RESOLUTION No. 2021- 10
Moratorium
WHEREAS, Idaho Code §67-6523 allows a governing board to adopt a moratorium on a
selected classes of permits if it finds imminent peril to the public health, safety or welfare; and
WHEREAS, said moratorium can be effective for a period not longer than one hundred
eighty two (182) days; and
WHEREAS, the City has determined there has been significant development and there are
other potential development interests that have been expressed in lands south of Chubbuck Road,
north of Interstate 86, east of Yellowstone Highway and west of the railroad tracks (hereinafter
called the "downtown subarea");
WHEREAS, the City and the Chubbuck Development Authority have financially invested
substantially in the downtown area for the purposes of redeveloping the area into a community
downtown area and has plans for further redevelopment aligned with a specific vision;
WHEREAS, the City, has found that the development of the downtown subarea is critical
to the economic success and well-being of the City's residents and is currently undergoing
research, planning, and the creation of subarea -specific plan for the downtown area;
WHEREAS, there are uses, layouts, and building forms which will dismantle the fabric of
the downtown subarea's future vitality, success, and public welfare; and
WHEREAS, a temporary moratorium on plat applications, design review committee
applications, and building permits for new buildings and additions to existing buildings will allow

the City time to propose and if approved, adopt the zoning requirements in that area that may be
more compatible for the other existing uses within the area as well as some anticipated uses;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of
Chubbuck as follows:
Effective with the adoption of this Resolution, there shall be an emergency moratorium,
as defined in Idaho Code §67-6523, on plat applications, design review committee applications,
and building permits for new buildings and additions to existing buildings within an area described
as east of Yellowstone Highway, west of the Union Pacific railroad tracks, south of Chubbuck
Road, and north of Interstate 86, except for a project known as Arbor Court at 295 E. Chubbuck
Road which currently undergoing the platting process with a known intent to obtain building
permits within the term of this Resolution..
This moratorium shall automatically expire 182 days after the adoption of this Resolution
unless sooner amended or rescinded by the Mayor or the City Council.
