AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION
2.28.010 OF THE CHUBBUCK MUNICIPAL CODE TO CHANGE THE NAME OF
THE PLANNING COMMISSION TO THE LAND USE AND DEVELOPMENT
COMMISSION; AMENDING SECTION 2.28.020 TO CHANGE THE NUMBER OF
MEMBERS OF THE LAND USE AND DEVELOPMENT COMMISSION FROM
NINE TO SEVEN; REPEALING PRIOR CONFLICTING ORDINANCES;
PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS
ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS OF CHAPTER 2.28
NOT AMENDED SHALL REMAIN IN EFFECT; AND PROVIDING WHEN THIS
ORDINANCE IS EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Amended Section 2.28.010. Section 2.28.010 of the Chubbuck Municipal
Code is amended as follows:
2.28.010: CREATED:
There is hereby created a commission to be known as the city of Chubbuck
Land Use and Development Commission.
Section 2. Amended Section 2.28.020. Section 2.28.020 of the Chubbuck Municipal
Code is amended as follows:
2.28.020: MEMBERSHIP; TERMS OF OFFICE:
A. The planning commission shall consist of nine (9) seven 7 members to be
appointed by the mayor with the consent and approval of the council.
B. The nine (9) seven 7 seats for the commission shall be designated as seats 1
through -M (7). Seats 1 and 2 shall have initial terms of three (3) years and then,
upon the expiration of those initial terms, shall have terms of four (4) years. Seats
3 and 4 shall have terms of four (4) years. Seats 5 and 6 shall have terms of four
(4) years, but the terms in existence as of this date shall be extended by one year
to allow for the orderly rotation of offices. Seats -79 -shall have a terms of
four (4) years, which terms shall not take effect until the expiration of the existing
terms. The application of this system shall be affirmed by resolution of the mayor

and council.
C. No person shall serve more than two (2) full consecutive terms without the
specific concurrence of two-thirds (2/3) of the council, adopted by motion and
recorded in the minutes. Vacancies occurring otherwise and through the expiration
of term shall be filled in the same manner as the original appointment.
D. Two (2) members of the commission may be nonresidents of the city of Chubbuck
who reside within two (2) miles of the city limits; other members shall be
residents of the city.
E. Members shall be selected without regard to political affiliations, and each shall
be reimbursed for each month of service in an amount to be set from time to time
by resolution of the city council. The commission shall elect its own chairman
annually and may create and fill such other offices as it may determine necessary.
F. The mayor may extend the term of a commission member for a period of up to
nine (9) months.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City and any provision of the Municipal Code which are in conflict with the provisions of this
Ordinance are repealed to the extent of such conflict. All other sections of Chapter 2.28 not
herein amended shall remain in effect.
Section 2. Severability. The sections of this ordinance are severable. The invalidity of a
section shall not affect the validity of the remaining sections.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall become
effective upon its passage, approval and publication.
