AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR
CHANGE OF LAND USE DISTRICT WITH RESPECT TO CERTAIN LANDS
WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK; FROM LIMITED
RESIDENTIAL (R-2) TO GENERAL COMMERCIAL (C-2); DECLARING THAT
THE CITY COUNCIL FINDS THAT SUCH CHANGE IN LAND USE PATTERN IS
CONSISTENT WITH THOSE PRESCRIBED BY THE CITY'S COMPREHENSIVE
PLAN; AND PROVIDING WHEN THIS ORDINANCE SHALT. BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1. Change of Land Use District. The land use district established by the
Chubbuck Land Use Ordinance, with respect to the lands described below, located within the
boundaries of the City of Chubbuck, are hereby changed is hereby changed from Limited
Residential (R-2) to General Commercial (C-2) as indicated:
Approximately .25 acres of Property more particularly
described on the attached Exhibit - part of Yellowstone Village
SECTION 2. Comprehensive Plan. The Mayor and Council find, and therefore declare,
that the foregoing changes in the Land Use Districts established in Title 18, Chubbuck Code, are
consistent with the land use pattern prescribed by the City's Comprehensive Plan for the
above-described property.
SECTION 3. Effective Date. Full, public hearings having been conducted in this matter,
the rule requiring an ordinance to be read on three separate days, one of which shall be a reading
in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage,
approval and publication as provided by law.

2021-022 R-2 Zone Legal Description
A portion of parcel of land, Deed Inst. 422111152, located in the Northeast % of the Northwest % of
Section 3, Township 6 South, Range 34 East, Boise Meridian, Bannock County Idaho.
Commencing at the North % corner of Section 3, said corner being marked by an ITD monument in a
vault, as described in CP&F Instrument #21111672;
Thence S 0°22'55" E along the meridional centerline of said section, 545.83 feet to a calculated point;
Thence S 89°55'11" W, 37,11 feet to a point on the westerly right-of-way line of Yellowstone Avenue,
said point be marked by a % inch diameter rebar with a plastic cap stamped "RMES PELS 2341";
Thence continuing S 89°55'11" W, 300.00 feet to a calculated point, said point being the True Point of
Beginning;
Thence continuing S 89°55'11" W, 63.00 feet to a point, said point being marked by a Yz inch diameter
rebar with a plastic cap stamped "RMES PELS 2341";
Thence S 0°20'26" E, 176.41 feet to a point, said point being marked by a % inch diameter rebar with a
plastic cap stamped "RMES PELS 2341";
Thence N 89°38'53" E, 63.05 feet to a calculated point, said point being 300.00 feet distant from the
westerly right-of-way line of Yellowstone Avenue;
Thence N 0°21'18" W parallel with and 300.00 feet distant from the westerly right-of-way line of
Yellowstone Avenue, 176.11 feet to the True Point of Beginning.
Said portion of the parcel containing 11,104.61 square feet (0.25 acres), more or less.
