ORDINANCE NO. &S -Z
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO PROVIDING FOR
CHANGE OF LAND USE DISTRICT WITH RESPECT TO CERTAIN LANDS
WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK; FROM LIMITED
COMMERCIAL (C-1) TO LIMITED RESIDENTIAL (R-2); DECLARING THAT
THE CITY COUNCIL FINDS THAT SUCH CHANGE IN LAND USE PATTERN
1S CONSISTENT WITH THOSE PRESCRIBED BY THE CITY'S
COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE
SHALL BE EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK,
IDAHO:
Section 1. Change of Land Use District. The land use district established by the Chubbuck
Land Use Ordinance, with respect to the lands described below, located within the boundaries of
the City of Chubbuck, Idaho is hereby changed from Limited Commercial (C-1) to Limited
Residential (R-2):
A Tract of land in Lot 4, Section 3, Township 6 South, Range 34 E.B.M., Bannock
County, Idaho, more particularly described as follows:
Beginning at the Northwest corner of said Section 3;
Thence along the North line of said Section 3, South 89°24' East 990.0 feet to the TRUE
POINT OF BEGINNING;
Thence South 198.0 feet;
Thence North 89°24' West 220.0 feet;
Thence North 198.0 feet more or less, to the North line of said Section 3;
Thence South 89°24' East 220.0 feet, more or less to the TRUE POINT OF BEGINNING.
Also, A strip of land in Government Lot 4, Section 3, township 6 South, Range 34, Boise
Meridian, Bannock County, Idaho, being a portion of the land described in Instrument No.
21517841, records Bannock County, Idaho, more particularly described as follows:
COMMENCING at the Northwest corner of Section 3, Township 6 South, Range 34 East,
Boise Meridian, said point being marked with 2 aluminum cap monument and described in
corner perpetuation filing record, recorded in the records of Bannock County as Instrument
No.'s 628844 and 20520353;
Thence South 89°24'00" East along the North line of Section 3, a distance of 991.25 feet
(recorded as 990.0 feet) to the Northeast corner of the land described in Deed Instrument
No. 95013484, the True Point of Beginning;
Thence South 00°41'00" West along the East line of the land described in said Deed
Instrument No. 95013484, a distance of 198.00 feet to the Northeast corner of Parcel 2,
described in Deed Instrument No. 95013484 of the records of Bannock County, Idaho.
Thence South 89°24'00" East, a distance of 16.15 feet to a point on an exitsing fence line,
the same being a point on the West boundary line of the land described in deed Instrument

Thence North 00°01'46" West, adjacent to an existing fence line and along the West
boundary line of the land described in said Deed Instrument No. 21104804 (recorded as
South 00°37' East), a distance of 198.01 feet; more or less to a point on the North line of
Section;
Thence North 89°24'00" West, along said North line of Section 3, a distance of 13.69 feet,
to the TRUE POINT OF BEGINNING.
Section 2. Comprehensive Plan. The Mayor and the City Council find, and therefore
declare, that the foregoing changes in the Land Use Districts established in Title 18, Chubbuck City
Code are consistent with the land use pattern prescribed by the City's Comprehensive Plan for the
above-described property.
Section 3. Effective Date. Full public hearings having been conducted in this matter, and
the rule requiring an ordinance to be read on three separate days, one of which shall be a reading
in full, is hereby dispensed with, and this Ordinance shall become effect upon its passage,
approval and publication as provided by law
