Linden Avenue, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 www.CityofChubbuck.us LEGACY PARK PRELIMINARY PLAT REQUEST - STAFF REPORT CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION REGULAR MEETING ON FEBRUARY 8, 2022 STAFF FINDINGS SUMMARIZED After reviewing the proposed Legacy Park preliminary plat, Staff finds that it appears to not meet the code requirements with the following comments: • The masterplan provided shows 348 residential units which will generate considerably more peak hour trips than the threshhold of 100 trips peak hour trips. Per City code section 17.12.100.13.5 a traffic impact analysis is required. • Revise the street name from Park Lawn Avenue to Park Lawn Drive. Provide the following notes: o "Fort Hall Irrigation Project has a 40 foot wide right of way for the Tyhee Wasteway Canal. No modifications or encroachment within the limits of the United States Right of Way for Tyhee Wasteway Canal will be allowed without prior written approval by the Bureau of Indian Affairs." o "The 40 foot right of way will also serve as a dedicated easement to the City of Chubbuck for access and recreation conditional upon written approval from the Bureau of Indian Affa i rs." • For the 15 foot utility easement along the street frontages, revise note to read "Public Utility and Access Easement". • Chubbuck Municipal Code 16.12.230 requires a secondary pressure irrigation system. Provide pump station location and provide piping from pump station to the shown improvements. • Show existing zoning on plat or submit a deviation request. • Revise the street right of way widths for Briscoe Road and Park Lawn Drive to 66' as Park Lawn Drive is a designated collector and Briscoe Road will function as a collector. Moreover, because Briscoe Road will allow traffic to flow from local streets/areas shown on the master plan to arterials, and will have commercial uses, it is a functionally classified collector requiring 66' right-of-way. Staff does not support the deviation request. • Provide instrument numbers for Diamond Court and Capell Park per Chubbuck Municipal Code 17.12.170.D. • Show the existing sewer easement on the plat. • Provide all curve data. • The Basis of Bearing shall be based on the City of Chubbuck grid coordinate system. • Connect the water mainline in Briscoe Road to the Yellowstone Ave. water mainline. • The master plan shows an additional lot located in the southwest corner of lot 1, block 4. It should be shown on the preliminary plat. • Intersection and access curb radius requirements are 30' radius not 20' per BTPO's Access Management Guidelines as adopted by the City. • Show the easement on the west side of the shared access south of Briscoe Road. • Provide a fire turnaround at the north end of the shared access north of Briscoe Road. • The domestic waterline between Lots 2 and 5, Block 2 shall continue north to the subdivision boundary line. When the parcel to the north develops, this will provide looping of the dead-end water line. • Provide a note restricting access to Briscoe Road for lots 1 and 6 of block 2, and lots 3 and 5 of block 1. • Provide a note restricting access to Yellowstone Avenue for Lots 1 thru 3, Block 1, and Lots 1 thru 3, Block 2. • Consider relocating the fire turn to the south end of the shared access south of Briscoe road. • With Park Lawn drive classified as a collector, lots 7 and 8 of block 2 will be required to share an access. • Provide 10' paved multi -use path separated from the street along Yellowstone Ave. frontage. • Revise master plan to show New Day Parkway and the connection to Industry Way. • If the sanitary sewer and domestic water is to be owned and maintained by the city, provide a temporary utility easement for the utilities outside the subdivision (east of Lots 10 and 11, Block 3). Said easement will be relinquished when development occurs. • The typical section for the 66' ROW Street Section doesn't meet the requirements. For 48' back- to-back section, the sidewalks are required to placed outside of the ROW and swales provided (The City would accept 56' back-to-back using standard 6" curb & gutter with sidewalk adjacent the curb). Provide 15' utility easements instead of 10'. FACTS REQUEST: The applicant proposes a 35 lot Preliminary Plat for 19 multi -family residential building lots, 14 commercial building lots, and 2 open space lots in the Legacy Park subdivision. It includes extending and improving Park Lawn Drive and Briscoe Road east of Yellowstone Ave. BACKGROUND: This is the 1 st division of the Legacy Park subdivision. TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the evidence and by applying law to the facts; decisions shall be based on the standards for approval). Recommendation/approval of this preliminary plat shall be whether it meets the requirements of the City of Chubbuck ordinance and State of Idaho statutes. The Commission may recommend approval with or without conditions, may table a decision, or may recommend denial of the application. OWNER: G. The preliminary plat was designed to meet all the applicable City of Chubbuck standards and requirements, with the only exception being a request to deviate from the standard collector section. The requested deviation is explained in more detail later in this document. PROPERTY BACKGROUND The subject property is a 26.07 -acre parcel of undeveloped land located 400 feet south of New Day Parkway and just north of