HomeMy WebLinkAboutItem #1 1992 Urban Renewal PlanCHUBBUCI( The urban renewal agency in the City of Chubbuck, Idaho Memo Located at Chubbuck City Hall 290 E. Linden Ave. Chubbuck, ID 83202 208-237-2400 To: Chubbuck Development Authority & City Council/Mayor; Bridger Morrison, Public Works Director From: Devin Hillam, CDA Executive Director I— Date: November 30, 2022 Re: 1992 Plan Remaining Funds With the 1992 Downtown Improvement urban renewal plan area terminating at the end of Fiscal Year'23, the CDA and the City Council met to discuss how to use remaining funds and it was determined that the bodies wanted to do a safety improvement project at the canal crossing on Hawthorne near Stuart Park and that the remaining monies would be spent to widen the railroad crossing on New Day Parkway. Until recently however, through discussions with the railroad, we were estimating that all of the noncommitted revenues of the district would need to be used to fulfil requirements of the New Day Parkway railroad crossing obligation and then recently we were told by the railroad company that we would also need to upgrade the Chubbuck Road railroad crossing. As such, very little planning and design has gone into the canal crossing safety project to date. Thankfully however, in October 2022 however, the Idaho Board of Transportation approved funding for both the New Day Parkway and Chubbuck Road railroad crossings and so significant funds have become available and now we need a plan for how to proceed through the remainder of the fiscal year. Attachment #1 contains a conservative estimated cashflow for the district developed in coordination with the Public Works Director and through inputting budgeted dollars of the Agency's specific plan budget. As estimated in the table, at the end of the District's life on 9/30/23, the fund will have a balance of $1,294,613. 1 As the two bodies look for projects, we have been counseled by TJ Budge, the CDA's counsel and Meghan Conrad, the Agency's external counsel, that district monies should be spent in a way that have an economic tie to those parcels that generate the increment. Those properties that generate increment in this distict are shown in red, yellow, or green below (please disregard the specific colors as the map layer is no longer current to reflect development opportunities): At the past joint meeting, it was decided that the Agency should try to fund a canal bridge safety improvement project on Hawthorne Road just north of Canal Street. The bridge constricts and realigns the lanes and is deteriorating and due to the smaller size, does not qualify for federal bridge repair monies. After we were informed by the railroad that we would have to fund the New Day expansion project and then the Chubbuck Road railroad crossing expansion project, all efforts on bridge repair design work ceased. As it stands, we currently only have some preliminary line work of existing conditions through field surveys and so if this is still the direction that the Council and CDA would like to pursue, City staff needs direction regarding the scope of the project. Certainly, all of the remaining monies could be used on the bridge for repairs and to add pedestrian crossing elements for the future TAP grant that the City obtained for the canal trail greenway that will run from Hawthorne Road to future Miller Park west of Philbin. There certainly are other funding needs and desires as well for consideration. • For many years, the CDA has talked about wanting to fund a skatepark as a way to help economic development for new and existing businesses and for the community that would use it- youth, adults, skateboarders, inline skaters, BMXers, etc. Without external funding partners, estimated costs for a facility that included restrooms, could be approximately $600-700k. Day-to-day maintenance costs of the facility would be minimal but the City would need to develop a capital maintenance budget for end of the life repair and replacement. • There are streets within the district which are deteriorated and need financial investment. Those include: o W Linden Ave, which is fronted directly by properties which generate increment for the district, many of which are under or undeveloped. The segment is approximately 1,275 feet long. The current road is pot holed and has collapsed in some sections. There are some needed water line upgrades under the road which could qualify for outside funding from the state if tied to economic development, with said project then helping to fund road repairs. o Afton Road extension from W Chubbuck Road to W. Linden Ave, which is fronted directly by properties which generate increment for the district, many of which are under or undeveloped. The segment is approximately 475 feet long and would require some property acquisition, either through purchase or donation. o Valenty Road is across the street from increment generating districts but does not have any generating properties on its frontage. However, for decades that CDA and City have discussed doing some improvements to the road, which is approximately 1,115 feet long. The road is deteriorated and many of its frontage properties are under or undeveloped. The Council and CDA may wish to consider 3 improvement a small section north from Chubbuck Road as a way to enhance to aesthetic of the road entrance since Chubbuck Road is a main corridor in the City, which could serve an economic development purpose. o Briscoe Road has been a topic for several years and recently was nearly funded. Although Briscoe Road is in disrepair, the fronting lots are largely zoned residential and so economic development opportunities which would benefit the revenue generating properties are likely very, very small and therefore this project would not qualify for funding under the guidance of the CDA's legal counsel. • There are numerous parks within the district which are deteriorated and need financial investment just