Guidelines be satisfied (section 16.12.025) and that the Design Review Committee review projects for conformance with the Access Management Guidelines (18.16.040.13). Table 3c of the Guidelines contains the General Provisions for Access on to Local Streets and they state: Direct Access: One access may be allowed from a local street to an individual parcel or to contiguous parcels under the same ownership or control if such access will not be detrimental to the safety and operation of the street. Lot Splitting: no additional access rights shall accrue upon the splitting or dividing of existing parcels or contiguous parcels under or previously under the same ownership or control. All access to newly created properties shall be provided internally or as determined by the governing body. Additional Access Points: Additional access may be provided if the applicant establishes that the additional access would not be detrimental to the safety and operation of the street. Additional access points would be subject to all access management guidelines unless variances are granted. Upon review of the Guidelines, one access into the common development at Patriot Square was already approved just north of the southern access to the flooring business, thus allowing for one direct access already. The lots in Patriot Square were or are currently owned by the developer and are part of the same development. Because the other uses on Branson Drive are residential in nature (directly across the street are single family residences), the Committee determined that no additional access points could be granted since they would be detrimental to the safety and operation of the street currently and in the future as the area continued to redevelop. \\cbkl-fs01\Public Works\Planning\Design Review\Design Review since Nov 2022\Chubbuck E 451 -Factory Direct Flooring\2.8.23 Memo to Council re appeal of DRC decision_letter.pdf.docx Attached are: Appeal Letter Chapter 18.16 of City Code — Design Review Criteria In Chronological Order a. 10/10/22 Design Review Application Materials b. 10/25/22 Design Review Decision c. 12/21/22 Submittal of Site Plan with Different Layout d. 1/10/23 Design Review Response e. 1/24/23 Submittal of Alternative Proposals for Truck Access f. 1/27/23 Design Review Decision \\cbkl-fs01\Public Works\Planning\Design Review\Design Review since Nov 2022\Chubbuck E 451 -Factory Direct Flooring\2.8.23 Memo to Council re appeal of DRC decision_letter.pdf.docx 2 rIED 1 O P T R A December 21, 2022 City of Chubbuck City Council Attn: Joey Bowers 290 E. Linden Avenue Chubbuck, Idaho 83202 RE: Patriot Square — Lot 3 Design Review Decision Mayor and City Council, On January 30, 2023, a letter was received from city staff and the Design Review Committee denying the proposed layout for Lot 3 of Patriot Commercial Subdivision. Patriot Commercial is requesting an appeal hearing to address this denial. Patriot Commercial and Dioptra have worked together to create civil site plans and site layout for the east side of Patriot Square Commercial Subdivision. Recently a short plat was presented to City Council to adjust a lot line on the east side to accommodate a new building south of AmeriTitle and create an additional building pad. Dioptra and Patriot Commercial have worked with city staff to review the site layout and new parking lot design. The proposed tenant, Factory Direct Flooring, requires loading/delivery doors for delivery of flooring and carpet and for customers to load their purchases. The initial comments from design review regarding the layout addressed concerns with the delivery trucks encroaching on the pedestrian sidewalk along Branson. This concern was addressed in our second round of layout and moved the building as far west as possible. The developers prefer that the proposed Lot 3 layout not encumber Lot 4 to the west and the stormwater pond on the south side of Lot 3. The developers are not interested in another replat within this development to move adjust/move lot lines. The developers are requesting an Appeal Hearing at the next City Council meeting on February 15, 2023. Sincerely, C Stewart K. Ward, PLS 4880 Clover Dell 208-237-7373 Chubbuck, Idaho 83202 CHAPTER 18.16 DESIGN REVIEW CRITERIA SECTION: 18.16.010: Applicability; Purpose 18.16.020: Authority Of The Administrator And The Committee 18.16.030: Application 18.16.040: Clearance Approval 18.16.050: Fees And Costs 18.16.010: APPLICABILITY; PURPOSE: Design Review is required for building, developing, or substantially altering the exterior of buildings or sites in all zones in the City of Chubbuck for any commercial or industrial building/use, for any residential buildings with three (3) or more single-family units, including, but not limited to, apartments, threeplexes, townhomes, etc., or for any residential development containing densities greater than six (6) units per acre. The primary purpose of the process is to identify the technical requirements of city code that will apply to each unique project and how to apply them to each project. A. Exemptions (unless otherwise required by a stricter portion of city code such as in the Village or Highway Corridor districts or Creative Community district, or unless required by a separate development agreement): 1. Structures not visible from a public street, private street, or abutting residence; 2. Structures fully screened from all abutting property lines not owned entirely by the applicant; 3. Maintenance and repair of existing exterior facades; 4. Modifications to exterior finishes that do not change the materials, including but not limited to paint, stain, or other exterior finishes; and 5. Roofing materials. 