both the Diamond Court Subdivision and Capell Park. The property is bounded on the west by Yellowstone Avenue and on the east by the Union Pacific Railroad. The subject property has been recently annexed into the City of Chubbuck and is roughly split in half by Commercial General (C-2) and Dense Residential (R-4) zones. The ground surface is relatively flat, sloping east to west and falls approximately 8 feet across the property. Fort Hall Irrigation has a waste canal along the property's western boundary with the canal's bottom being around 6 feet lower than Yellowstone Avenue. The subject property has favorable access to existing transportation routes, namely Yellowstone Avenue, Park Lawn Avenue, and in the future New Day Parkway. These routes provide ample access to the city center, the Interstate, and the Northgate area. The Idaho Transportation Department (ITD) has approach restrictions along Yellowstone Avenue and has identified Briscoe Road as the only point Legacy Park can utilize as access into the property. ITD is also in the planning and design phase of a project to widen and improve this area of Yellowstone Avenue, but actual construction may not begin for another 3-6 years. Culinary water will be provided by the City of Chubbuck, and our proposal shows that we are tying into the existing water mains at the intersection of Yellowstone Avenue & Briscoe Road as well as at the current north end of Park Lawn Avenue. Sanitary sewer will also be provided by the City of Chubbuck with our connections being located at the existing manhole east of both the Yellowstone/Briscoe intersection and the waste canal as well as the current end of the sewer in Park Lawn Avenue. Irrigation water is available for the subject property through Fort Hall Irrigation and will be connected towards the northeast portion of the development. City of Chubbuck — Development Services Division Legacy Park - Preliminary Plat Narrative December 14, 2021 Page 2 Joint trench utilities (power, gas, fiber, ect.) are available both above and below ground along Yellowstone Avenue and below ground at the current end of Park Lawn Avenue. PROPOSAL INFORMATION Our proposal is to develop a 26.07 -acre parcel of land into 35 new commercial and residential lots to help meet the current market demand. This project would transition the existing dense residential uses south of the development with the more industrial uses to the north, while still being in line with the Yellowstone Commercial Corridor detailed in the Comprehensive Plan for the City of Chubbuck. LOT BREAKDOWN The southeast portion of the proposal is zoned Dense Residential (R-4) and has been set up for a series of 4-plex units and a few 8-plex units. The applicant's plan is to construct the public roadways, utility mains & service stubs and then sell the lots off to builders or investors who will construct the actual structures and parking areas. The new lot owners would be able to create their own floorplan for the 4-plex if they stay within the maximum building extents we establish for each lot. We are proposing 19 new residential lots. The parking areas and utility corridors would be under a common easement for access, maintenance, and use. The western and northern portions of our proposal are zoned Commercial General (C-2). The envisioned uses of the commercial area could consist of storefronts, convenience stores, office, yard, repair, and storage facilities. These areas are configured in a way that we can easily adjust the layout or further subdivide the current configuration without having to demolish the infrastructure built in this proposal. We are proposing 14 new commercial lots. Some of these areas have a shared access and utility easement to limit the number of approaches on the interior roadways. There are two open space lots that will be used for storm water retention for the residential areas. They will be commonly owned by the development. The individual commercial lots will be responsible for handling their own storm water runoff. ROADWAYS & PARKING LOTS There are five different sections for traffic flow throughout the development: 66' R -O -W, 55' R -O -W, roundabout, shared commercial access, and parking lot. 66' R -O -W: This street section is placed at the Yellowstone/Briscoe intersection, and it allows for two lanes of traffic in each direction which will better facilitate traffic into and out of the development. It utilizes ribbon curb and curbside sidewalk to allow stormwater runoff to enter the roadside swales. There will be no parking along this section. 55' R -O -W: This street section is used for most of the public roads, and it has one lane of traffic in each direction with a dedicated middle lane for left turns off the road. It utilizes ribbon curb to allow stormwater runoff to enter the roadside swales which lays between the curb and sidewalk. There will be no parking along this section. Roundabout: This section allows for smoother flow of traffic through an intersection City of Chubbuck — Development Services Division Legacy Park - Preliminary Plat Narrative December 14, 2021 Page 3 and is sized for a WB -67 trailer truck. It utilizes rolled curb on the interior portions and ribbon curb along the exterior to facilitate stormwater drainage. The central island is planning to have landscaping and aesthetic features placed within it. Roundabouts can offer faster vehicle cycle times when compared to