MINUTES
Board Members Present: Chair Jason Mendenhall, Mike Schwartz, Brady Smith, Brett Hiltbrand,
Thais Ayre, and Darell Stewart. Staff Members Present: Attorney Ryan Lewis, Planning Manager
Don Matson, Development Services Manager Sean Harris, Planning & Development Director
Devin Hillam, and City Clerk Joey Bowers.
Mendenhall called the meeting to order at 6:OOpm.
Mendenhall asked if any commissioners had a conflict of interest with the items before the
board. Smith stated that he had prior conversations with community members on public hearings
#2 and #3, but would not have an impact on his decision.
APPROVAL OF THE MINUTES: October 11, 2022.
Mendenhall entertained a motion to approve the minutes as emailed. Schwartz moved to accept
the meeting minutes of October 11, 2022 as emailed; Hiltbrand seconded. The full commission
approved.
PUBLIC HEARING
1. An application for a Conditional Use Permit for a school in a General Commercial (C-2) zone
on approximately 9.8 acres of land. Subject property is generally located at 4200
Hawthorne Rd, Chubbuck, Idaho. The Comprehensive Plan Future Land Use Map
designates this area as Commercial. The application will be reviewed against criteria in
section 18.28.020.C.5 of City Code. Type of action: Decision.
Aubrey Naasz represented Pocatello-Chubbuck School District 25. Mr. presented
an application for a Conditional Use Permit (CUP) for a school on approximately 9.8
acres of land in the General Commercial (C-2) zone.
Planning Manager Don Matson stated that this application had been reviewed by
City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and
recommended approval.
Mendenhall declared the public hearing open for public comment.
Boyd Byrd at 5036 Kevin Ave., was In Favor. Mr. Byrd was in favor of the
application but was concerned about the negative effect this application would have on
commercial property taxes in the future.
Due to no more public comment Mendenhall closed the public hearing.
Schwartz motioned to recommend approval of a Change in Land Use District on .47 Acres of
Land from Limited Residential (R-2) to Limited Commercial (C-1) located at 5122 Hawthorne
Rd. as presented to City Council. Hiltbrand seconded.
With all commission members understanding the motion they voted.
Roll Call Vote: Darell Stewart, Yes; Thais Ayre, Yes; Brett Hiltbrand, Yes; Jason Mendenhall,
Yes; Mike Schwartz, Yes; Motion carried.
2. A petition by City of Chubbuck City staff to update several sections of City Code Title 17, Land
Development, regarding public improvements and recording of plats: Chapter 17.16.070, Warrant
Against Defects, altering the length of a warranty period and establishing potential extensions of
time; Chapter 17.20.010, Recording of Plats, requiring a guarantee of various public improvements
with the approval of a final plat before recording; Create a new Chapter 17.20.015: Guarantee of
Completion Required Prior to Recording Plats; Guarantee Maintained Until Warrantee Expires for
Improvements Dedicated to Public Agency, with standards and requirements for a financial
guarantee, including a surety bond, cash deposit, accrual to the City, amount of guarantee, term
length, cost estimates, penalty of case of failure to complete construction of improvement,
release of guarantee, and potential exceptions for sidewalks; Chapter 17.20.030, Location of
Structures and Improvements, adding a reference to Chapter 17.20.010; Chapter 17.20.040,
Permits and Municipal Services, clarifying City acceptance and maintenance of public
infrastructure or provision of services. Type of action: Recommendation.
Development Services Manager Sean Harris presented updates to several sections of City
Code Title 17 which included: Land Development, regarding public improvements and recording

regarding self-service storage facilities: Title 18.08.040, Schedule of General Controls, changing
land use districts where facilities may be conditionally permitted; Title 18.08.0301, Vehicle Storage
Sites, clarifying that vehicles may be stored at self-service storage facilities and how much of the
storage area may be for vehicle storage; and Title 18.12.050 Supplemental Controls for Self -
Service Storage Facilities, establishing separation standards between facilities, and clarifying
prohibited activities at self-service storage facilities. The application will be reviewed against
criteria in section 18.28.050.6.8 of city code. Type of action: Recommendation.

Clearance", adopting a new Chapter 18.16 "Design Review Clearance" setting forth applicability
and purpose for Design Review clearances and setting for certain exemptions; setting forth actions
that may be taken if requirements are not satisfied; setting forth the Community Services Director
as the Administrator, setting forth a list of members of the Design Review Committee; setting
forth the materials necessary to make application; setting forth the criteria for approval and the
process thereof, including requiring that decisions shall be in writing, and including a process for
reconsideration of a decision and appeals to the City Council; and setting forth fees as set by
resolution of the City Council. The petition will be reviewed against criteria in section 18.28.050.8.8
of city code. Type of action: Recommendation.
