Council Meeting Minutes

CALL TO ORDER: Mayor England.
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Heiner
COUNCIL. PRESENT: Roger Hernandez, Melanie Evans, and Dan Heiner.
STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Tom Holmes, Public Works
Director Rodney Burch, Planning & City Development Director Devin Hillam, Development
Services Manager Sean Harris, Municipal Services Program Administrator Kami. Morrison,
Police Chief Bill Guiberson, Fire Chief Merlin Miller, Human Resource Director Scott
Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers.
Mayor England informed the Council that Councilmember Ryan S. Lewis had resigned from
his Council Seat #4 effective February 15, 2022, and that City Attorney Tom Holmes had turned
in a notice of retirement effective as of February 16, 2022.
APPROVAL of MINUTES: February 2, 2022.
Councilmember Heiner motioned for approval of the Council Meeting minutes.
Councilmember Hernandez seconded motion for approval of minutes.
Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, motion passed.
GENERAL BUSINESS:
1. Approval of the Public Works Confined Space Policy.
(Council will discuss the adoption of the public works confined space policy).
Municipal Services Program Administrator Kami Morrison presented a Public Works
confined space policy. Human Resource Director Scott Gummersall stated that the
Association of Idaho Cities (AIC) recommended that all internal policies should be
placed before the Council for approval.
Councilmember Hernandez motioned for approval of the public works confined space policy.
Councilmember Heiner seconded motion for approval.
Roll Call: Evans -yes, Heiner -yes, Hernandez -yes, motion passed.
2. Acceptance of Offer of Dedication for Westfield Estates Div. 3.
(Council will discuss if all city requirements have been inspected and completed).
Development Services Manager Sean Harris stated that all city requirements had been
inspected and completed and recommend approval.
Councilmember Hernandez motioned for acceptance of offer of dedication for Westfield Estates
Div. 3. Councilmember Heiner seconded motion for acceptance.
Roll Call: Heiner -yes, Hernandez -yes, Evans -yes, motion passed.
3. Acceptance of Offer of Dedication for Bilyeu Estates Div. 7A.
(Council will discuss if all city requirements have been inspected and completed).
Development Services Manager Sean Harris stated that all city requirements had been
inspected and completed and recommend approval.
Councilmember Heiner motioned for acceptance of offer of dedication for Bilyeu Estates Div.
7A. Councilmember Hernandez seconded motion for acceptance.
Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, motion passed.
4. Acceptance of Offer of Dedication for Bilyeu Estates Div. 7B.
(Council will discuss if all city requirements have been inspected and completed).
Development Services Manager Sean Harris stated that all city requirements had been
inspected and completed and recommend approval.
Councilmember Heiner motioned for acceptance of offer of dedication for Bilyeu Estates Div.
7B. Councilmember Hernandez seconded motion for acceptance.
Roll Call: Evans -yes, Heiner -yes, Hernandez -yes, motion passed.
5. Acceptance of Offer of Dedication for Elliott Estates.
(Council will discuss if all city requirements have been inspected and completed).
Development Services Manager Sean Harris stated that all city requirements had been
inspected and completed and recommend approval.
Councilmember Hernandez motioned for acceptance of offer of dedication for Elliott Estates.
Councilmember Heiner seconded motion for acceptance.
Roll Call: Heiner -yes, Hernandez -yes, Evans -yes, motion passed.
6. Approval to Appoint Darell Stewart to the Land Use and Development Commission.
(The Council will discuss an appointment to the Land Use and Development Commission).
Mayor England presented Darell Stewart to replace TJ Budge on the Land Use and
Development Commission.
Councilmember Hernandez motioned to approve the appointment of Darell Stewart to the Land
Use and Development Board. Councilmember Heiner seconded motion for approval.
Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, motion passed
7. Approval to Confirm Mayor's Appoint of Ryan S. Lewis to City Attorney.
(The Council will discuss an appointment to the position of City Attorney).
Mayor England presented Ryan S. Lewis to replace Tom Holmes as the City Attorney.
Councilmember Heiner motioned to approve the appointment of Ryan S. Lewis to the positon of
City Attorney. Councilmember Hernandez seconded motion for approval.
Roll Call: Evans -yes, Heiner -yes, Hernandez -yes, motion passed.
CLAIMS:
City of Chubbuck claims for February 16, 2022 as presented to Mayor England and
Council. (Action Item).
Councilmember Hernandez motioned to approve the City of Chubbuck Claims as presented.
Councilmember Heiner seconded motion for approval.
Roll Call: Heiner -yes, Hernandez -yes, Evans -yes, motion passed.