6. Accessory dwelling units are not considered towards density calculations. B. Design Review is required for site alterations, including, but not limited to the addition, removal, or modification of site improvements and/or features such as access, parking, landscaping, or any other alteration which modifies the site, approved conditions, and/or the requirements of Chubbuck city code. The Administrator of the Design Review Committee has the discretion to determine if Design Review is required. C. Design Review approval must be obtained prior to making application for any conditional use permit, preliminary plat, short plat, or building permit when required by this section. D. The Committee may approve any condition necessary to ensure the health, safety, and welfare of the public is not jeopardized, and to ensure that the technical requirements of the city code will be met. F. A decision by the Committee is specific only to the technical details of City Code, and is not an approval for any other separate authorization required by City Code such as a conditional use permit or plat, nor is it a complete list of detailed technical requirements for approval of a project. G. If an applicant disagrees with the written findings of the Committee, then the applicant must, prior to making an appeal to the Council, submit a request to reconsider in writing, stating the specific requirements with which the applicant takes issue. Traffic Safety and Traffic Congestion: (ingress, egress, off-street parking, unloading) • Access approved with subdivision plat. • Loading dock off Branson is problematic — residential neighborhood, tractor -trailer trucks would block sidewalk. Trucks backing down street on their blind side also a problem. Applicant needs to explore other options and report back to city for further discussion. 2. Traffic Studies, Utility Studies: (as requested) • Applicant needs to submit a Traffic Impact Statement with their building plans. 3. Drainage: (storm & surface water, to be engineered, retained on site) • Drainage has been accounted for in the Patriot Square design, will need to utilize the existing system. 4. Pretreatment / Nonresidential Waste Water Permit: (grease or oil/silt separator) • Standard wastewater discharge permit required. 5. Development Agreement (when needed) • Yes. However, short plat is not required. 6. Structures and Site Layout: (exterior design, buffering, fencing, dumpster enclosure) • Need to see details of dumpster enclosure on construction plans. • Need buffering between commercial activity and any residential zone within 40'. Homes facing Chickadee are 50+' away, but buffer needed from house at corner of Chickadee and Branson — 6' solid fence on north and west sides of the residential lot will satisfy code. 7. Building Department: (professionally approved plans, ADA compliance, dumpster enclosure) • Submit plans to Building Department. • Sidewalk ramp improvement recommendation is to follow a linear path. 8. Signs/ Advertising: (advertising signs, height, structure) • No problem with the sign shown on building. No limit on size, however, a separate building permit must be issued for most signs. A monument sign may be approved with an advised controlled lighting system because of residential properties across the street, and an additional permit must be issued. 9. Landscaping: (ordinance copy, approved tree list) • Requirements met in parking area (minimum 544 square feet landscaping beds and 3 trees) • Need 2 trees and 18 shrubs on Branson street side. Be mindful of sight triangles. • Submit final landscaping plan with or before building permit for review. 10. Exterior lighting: (light shielding, light trespass) • It was recommended to add a streetlight. • No trespass lighting onto residential neighbors on Branson and south side. 11. Development: (platting, addressing) • Address is 451 E Chubbuck Rd 12. Fire Department: (knox Box, fire hydrant locations, sprinkling, visible street address) • Needs a single knox box. 13. Police Department: (safety issues) • Concerned with delivery and parking on Branson. 14. Business License: (before opening) • Required 2 weeks prior to opening. There are several concerns that require attention. Please contact me if you have any questions — Design Review is no longer under the Clerk's office. I'm now the point of contact for Design Review Clearance. Regards, Don Matson, Planning Manager Phone: 208-239-3252 1 Email: dmatson@cityofchubbuck.us Loading Area/Site Layout: The committee comment was "Loading dock off Branson is problematic — residential neighborhood, tractor -trailer trucks would block sidewalk. Trucks backing down street on their blind side also a problem. Applicant needs to explore other options and report back to city for further discussion." The building has been moved west to help accommodate trucks from blocking the sidewalk. In doing so, the dumpster enclosure has been relocated to the south side of the truck access and the truck access has been revised to a full access to allow for garbage pickup. Although the updated layout is convenient for sanitation service there are other issues with it. The Committee asked for multiple layout options, specifically to explore options that wouldn't require trucks to back down the street on their blind side. Only one variation was submitted. The loading access is showing a change to a full access, which city policy doesn't allow without an approved exception. The adjustment that was made does not address the concerns about the proximity to and impact it will have on the residential neighborhood or the truck backing down the street on their blind side. Other layouts should be investigated, such as moving the loading area to the west of the building, with parking east or north of the building, a shared access agreement or expanded parcel footprint. Page 1 Submit alternative(s) that are most suitable for the applicant and the city for further discussion. 