prior to the public hearing and which contained the appropriate documents.

June 14, 2022 Regular Meeting of the Land Use and Development Commission at a
public hearing.
3. Copies of notices are on file with City staff. In accordance with City Code 18.28.010,
notice of the public hearing was provided at least 15 days prior to the hearing as
follows:
a. Notice posted on the premises;
b. Mailing to owners of property within a 300 ft. radius of the site;
c. Notice sent to utilities and political subdivisions providing services within the
City;
d. Publication in the Idaho State Journal at least 15 days prior to the hearing;
e. Notices posted prominently at the City office and on webpage; and
4. Hearing will be conducted in accordance with procedures established by City Resolution
2021-06.
COMMENTS RECEIVED: No written comments were received from the general public as of
this report, nor from any political subdivisions providing services within the city (see
Exhibit 2b).
ANALYSIS AND RECOMMENDATIONS
This is a quasi-judicial decision. A change in zoning and a new plat are required for development to
continue for both applicants. City staff finds that the application satisfied the criteria for the
requested zoning designation. The Commission must determine if it is in the best interest of the
City of Chubbuck and adjacent landowners to recommend a Title Change to the Land Use (zoning)
Map.
The criteria in City Code Title 18.28.050 for approval can be found in the table City Code Title 78.28.-
Land
8.28:Land Use Administration below. See the standards in Idaho Statutes for reviewing changes in Exhibit
2b. Information on how the proposal relates to the Comprehensive Plan can be found in Exhibit 3b.

CITY CODE TITLE 18.28: LAND USE ADMINISTRATION
SECTION 18.28.050.8k TITLE MAP AMENDMENTS STANDARDS
POLICY
1. The proposed map amendment would be in the community's best interest.
COMMENT
The Agriculture zone is intended for activities that consume several acres. As the city
grows the zoning needs to be changed for more efficient development to occur.
POLICY
2. The list of uses permitted by the land use ordinance would blend with surrounding
land uses and the uses permitted in the proposed zoning district would be harmonious
in terms of their scale, mass, coverage, density, and intensity with adjacent land uses.
COMMENT
Neighboring parcels within the City are in the R-2 zone and the eastern part is
developing in single family homes.
POLICY
3. The subject site is suitable for the type and intensity of land uses permitted under
the proposed zoning district.
COMMENT
The Group 5 property, Academy Acres Subdivision, will develop as single family
residential, which is also planned for the property to the north. The school expansion
provides a good separation and buffer between the residential areas and the large gravel
pit west of Chubbuck Rd.
POLICY
4. The subject site would be adequately served by transportation routes, police, fire
and EMS protection, water/sewer, schools, and other public facilities and services, or
agencies, to serve the public health, safety, and general welfare under the proposed
zoning district.
COMMENT
The site has ready access to public services and utilities, as well as irrigation water. Alpine
Ave is currently the only access to the school site, and it can adversely affect traffic on
Philbin Rd. The projects extend further on Alpine Ave to the east to provide pedestrian
and street connections.
POLICY
5. The proposed map amendment is generally not in conflict with the goals, objectives,
and policies of the adopted Comprehensive Plan. LUDC and Council shall have
discretion in interpreting exact boundary locations of the future land use map
designations when considering map amendment request.
COMMENT
The project complies with the plan. See attachment 3b for an analysis concerning the
proposal in relation to the Comprehensive Plan.
Staff recommends approval of the request. It complies with the comprehensive plan and meets the
standards for reviewing a title map amendment. Properties to the north and east are in the same
land use district, Limited Residential (R-2). The school site also buffers the planned housing area
from the non-residential properties across Philbin Road and outside the city limits.
