STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Ryan Lewis, Interim Public Works Director Bridger Morrison, Community Services Director Devin Hillam, Development Services Manager Sean Harris, Planning Manager Don Matson, Police Chief Bill Guiberson, Fire Chief Merlin Miller, Human Resource Director Scott Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers. APPROVAL OF MINUTES: November 2, 2022. Councilmember Evans motioned for approval of the Council Meeting minutes. Councilmember Hernandez seconded motion for approval of minutes. Roll Call: Evans -yes, Heiner -yes, Reece -yes, Hernandez -yes, motion passed. GENERAL BUSINESS: I. Approval of the 2023 Beer, Wine and Liquor Licenses. (Council will discuss if all City, State and County requirements have been completed). City Clerk Joey Bowers presented the 2023 beer, wine, and liquor licenses. Councilmember Hernandez motioned to approve the 2023 Beer, Wine, and Liquor Licenses as presented, conditional upon on all City, State, and County fees are paid in full. Councilmember Heiner seconded motion for approval. Roll Call: Heiner -yes, Reece -yes, Hernandez -yes, Evans -yes, motion passed. 2. Adoption of Ordinance 853 Public Improvements and Recording of Plats. (Council will discuss amending 17.16 and 17. 20 of city code). Development Services Manager Sean Harris presented updates to several sections of City Code Title 17 which included: Land Development, regarding public improvements and recording of plats: Chapter 17.16.070, Warrant Against Defects, altering the length of a warranty period and establishing potential extensions of time; Chapter 17.20.010, Recording of Plats, requiring a guarantee of various public improvements with the approval of a final plat before recording; Create a new Chapter 17.20.015: Guarantee of Completion Required Prior to Recording Plats; Guarantee Maintained Until Warrantee Expires for Improvements Dedicated to Public Agency, with standards and requirements for a financial guarantee, including a surety bond, cash deposit, accrual to the City, amount of guarantee, term length, cost estimates, penalty of case of failure to complete construction ofimprovement, release of guarantee, and potential exceptions for sidewalks; Chapter 17.20.030, Location of Structures and Improvements, adding a reference to Chapter 17.20.010; Chapter 17.20.040, Permits and Municipal Services, clarifying City acceptance and maintenance of public infrastructure or provision of services, and recommended approval. Councilmember Reece motioned for the waiver of three readings, including the reading of one time in full for Ordinance 853. Councilmember Hernandez seconded motion for waiver. Roll Call: Reece -yes, Hernandez -yes, Evans -yes, Heiner -yes, motion passed. Councilmember Heiner motioned for adoption of Ordinance 853. Councilmember Evans seconded motion for adoption. Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, Reece -yes, motion passed. Adoption of Ordinance 854 Storage Units and Vehicle Storage. (Council will discuss amending 18.08 and 18.12 of city code). Planning Manager Don Matson presented updates to several sections of City Code Title 18, Land Use, regarding self-service storage facilities: Title 18.08.040, Schedule of General Controls, changing land use districts where facilities may be conditionally permitted; Title 18.08.0301, Vehicle Storage Sites, clarifying that vehicles maybe stored at self-service storage facilities and how much of the storage area may be for vehicle storage; and Title 18.12.050 Supplemental Controls for Self -Service Storage Facilities, establishing separation standards between facilities, and clarifying prohibited activities at self-service storage facilities, and recommended approval. Councilmember Heiner motioned for the waiver of three readings, including the reading of one time in full for Ordinance 854. Councilmember Hernandez seconded motion for waiver. Roll Call: Heiner -yes, Evans -yes, Reece -yes, Hernandez -yes, motion passed. Councilmember Reece motioned for adoption of Ordinance 854. Councilmember Hernandez seconded motion for adoption. Roll Call: Evans -yes, Reece -yes, Hernandez -yes, Heiner -yes, motion passed. 4. Adoption of Ordinance 855 Design Review. (Council will discuss amending 18.16 of city code). Planning Manager Don Matson presented a new Chapter 18.16 "Design Review Clearance" setting forth applicability and purpose for Design Review clearances and setting for certain exemptions; setting forth actions that may be taken if requirements are not satisfied; setting forth the Community Services Director as the Administrator; setting forth a list of members of the Design Review Committee; setting forth the materials necessary to make application; setting forth the criteria for approval and the process thereof, including requiring that decisions shall be in writing, and including a process for reconsideration of a decision and appeals to the City Council, and recommended approval. Councilmember Evans motioned for the waiver of three readings, including the reading of one time in fall for Ordinance 855. Councilmember Hernandez seconded motion for waiver. Roll Call: Reece -yes, Hernandez -yes, Heiner -yes, Evans -yes, motion passed. Councilmember Reece motioned for adoption of Ordinance 855. Councilmember Heiner seconded motion for adoption. Roll Call: Hernandez -yes, Heiner -yes, Evans -yes, Reece -yes, motion passed. CLAIMS: City of Chubbuck claims for November 16, 2022 as presented to Mayor England and Council. Councilmember Heiner motioned to approve the City of Chubbuck Claims as presented. Councilmember Hernandez seconded motion for approval.