2. Branson Access: Changing to a full access on Branson is in violation of Access Management Guidelines. Branson is a local street and should experience less commercial traffic. 3. Curb Radii: Access Management Guidelines also require 30' radius for curbs. The approaches on the plan are shown at 25' and 15'. Design Review clearance is not an approval of other required permits or licenses and is only an approval of authorized functions of the Committee per Chapter 18.16 of Chubbuck Municipal Code. /944c-\ CHUBBUCK 1 0 R H 0 290 E Linden Avenue, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 www.CityofChubbuck.us r1D 10 P TR A Patriot Square Commercial - East Patriot Commercial Properties LLC Design Review — Factory Direct Flooring - Revision Notes Prepared by Dioptra, Stewart K. Ward, PLS January 24th, 2023 Design Review Committee, Thank you for working with Dioptra and Patriot Commercial to review and discuss the layout options for Lot 3 Patriot Square. We have prepared layout options to assist in determining the best overall layout for the site. All options have adjusted the main access curb radius to 30' as requested. The layout options are included with this memo and the impacts of each option are listed below in order of preference: Option 1 (,Original Design) — The truck loading ramp access off Branson. The ramp area is connected to the parking area. The dumpster enclosure is located on the south side of the loading ramp to allow direct access of garbage trucks from the interior of the parking lot. Option 2 — The truck loading ramp remains in the previous location. The ramp area has been separated from parking area via a curbed landscape island. The dumpster enclosure has been adjusted to allow direct access of garbage truck from Branson Drive. - Impacts are minimal for this option. Anticipated costs remain similar. Option 3 — Find New Location in Pocatello/Chubbuck Area Option 4 — The building has been rotated 90 degrees to place the loading docks in the NW corner of the building. The truck access to Branson has been eliminated. Dumpster location placed to allow feasible access by garbage truck. The building is placed at 5' offset from west property line and 20' offset from south property line. As shown, the delivery trucks extend into the traveled way of the main access road. The storm water pond will need to be reconfigured to retain the needed capacity. - Impacts are significant for this option. Storm Pond redesign and reconstruction. Building redesign to move loading dock to NW corner and Entrance to NE corner. Structural fill required in existing pond to support building foundation. The parking area east of the building requires an increase in paved area. Option 5 — The building has been adjusted to place the loading docks in the NW corner of the building. The truck access to Branson has been eliminated. Dumpster location placed to allow 4880 Clover Dell 208-237-7373 Chubbuck, Idaho 83202 rID 10 P TR A feasible access by garbage truck. The building is placed at 5' offset from west property line and at a location that allows delivery trucks to avoid conflict with main access road. The storm water pond will need to be reconfigured to retain the needed capacity. - Impacts are significant for this option. Storm Pond redesign and reconstruction. Building redesign to move loading dock to NW corner and Entrance to NE corner. Structural fill required in existing pond to support building foundation. One item to note is that all deliveries to the proposed building on Lot 3 will happen during regular business hours and not early morning or late-night hours to reduce the impact to the residences along Branson. Parkin The proposed building is 7,000 sf with approximately 875 sf used for mechanical and restroom facilities. Based on research of national standards, warehouse use would suggest that 2 spaces are needed for every 1,000 sf of building space. This would require (7,000 — 875 = 6,125) 6,125 / 1,000 = 6.1 x 2 = 12 spaces plus assumed 4 employees is a total of 16 spaces. If the building converts to an office or retail use it is suggested that 5 spaces are needed for every 1,000 sf of building space. Using the same equations as listed above, the sight would require 35 spaces. The Design Review Committee has met to discuss the options you provided earlier this week. In reviewing the site, surrounding area, adopted Access Management policy and public safety, the Committee will not approve a site layout that includes access to Branson Dr. The parking analysis you included in your last memo provides reasonable justification to determine the number of spaces that should be provided for a warehouse use. The City does not consider potential future uses of the building, such as office or retail, in parking space requirements. If you desire to appeal the Committee's decision to the City Council, rather than completing a site plan without access to Branson Dr., you may do so. If you choose to appeal it must be filed within in the next 10 calendar days per City Code Section 18.16.040.H: H. Decisions of the Committee may be appealed to the City Council, provided the applicant has properly made a request to reconsider as set forth above. Any appeal must be filed within ten calendar (10) days of the date of the Committee's final decision. At the Council meeting to review the appeal, both the applicant and members of the Committee may provide testimony to the Council, and the Council may reverse, affirm, or modify any decision of the Committee. (Ord. 855, 2022) For your reference I have included a copy City Code sections and adopted policies pertaining to Access Management at the site.
