APPLICATION FOR A CONDITIONAL USE PERMIT
FOR AN ACCESSORY DWELLING UNIT IN A LIMITED RESIDENTIAL (R-2) ZONE
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON DECEMBER 13, 2022
SUMMARY
DESCRIPTION: An application for a Conditional Use Permit for an accessory dwelling unit (ADU) in a Limited
Residential (R-2) zone on approximately 1.09 acres of land. Subject property is generally located at 343 W
Siphon Road in Chubbuck, Idaho. The application will be reviewed against criteria in section 18.28.020.C.5
of City Code. Type of Action: Decision.
STAFF FINDINGS: After reviewing the application and related materials, staff finds that it meets the
standards established by the City for a Conditional Use Permit (CUP).
• The applicant has met City Code requirements to be heard for a CUP.
• ADUs are conditionally permitted in the Limited Residential (R-2) zone.
• The proposal is to convert part of a garage, into an ADU, addressed in section 18.10.030.6 of
City Code regarding ADUs.
• Approval does not waive owner occupancy requirements per section 18.020 in the R-2 zone.
• The building fa4ade has new metal to match the rest of the building. There are no other
immediate changes planned to the site or the exterior of the building.
• The Land Use and Development Commission may approve conditions on the proposal.
• Staff recommends approval of the proposed CUP and Findings of Fact and Conclusions of Law
with no conditions.
FACTS
BACKGROUND: The property, comprising 1.09 acres, includes a duplex, an outbuilding, and a large shop
building, approximately 2,200 square feet, that formerly included Hatch's House of Dolls. In 2021 the
owner, Mr. Cervantes Campos, legally created an ADU in the basement of the home, and in September of
this year the Commission approved a CUP to redefine the home as a duplex.
The owner was granted a CUP to lease part of the shop building for a preschool in 2021. With the failure
of that venture, he now is seeking a CUP for an ADU.
TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the
evidence and by applying law to the facts; decisions shall be based on the criteria and standards for
approval per section 18.28.020.C.5 of City Code). The Commission may approve with or without
conditions, may table a decision, or may deny the application.

makes affirmative findings of fact on each of the following standards. These are addressed by the
applicant with the submittal (see attached), section E8:

1. The proposed use is conditionally permitted in the subject zoning district and complies with all
of the applicable provisions of city code unless modified through the conditional use permit
process.
2. The proposed use is generally not in conflict with the goals, objectives, and policies of the
adopted Comprehensive Plan.
3. The proposed use is compatible with other existing and permitted uses in the general vicinity.
4. The proposed use is harmonious in scale, mass, coverage, density, and intensity with all
adjacent permitted land uses.
5. The proposed use would not place an undue burden on transportation, police, fire and EMS
protection, water/sewer, schools, and other public facilities or agencies, in the vicinity.
6. The proposed use, if it complies with all conditions imposed, will not adversely affect other
properties or the environment in the vicinity to a materially greater extent than would uses
permitted outright by this Code.
18.28.020.C6. Conditions for Approval: To make affirmative findings relating to the standards
established in section 18.28.020.C.5, the Commission may condition approval of the permit on
compliance, including but not limited to, the following:
1. Conformity to approved plans and specifications.
• The Comprehensive Plan Future Land policies strongly support increasing housing and
creating a diversity of housing opportunities. Accessory dwellings are one measure that
addresses the plan policies. As with other ADUs the maintenance and other requirements are
perpetual
2. Provision of open spaces, pathways, buffer strips, walls, fences, landscaping, and lighting.
• Generally, this is not applicable since this is on existing single structure. There are fences
surrounding the property.
3. Minimizing adverse impact on other development.
• There is limited change to the existing structure. The property owner has replaced the wood
fagade with metal that is similar to the rest of the building and windows and a door are
proposed on the sides. It will use existing water and sewer service so little or no increased
demand on public infrastructure is anticipated.
4. Controlling the sequence and timing of development.
• Not necessary — there is no new development.
5. Assuring that development is maintained properly.
• Maintenance has been ongoing on site, except for construction activity for the duplex, removal
of nuisance landscaping, etc. Complaints are managed by the Police Department Code
Enforcement. As with other CUPS maintenance of the site and other requirements are
perpetual.
6. Designating the provision of on-site or off-site public facilities or services.
• There are no outstanding issues.
7. Requiring more restrictive standards than those generally required by the Code.
• There is no new construction nor significant change to the exterior of the house or the ADU,
and no increase in demand to public infrastructure. The requirements on the ADU are stated
in the Code.
8. Requiring the mitigation of effects of the proposed development upon service delivery to the
property by any political subdivision, including school districts.

• An ADU will present only minimal change to demand on public services. As of this report, no
comments have been received from any service providers.
STAFF RECOMMENDATION
Based on the Standards for Approving a CUP, and Conditions for Approval above, staff recommends
approval of the Findings of Fact and Conclusions of Law, with the proposed use, and other details of the
project as presented for the CUP.
• The applicant has met City Code requirements to be heard for a CUP.
• ADUs are conditionally permitted in the Limited Residential (R-2) zone.
• The proposal is converting part of a garage, addressed in section 18.10.030.8 of City Code
regarding ADUs.
• Approval does not waive owner occupancy requirement per section 18.020 in the R-2 zone.
• Regarding residential density, the proposal would create an ADU in addition the duplex on 1.09
acres — a density of 3 units per acre. This is a lower density than the two nearest subdivisions.
However, ADUs are not considered in density calculations.
• The building facade has new metal to match the rest of the building. There are no other
immediate changes planned to the site or the exterior of the building
• Staff has reviewed the general site requirements and other permits.
• The Land Use and Development Commission may approve conditions on the proposal.