to maintain what is currently built. The following parks include: Mary's/Heartland Park, Briarwood Park, Capell Park, Cotant Park, Stuart Park, Sample Park, Jerry Rowland Park, Dalton Park, and Bistline Park. Of these parks, the following need investment attention for repairs which would be non -qualifying for parks impact fee money use and which would likely be outside of the scope for which we could seek donors/volunteers: Mary's/Heartland Park (Washburn St, Sacaiawea Dr., Stripes Rd., Brundage St.) • Pickleball court needs resurfaced — estimated cost $15,000 • Pathway needs seal coated — estimated cost $3,000 REMAINDER OF PAGE LEFT INTENTIONALLY BLANK 4 Briarwood Park (Eagle Drive) • Pathway needs seal coated — estimated cost $5,000 • Playground needs new surface treatment- dig out hard clay and replace with soft material- $5,000 • Basketball Court needs rebuilt entirely - $15,000 REMAINDER OF PAGE LEFT INTENTIONALLY BLANK N 7 Capell Park (Park Lawn) • Path needs seal coated and replaced in spots - $10,000 • Park has major out of area visitors- entrance could be landscaped to better feature and enhance our community- $25,000+ I Cotant Park (Teton St., Victor Ave.) • Path needs seal coated and replaced in spots - $20,000 • Backstops need significant maintenance or replacement — reshaping, refencing, repainting, etc. - $60,000 - 90,000 • Repair basketball court- or replace it and the odd landscaped area next to it- $45,000+ • Consider replacing bleachers with aluminum bleachers- $7,000 / 5 row bleacher = $42,000 • Pave southern parking lot- $60,000 RI Jerry Rowland Park (Delaware St) • Pathway needs seal coated — estimated cost $3,000 • Playground needs new surface treatment- dig out hard clay and replace with soft material- $5,000 REMAINDER OF PAGE LEFT INTENTIONALLY BLANK 12 Other Park Needs for Council Consideration Outside of the District The Parks system needs significant investment in maintenance, not just in the boundaries of the district but outside of it. The remainder of these photos are from parks outside of the boundaries which the Council may wish to begin considering earmarking monies towards annually once the district closes, in additional to maintenance of parks within the boundaries. 13 Armstrong Park (Boyd St., Gloria St.) 14 15 16 5 17 Heritage Park (Liberty Ave., Pennsylvania Ave.) 18 19 vt y1.r Tree Valley (Garden Dr.) 21 Date Project Cost Balance Notes 11/16/2022 Post Nov. Linden Ave. Chubbuck, ID 83202 208-237-2400 Attached, please find a memo from the Public Works Director regarding additional project funding needs, this time however, for monies already budgeted as part of the Philbin Roundabout project. The projects that Bridger discusses as opportunities are ones that I believe meet the qualifiers for agency projects since they're located adjacent to increment generating parcels and/or would have a large impact on traffic and mobility to and from said parcels. Therefore, I am supportive of the Street Department's request to use the monies which would have been spent at the roundabout on other needed projects as identified. 1 /6470-t-\ CHUBBUCK 1 0 0 H 0 Memo Public Works Department 290 E. Linden, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 www.CityofChubbuck.us To: Devin Hillam - Chubbuck Development Authority Executive Director From: Bridger Morrison, Public Works Director Date: November 30, 2022 Re: Potential Funding Opportunity for Philbin/Chubbuck Roundabout Project Devin, On the Philbin/Chubbuck Road Roundabout Project, the concrete that was placed for the sidewalks and truck apron, which is at the interior of the roundabout, failed to meet the project specifications. After additional testing, it was confirmed that the concrete did not meet the strength requirements called for the in the construction documents. Therefore, we have two options to address the deficient concrete: 1) Require the concrete to be removed and replaced, or 2) Leave the concrete in place but not pay the contractor for those items. If Option 2 were selected, there would be a savings to the project of $145,370.00. 1 have reviewed these options with the Street Department and we believe that Option 2 is worth considering. However, if Option 2 were selected, there will likely be additional future maintenance costs that the Street Department will be responsible for related to the concrete. Therefore, the City would like the CDA to consider if that funding could be applied to projects the Street Department needs to complete in the near future. If that is possible, the funding provided by the CDA would be recognized as offsetting future maintenance costs that the Street Department will be responsible for at the roundabout. The Street Department has identified some project needs that could be considered such as significant storm drain improvements on Eagle Drive near Briarwood Park, storm drain improvements on Hawthorne Road between Knudsen and Chubbuck Road, and sidewalk ADA improvements at various locations. If possible, I would like to discuss this further with the CDA at the joint meeting on December 7, 2022. STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Ryan Lewis, Interim. Public Works Director Bridger Morrison, Planning & Development Director Devin Hillam, Police Chief Bill Guiberson, Fire Chief Merlin Miller, City Treasurer Rich Morgan, and City Clerk Joey Bowers. GENERAL BUSINESS: 1. A Joint Meeting with the City Council and the Chubbuck Development Authority Board. (CDA) to Discuss Project Priorities and the Remainder of the 1992 Urban Renewal Plan. The City Council and CDA Board Members discussed the current projects associated with the 1992 Urban Renewal Plan which included expanding New Day Parkway, and the Chubbuck/Philbin Intersection. The City Council and CDA Board Members also discussed priorities for future projects. The main project that both boards wanted to see finished with the 1992 Urban Renewal Plan before it closes out in 2023 was