Linden Avenue, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 www.CityofChubbuck.us LEGACY PARK DIVISION 2 PRELIMINARY PLAT REQUEST - STAFF REPORT CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION REGULAR MEETING ON SEPTEMBER 13, 2022 STAFF FINDINGS SUMMARIZED After reviewing the proposed Legacy Park Division 2 preliminary plat, Staff finds that it appears to meet the code requirements with the following comments: • Chubbuck Municipal Code section 16.12.030.G does not allow for a lot to split land use zones. Lots 13, 15, and 16, block 3 are within both General Commercial (C-2) and Dense Residential (R-4). Secondary irrigation facilities will be required to be designed and constructed in accordance with section 16.12.230 of city code, which will require a pump station. The applicant proposed to construct dry pressure irrigation lines within the development and would like to postpone the pump station to a future phase Lots 16 — 19 do not meet the Lot Depth To Width Ratio as described in Title 18.08.044. STAFF RECOMMENDATION: Staff recommends approval of the preliminary plat with the following conditions and deviations: A Change of Land Use application be approved for the portions of lots 13, 15, and 16, block 3 that fall within the Dense Residential (R-4) zone prior to submittal of final plat. Provide a complete final design of the secondary pressurized irrigation pump station to be submitted with the final plat and construction drawings and provide financial guarantee for the preliminary plat's portion of the pressure irrigation system improvements. Staff is supportive of the lot depth to width ratio deviation as Lot 16 is earmarked for commercial/industrial use and Lots 17 — 19 are earmarked for further multi -family residential subdivision. FACTS REQUEST: The applicant proposes a 32 lot Preliminary Plat for 24 multi -family residential building lots, 6 commercial building lots, and 2 open space lots in the Legacy Park subdivision, Division 2. It includes extending Park Lawn Drive to the north for access and extending potable water, sanitary sewer, and pressurized irrigation mains with services through the development. BACKGROUND: This is the 2nd division of the Legacy Park subdivision. TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the evidence and by applying law to the facts; decisions shall be based on the standards for approval). Recommendation/approval of this preliminary plat shall be whether it meets the requirements of the City of Chubbuck ordinance and State of Idaho statutes. The Commission may recommend approval with or without conditions, may table a decision, or may recommend denial of the application. OWNER: G. DWG CONCEPT MASTERPLAN AUGUST 2022 FIGURE NO. F-1 DATE AUGUST -2022 LEGACY PARK LANDQUEST DEVELOPMENT, LLC CHUBBUCK, IDAHO ,,.KNUDSEN ENGINEERING (r, KNUDSEN August 9, 2022 City of Chubbuck — Development Services Division 290 East Linden Avenue Chubbuck, Idaho 83202 SUBJECT: Legacy Park (Division 2) - Preliminary Plat Narrative 131 R 17.E 609 West Maple Street Pocatello, Idaho 83201 knudsen-eng.com The intent of this narrative is to provide a description of the Legacy Park development and to facilitate its approval. The preliminary plat was designed to meet all the applicable City of Chubbuck standards and requirements. PROPERTY BACKGROUND The subject property is a 28.50 -acre parcel of undeveloped land located south of New Day Parkway and east of Yellowstone Avenue. The subject property has been recently annexed into the City of Chubbuck and is zoned Commercial General (C-2) and High Density Residential (R-4). The ground surface is relatively flat, sloping east to west and falls approximately 7 feet across the property. Culinary water will be provided by the City of Chubbuck, and our proposal shows that we are tying into the existing water mains at the intersection of Yellowstone Avenue & Briscoe Road. Sanitary sewer will also be provided by the City of Chubbuck with our mainline connection at the existing manhole east of the Yellowstone/Briscoe intersection and the waste canal. Irrigation water is available through Fort Hall Irrigation with the point of service located further to the northeast. Main lines and services will be installed dry and become active in a future phase when the pump station is constructed further towards the northeast. Joint trench utilities (power, gas, fiber, ect.) are available both above and below ground along Yellowstone Avenue. PROPOSAL INFORMATION Our proposal is to develop a 28.50 -acre parcel of land into 6 commercial, 24 residential, and 2 open space lots to help meet the current market demand. This project would transition the existing dense residential uses south of the development with the more industrial uses to the north of New Day Parkway, while still being in line with the Yellowstone Commercial Corridor detailed in the Comprehensive Plan for the City of Chubbuck. The envisioned uses of the commercial area could be a mix of storefronts, convenience stores, offices, storage, and yard repair facilities. These areas are configured in a way that we can easily adjust the layout or further subdivide the current configuration without having to demolish the infrastructure built in this proposal. However, any further subdivision would still need to be done according to city procedures. The individual commercial lots will be responsible for handling their own storm water runoff, which will be considered during the building permit process. City of Chubbuck — Development Services Division Legacy Park - Preliminary Plat Narrative August 9, 2022 Page 2 The residential lots will be used for 4-plex structures. These lots will have a shared parking lot and stormwater will be directed to the open space lots for retaining. ROADWAYS SECTIONS Our proposal consists of two street sections, the 66' R -O -W public collector section and the 24' wide shared access road section. Each section is depicted graphically on the preliminary plat and further detailed below: 66' R -O -W Public Collector: Consists of a 48' wide asphalt and ribbon curb road (measured between opposing back of curbs) with a 9' wide drainage Swale on each side. A 5' sidewalk will be constructed just outside the R -O -W line at the time of each individual lot construction. A 15' public utility & access easement will be placed outside of the R -O -W. 55' R -O -W Public Local Road: Consists of a 35' wide asphalt and ribbon curb road (measured between opposing back of curbs) with a 9' wide drainage Swale on each side. A 5' sidewalk will be constructed just outside the R -O -W line at the time of each individual lot construction. A 15' public utility & access easement will be placed outside of the R -O -W. 24' Private Shared Access: Consists of a 24' wide asphalt road. This access will be covered by a 47' public utility & access easement. UTILITIES As part of our proposal all commercial lots will receive culinary water, sanitary sewer, and pressurized irrigation services. The Sanitary Sewer will ultimately drain to the existing sewer line within New Day Parkway. Stormwater runoff for public roadways will be held in roadside swales. All commercial areas will be responsible for retaining their own stormwater runoff. All residential areas will be directed to the storm areas surrounding the roundabout. Pressurized Irrigation main lines and service points will be installed dry within the development. A pumping and delivery system will be designed in a future phase and placed within lot 16, block 3. Once this system is implemented all lots will be required to connect into it for landscaping irrigation. If you have any questions regarding this request, please give me a call at (208) 417-0522.
