Proposed Title 18.19: Chubbuck Village Criteria
Proposed Village
District (V Zone)
Proposed
Highway
Corridor
District (HC
Zone)
Proposed Title 18.19: Chubbuck Village Criteria
•Traditional Zoning
•Enforces separation and isolation of land uses, and of people
•Lack of design standards discourages creativity
•No incentive for pedestrian or bicycle “active” transportation
•Neglects pedestrian environment
•Buildings away from sidewalk
•Parking between sidewalk and businesses
•Form-Based Code
•Encourages mixture of uses, such as residential, commercial and civic
•Design standards, simple or complex, used to create a desired environment
•May include street standards for wider, shaded sidewalks, and bike lanes, racks
•Protects pedestrian environment
•Buildings at or close to sidewalk
•No parking between sidewalk and business
Proposed Title 18.19: Chubbuck Village Criteria
Traditional Zoning Setback Form-based Code Build-to Line
Proposed Title 18.19: Chubbuck Village Criteria
Proposed Title 18.19: Chubbuck Village Criteria
Recommended Updates to Draft Code:
Delete several requirements from the draft code regarding:
a.Maximum lot width.
b.Window configurations/shapes on upper floors.
c.Door/entry spacing.
d.Vacant lot screening (language in several sections).
e.Living vs non-living materials in planting beds.
Proposed Title 18.19: Chubbuck Village Criteria
•Streets and Rights-of -Way, modify pedestrian corridor
requirements, page 4.
•Design and Frontage
•Modifying front setback/Build-to Lines in the Village zone
and including courtyards, page 5.
•Reduce minimum building height in the Village zone from
2-stories to 20’, page 5.
•This better reflects the intent of the form-based code to define the
street for the pedestrian, with a minimum building height ratio
based on the right-of -way width.
•For wider streets in the Village zone with angled parking, as well as
Yellowstone Ave, setting the minimum height to 25’ with a ratio also
based on width.
Proposed Title 18.19: Chubbuck Village Criteria
•Design and Frontage
•Reduce allowed encroachment of awning, canopies, etc.
into right-of -way, page 6.
•Add sections to resolve issues within the chapter, page 7.
•Courtyards and patios, to maintain the BTL, maintain access points
to building interior, and include some pervious surface. Deleted
complex language about landscaping with courtyards and patios in
Chapter 18.19.080 Landscaping Standards on page 13.
•Modify requirements along a pedestrian corridor.
•Clarification on horizontal
expression lines.
Proposed Title 18.19: Chubbuck Village Criteria
•Design and Frontage
•Relocating standards regarding existing buildings to
Section E, pages 7-8 (from 18.19.070 Land and Building
Uses Section B. Nonconforming Uses). These issues were
identified by the LUDC as specific changes for staff.

•Clarifying that new automobile, RV, and other vehicle
service businesses are not allowed in the Village zone.
•Eliminating size restrictions on apartments.
•Deleting minimum size standard for townhouses and
added façade differentiation requirement.
Proposed Title 18.19: Chubbuck Village Criteria
•Landscaping Standards
•Clarifying what improvements in parking areas trigger

•Relaxing and eliminating some standards regarding tree
placement, page 13.
Proposed Title 18.19: Chubbuck Village Criteria
•Parking Standards
•Including language to address on-street parking as part of
total requirements, page 16.
•Clarifying that the City Council may consider deviations in
parking requirements, page 16.
•Relaxing requirement for bicycle parking for residential
uses, page 16.
•Clarifying parking standards for fixed vs. non-fixed seating
in assembly land uses, page 17
•Signage Standards
•Reducing allowed extensions into ROW for signs, page 19.
•Removing low height limit for building-mounted signs in
the Village zone, page 19.
•Adding illustrations of sign types, page 21.

STANDARDS FOR APPROVING A CONDITIONAL USE PERMIT
CHUBBUCK MUNICIPAL CODE SECTION 18.28.020.C.5
POLICY A The proposed use is conditionally permitted in the subject zoning district and
complies with all of the applicable provisions of city code unless modified
through the conditional use permit process.
POLICY B The proposed use is generally not in conflict with the goals, objectives, and
policies of the adopted Comprehensive PIan.
POLICY C The proposed use is compatible with other existing and permitted uses in the
general vicinity.
POLICY D The proposed use is harmonious in scale, mass, coverage, density, and intensity
with all adjacent permitted land uses.
POLICY E The proposed use would not place an undue burden on transportation, police,
fire and EMS protection, water/sewer, schools, and other public facilities or
agencies, in the vicinity.
POLICY F The proposed use, if it complies with all conditions imposed, will not adversely
affect other properties or the environment in the vicinity to a materially greater
extent than would uses permitted outright by this Code.
STANDARDS FOR APPROVING A ZONING TITLE TEXT AMENDMENT
CHUBBUCK MUNICIPAL CODE SECTION 18.28.050.8B
POLICY 1 The proposed text amendment would be in the community's best interest.
POLICY 2 The list of uses permitted by the land use ordinance would blend with
surrounding land uses and the uses permitted in the proposed zoning district
would be harmonious in terms of their scale, mass, coverage, density, and
intensity with adjacent land uses.
POLICY 3 The proposed text amendment is generally not in conflict with the goals,
objectives, and policies of the adopted Plan and furthers them more than the
adopted zoning text.
