Dixon F=ee: $0 00 Deputy: imcdonald CITY OF CHUBBUCK, IDAHO ORDINANCE NO. a yg AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO PROVIDING FOR CHANGE OF LAND USE DISTRICT WITH RESPECT TO CERTAIN LANDS LOCATED AT 1295 ALPINE AVENUE AND WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK FROM AGRICULTURAL (A) AND LIMITED RESIDENTIAL (R-2) TO LIMITED RESIDENTIAL (R-2); DECLARING THAT THE CITY COUNCIL FINDS THAT SUCH CHANGE IN LAND USE PATTERN IS CONSISTENT WITH THOSE PRESCRIBED BY THE CITY'S COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE SHALL BE EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Change of Land Use District. The land use district established by the Chubbuck Land Use Ordinance, with respect to the lands described below, located within the boundaries of the City of Chubbuck, Idaho is hereby changed from Agricultural (A) and Limited Residential (R-2) to Limited Residential (R-2): Part of Sections 8 and 9, Township 6 South, Range 34 East Boise Meridian, Bannock County, Idaho, more particularly described as, Beginning at the West Quarter comer of Section 9, Township 6 South, Range 34 East and running thence S 89°44'22" E 60.00 feet along the latitudinal centerline of said Section 9 to the west right-of-way line of Philbin Road, Thence continuing S 89°4422" E 1258.41 feet along said latitudinal centerline to the west sixteenth comer of said Section 9, Thence N 00°33'30" W 470.94 feet along the west sixteenth line to the centerline of Redman Canal, Thence along said centerline the following three (3) courses: 1) Thence N 61°35'34" W 128.99 feet to a curve to the left, 2) Thence along said curve to the left 282.40 feet (Curve Data: Radius = 1540.00', Delta= 10°30'24", Chord= N 66°50'37" W 282.00'), 3) Thence N 72005'49" W 947.64 feet to the easterly line of a parcel as described in Deed Instr. #20724483, Thence S 00°39'36" E 418.78 feet along said parcel to the south line of Alpine Ave., also being the north line of Lot 2, Block 1 of The Academy Subdivision Instr #21500997, Thence N 89°44'22" W 7.05 feet along said north line to the east right-of-way line of Philbin Rd as described in Deed Instr. #417798, ORDINANCE - Page 1 Chubbuck 070621 - Ch Land Use Dist 22.92 acr Thence N 02°34'21" W 341.61 feet along said right-of-way line, Thence N 08°13'00" W 49.83 feet along said right-of-way line, Thence S 89°20'24" W 50.00 feet to the west right-of-way line as described in Deed Instr. #418156, Thence S 06°52'35" W 51.20 feet along said right-of-way line, Thence S 01'15'01" W 848.87 feet along said right-of-way line to the latitudinal centerline of Section 8, Township 6 South, Range 34 East, Thence S 89°44'22" E 60.02 feet along said latitudinal centerline to the Point of Beginning. Parcel contains 122.82 acres Section 2. Comprehensive Plan. The Mayor and the City Council find, and therefore declare, that the foregoing changes in the Land Use Districts established in Title 18, Chubbuck City Code are consistent with the land use pattern prescribed by the City's Comprehensive Plan for the above-described property. Section 3. Effective Date. Full public hearings having been conducted in this matter, and the rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effect upon its passage, approval and publication as provided by law PASSED BY THE COUNCIL AND APPROVED BY THE MAYOR OF THE CITY OF CHUBBUCK, IDAHO, this 6 f."day of .Svc , 2022.