the Hawthorne Irrigation Bridge Project. The City Council and CDA Board Members recommended moving any projects that address safety improvements/concerns throughout the community to the top of the priority list. City Staff committed to look for available grants and other funding opportunities to help fund the recommended priority projects. City Staff is still working with the Union Pacific on a schedule and costs associated with expanding the rail road crossing along New Day Parkway. ADJOURN: Mayor Kevin England adjourned at 5:45. J *0s-05ty Clerk _A Kevin England- r December 5t", 2022 Honorable Mayor, City Council and CDA Board Members via email distribution by City and CDA Clerk RE: Use of excess URA funds Dear Mayor, Council and Board Members, Please accept and consider this information as part of the decision process to determine the appropriate use of excess URA funds. The information contained in this correspondence is intended to add clarity to the decision process and provide supplemental information that is not contained in the staff report. The topics are as follows: 1) History of 1992 URA plan and creation of Revenue Allocation Areas (RAA) 2) Historical use of 1992 URA funds 3) Consideration during your decision process History of 1992 URA Plan and creation of RAA Since the creation of the 1992 URA Plan, the parcel that generate revenue do NOT match the geographic locations of the RAA (were the money can be spent). This was by design and the plan has functioned for 30 years under this knowledge. I have attached the current RAA approved in 2016 that defines the limits where URA funds can be spent (see attachment #1). It is true that newly created URA Plans should spend the URA funds on the parcels that created the revenue (in fact the creation of new plans requires this). However, the application of 2022 URA regulations to the 1992 plan is unwarranted and violates the intent of the 1992 plan objectives. Please consider adhering to the original intent of the 1992 plan during your decision process. Historical use of 1992 URA funds During the 30 years of existence, the 1992 URA plan has provided more than $42 million in funding for projects located inside the URA. I have attached a project spending history for your review (see attachment 2a and 2b). This information represents that 68.1% of the funds have been spent on transportation. This aligns with the original intent of the 1992 URA Plan. These projects include significant rehabilitation of street networks in previously developed areas of the City. Most recently, this list includes Whitaker Road, Stuart Additions, Country Acres, New Day Parkway, Philbin / Chubbuck Intersection. All these projects occurred within the 2016 RAA boundary. The direct economic benefit of these project is evident by the increased valuation of these neighborhoods, the renewed pride of residents and the increased care of private property with reduces blight (a main goal of the 1992 URA). The other, not so obvious economic benefit is a reduction in property tax needed to fund transportation improvements. Without the use of URA funds, these projects would have only been accomplished by increased tax burden to our residents. The City has financial tools in place water, sewer, parks improvements but there is no other mechanism than increased taxes for local street improvement funding. Considerations during your decision process During your decision process related to allocating the $1.2 million funds, please consider these factors: The 2016 RAA boundary, established by resolution, allows funds to be spent outside the property that generates the revenue, but must be withing the 2016 RAA boundary The original intent and the historical use of funds is largely focused on transportation infrastructure. As discussed above, transportation infrastructure does not have any other funding mechanism. The change in funding that has generated the $1.2 million in excess funds came from a transportation project. Please consider allocating those funds back to transportation needs. If the $1.2 million needs to be spent by September 30, 2023, the Hawthorne Bridge project would not be eligible. (construction wouldn't occur until winter of 23-24). For the remaining transportation project listed by staff (including Briscoe Road), please consider applying a scoring system that could include the following: - Cost -Benefit analysis - Compliance with City Comprehensive plan Chapter 5 goals and the functional road map - Compliance with Bannock Transportation Planning goals - Compliance with City Strategic Plan goals - Ability to design and construct by September 30, 2023 - Safety of pedestrians and cyclist - Transportation connectivity - Will corridor be improved by development in the future Applying these criteria likely narrows the project list to only a few options. Use of URA funds for parks maintenance appears to be using URA monies for purposes that should be fulfilled by City budget process. (I believe the 5 year capital budget for parks includes increase maintenance funding) Finally, I would openly advocate for the reconstruction of Briscoe Road. This project is shovel ready, would meet the goals of Comp Plan, Strategic Plan and BTP® Plans. It mirrors the investment that CDA has made in other residential areas to improve the area and remove blight. It provides connectivity that increase pedestrian access to parks, schools and churches while also reducing traffic congestion on Yellowstone Ave. Previously this project was designed and bid but ultimately was de -funded because of my (at the time CDA director and City employee) ownership of property at the west end of the project. At this point, I no longer own the property in question and am no longer a City / CDA employee. Ultimately, if Briscoe Road is not the top priority, I would still implore you to use a decision process that identifies the top priority based on criteria that best benefit our community.