standard controlled intersections. Shared Commercial Access: This street section is a 24' wide asphalt strip used to access commercial lots that do not have frontage on any road. Parking Lot: This section is used in the dense residential areas. It will incorporate standard curb and gutter to help direct stormwater runoff into retention areas. The overall width of the section is 60' between the opposing curb faces, with two 18' deep parking areas and a 24' central drive aisle. The sidewalk for this section is typically along the curb and gutter. The Comprehensive Plan identifies Park Lawn Avenue and Briscoe Road as collectors which, per the city code, requires a 48' wide street section with roadside swales. Our proposal would use this standard section for the first portion of Briscoe Road but would then transition to a 37' wide street section. This deviates from the code and would require a specific approval from the City Council. Below are some discussion items that may justify a deviation from the code: If the standard collector section is intended to have four lanes of traffic, two in each direction a driver may need to turn left off the road, this could disrupt traffic in the inside lane while waiting for an opportunity to turn. If a second driver coming from the other direction also wanted to turn left, they would now be disrupting traffic in two lanes increasing the potential for accidents. A shared turning lane, as proposed, would get these drivers out of the travel lane reducing disruption, improving traffic flow and safety. 2. If the standard collector section is intended to have one lane of traffic in each direction, a shared turning lane, and parking on each side our development proposes to eliminate the parking on all the public roads. We anticipate less congestion and accidents by this removal and will offset the potential parking loss by placing additional stalls in the residential parking areas. Our residential area has 120% of the required parking stalls, with an even higher percentage planned for future phases. It is our design goal to achieve 2.5 stalls per dwelling unit. Commercial areas will also have their own parking areas or share parking with each other. 3. A larger road section may increase the likelihood of drivers opting to cut through the Legacy Park development to bypass the streetlight on Yellowstone Avenue. 4. By keeping the street section narrower we anticipate that drivers would be less likely to prefer taking the south leg of the roundabout through the existing residential neighborhood along Park Lawn Avenue to get onto Yellowstone, reducing the traffic through this area. 5. A nearby development, Northside Crossing, has 37' wide interior street sections. That development is expected to have significantly more dwelling units than Legacy Park at City of Chubbuck — Development Services Division Legacy Park - Preliminary Plat Narrative December 14, 2021 Page 4 full build out. This sets a strong precedent for allowing us to use the same section width. 6. Whitaker Road, a collector road east of our development, also has a 37' wide street section, and appears to service more lots than Legacy Park at full build out. Whitaker Road is closer to that of a commonly perceived collector road as it is connected to many local/arterial roads and allows for through traffic. The above arguments demonstrate that the Legacy Park development, as proposed, could adequately handle the traffic loads generated by the project in a similar manner to that of nearby developments. UTILITIES As part of our proposal, all newly created residential and commercial lots will receive a culinary water and sanitary sewer service. Each commercial lot will also have its own pressurized irrigation service, while the residential and open space areas will utilize a common service to each isolated group of landscaping. Where practical culinary water mains will be designed and constructed to loop into existing water mains. Water main stubs will also be placed at the ends of each road for future development. Sanitary Sewer is split into two main lines with all the commercial feeding into the connection at Yellowstone Avenue and all the residential areas feeding into the connection at Park Lawn Avenue. Stormwater runoff for public roadways will be held in roadside swales, which will overflow into the common space retention areas. The residential areas will surface drain into the roadside swales or directly to the common space retention areas. The common space retention areas will be connected by a pipe to allow these areas to fill at the same rate. All commercial areas will be responsible for retaining their own stormwater runoff. Pressurized Irrigation main lines and service points will be installed with the overall development. A pumping system will be designed in a future phase. Once the pumping system is implemented all lots will be required to connect into it for landscaping irrigation. Contact Idaho transportation Department to verify their right-of-way needs and Briscoe Road access requirements. 2. Provide additional right-of-way for Yellowstone Avenue to meet Idaho Transportation Department needs. 3. Submit an approved Briscoe Road access permit from Idaho Transportation Department. 4. Please revise the street name from Park Lawn Avenue to Park Lawn Drive. 5. Please provide the following notes: a. "Fort Hall Irrigation Project has a 40 foot wide right of way for the Tyhee Wasteway Canal. No modifications or encroachment within the limits of the United States Right of Way for Tyhee Wasteway Canal will be allowed without prior written approval by the Bureau of Indian Affairs." b. "The 40 foot right of way will also serve as a dedicated easement to the City of Chubbuck for access and recreation conditional upon written approval from the Bureau of Indian Affairs." 6. For the 15 foot utility easement along the street frontages, revise note to read "Public Utility and Access Easement". 7. Chubbuck Municipal Code 16.12.230 requires a secondary pressure irrigation system. Provide pump station location and provide piping from pump station to the shown improvements. 8. Multi -family developments are required to be reviewed by the Chubbuck Design Review Committee. Revise the street right of way widths for Briscoe Road and Park Lawn Drive to 66' as they are collectors. 12. Provide instrument numbers for Diamond Court and Capell Park per Chubbuck Municipal Code 17.12.170.D. 13. Show the existing sewer easement on the plat. See attached documents. 14. Provide all curve data. J: Engineering I DevelopmentLegacy ParkPlatting - Land UsePreliminaryl submitted 1-11-22Legacy Park Review - Preliminary Plat SWH 1-28-22.docx 15. The Basis of Bearing shall be based on the City of Chubbuck grid coordinate system. 16. What is the 20' easement shown between lots 2 and 3 of block 1 for? 17. Connect the water mainline in Briscoe Road to the Yellowstone Ave. water mainline. 18. There are 2 sanitary sewer services shown to lot 6, block 2. 19. There are 2 water services and 2 irrigation services to lot 1, block 4. 20. The master plan shows an additional lot located in the southwest corner of lot 1, block 4. It should be shown on the preliminary plat. 21. Contact Chubbuck Fire Department to verify acceptable fire hydrant locations. 22. Intersection and access curb radius requirements are 30' radius not 20'. 23. Why is lot 5, block 1 being split by the shared access. The westerly piece will be unusable. 24. Sheet 1 does not show the easement on the west side of the shared access south of Briscoe Road. 25. Provide a fire turnaround at the north end of the shared access north of Briscoe Road. 26. The domestic waterline between Lots 2 and 5, Block 2 shall continue north to the subdivision boundary line. When the parcel to the north develops, this will provide looping of the dead-end water line. 27. Provide a note restricting access to Briscoe Road for lots 1 and 6 of block 2, and lots 3 and 5 of block 1. 28. Provide a note restricting access to Yellowstone Avenue for Lots 1 thru 3, Block 1, and Lots 1 thru 3, Block 2. 29. Consider relocating the fire turn to the south end of the shared access south of Briscoe road. 30. With Park Lawn drive classified as a collector, lots 7 and 8 of block 2 will be required to share an access. 31. Provide 10' paved multi -use path separated from the street along Yellowstone Ave. frontage. 32. Revise master plan to show New Day Parkway and the connection to Industry Way. 33. If the sanitary sewer and domestic water is to be owned and maintained by the city, provide a temporary utility easement for the utilities outside the subdivision (east of Lots 10 and 11, Block 3). Said easement will be relinquished when development occurs. 34. It appears the sanitary sewer main between Lots 1 and 6, Block 2 is too close to the easement sideline. The easement sideline must be 10' minimum from the sanitary sewer infrastructure. 35. All public sewer manholes must be accessible for operations and maintenance. Location of each sewer manhole should be in the public road right of way or must be accessible with a heavy truck / cleaning equipment by path or private roadway. If owned and maintained by the city, this would include the sewer manhole between Lots 3 and 4, Block 2, and the manhole east of Lots 10 and 11, Block 3. A gravel access surface will be required at a minimum to access the manholes. 36. Park impact fees will be required for this development. 37. The typical section for the 66' ROW Street Section doesn't meet the requirements. For 48' back- to-back section, the sidewalks are required to placed outside of the ROW and swales provided (The City would accept 56' back-to-back using standard 6" curb & gutter with sidewalk adjacent the curb). Provide 15' utility easements instead of 10'. 38. The city will review the roundabout layout after design information is submitted. Changes to the right-of-way lines around the roundabout may be needed based on the approved final design of the roundabout. The city will provide additional information regarding the design and review requirements for the roundabout. (See attachment) A: 290 E. Although not related to the preliminary plat, the city is potentially interested in contributing to the cost of the irrigation pump station if it can also serve Capell Park. Depending upon approval from Fort Hall, if a larger pump station is designed to accommodate Capell Park, the city will cover the increased cost. Please work with the city during design to accommodate this. In addition, it may be advantageous to the developer to consider partnering with nearby property owners to build one irrigation system to serve a larger area instead of smaller, individual systems. Please revise / address the above items and resubmit a digital PDF copy of the preliminary plat along with a RESPONSE LETTER addressing all items.
