A proposal by city staff to amend Chapter 18.13 Wireless Telecommunications Facilities
to bring the chapter into compliance with recent Federal legislation and rulemaking
regarding 5G implementation, setting forth a new title, purpose and policy statements,
definitions, and exemptions; regulations on modification and collocation of antennas,
distributed antenna systems, and small cells; regulations on collocation and sharing of
towers, locations, and standards; clarifications of permits and reviews required in
different zoning districts; new permit review time requirements; modified inspection and
maintenance requirements; and revised requirements regarding facility abatement,
nonuse, or abandonment. Type of Action: Recommendation.
Planning Manager Don Matson gave an update to the Board about potential
amendments to City Code 18.13 Wireless Telecommunications Facilities. The placement,
appearance and height of wireless telecommunication facilities are regulated by federal,
state and local laws. Federal codes limit the City's jurisdiction over some aspects of the
facilities, as long as a proposed facility is complying with regulations provided by the
Federal Communications Commission (FCC).
Mendenhall asked when the City would ask for inspections reports from the owners of
these facilities and if a resident from the community could ask for the City to request a
copy of those reports. Matson stated that if the City had a concern of the condition of the
facility it could make a request for those reports and a resident could also be a reason for
the City to request a copy of those reports.
Berls read the definition of a right of way located in section 18.13.030.27 and was
concerned that a wireless company could locate a cell tower on top of a utility pole
located within any right of way or utility easement in a residential neighborhood as long
as they have a franchise agreement with the City without having to notify the public or
get input for the neighbors. Berls asked if they could require the applicant to also apply
for a conditional use permit. Matson stated that the main issue with requiring a
conditional use permit is due to federal law the City only has a 60 day window to review
the application and make a decision or it is automatically approved. The City would not
have enough time to go through all the required notifications and processes for a
condition use permit within the allowed 60 days. The second concern was that the City
Council could override any decision the Land Use Board makes towards a conditional
use permit with the approval of a franchise agreement.
Mendenhall opened the Public Hearing. There being no comment, Mendenhall closed the public
hearing, bringing the meeting back to the Commission.
The commission was concerned that the public would not be receiving any
notifications or given a chance to express their concerns to the Land Use Board or to the
City Council.
Mendenhall asked if a franchise agreement required a public hearing. Attorney
Holmes stated that a franchise agreement does not require a public hearing and goes
before the City Council as a general business item for discussion.
Mendenhall asked if the public was given an opportunity to speak on a general
business item. Bowers stated that the Council could call on a member of the audience to
speak on an item of business if they desire but it is not required. The public would not
have an opportunity to speak unless asked by the City Council to do so.
Mendenhall felt like the public should be given an opportunity to express concerns
and ask questions.
Hillam asked if the City could require the applicant to provide proof of notification
that would give the public an opportunity to petition for a public hearing. Matson
recommended for the City to handle notifications at the expense of the applicant, so that
the City can verify that all legal requirements had been met.
Budge asked if a wireless company could enter into a franchise agreement with the
City or another utility company and place a new pole within the right of way without
notifying the public. Matson stated that a franchise agreement could only be entered into
for the use with an existing structure such as a power pole and not for the installation of a
new structure.
Berls stated that nowhere within this section of City Code does it specify existing
structures only, and asked for that to be added for clarification.
Stoddard asked if an application would need to be site specific or a general
application. Matson stated that the City can require an application to be site specific.
Budge asked what the public can do when they receive a written notice but no public
hearing will be available for them to express their concerns and ask questions. Bowers
stated that all notices that the City sends out notifies the public that they can submit
written correspondence to the City Council or Land Use Board up to 7 days before a
meeting, and any written correspondence will be included in the meeting packets. The
Public can also always reach out to the Mayor and Council through email.
Budge motioned to recommend to amend Chapter 18.13 Wireless Telecommunications Facilities
to the City Council as presented, conditional upon 18. 13.130 foot note 6 include any WCF
located within a right of way must be attached to an existing structure and also meet all other
requirements for that type of facility. Berls seconded.
With all commission members understanding the motion they voted.
Roll Call Vote: Carrie Holm, Yes; Thais Ayre, Yes; Jason Mendenhall, Yes; Brady Smith, Yes;
Dan Stoddard, Yes; TJ Budge, Yes; Brandon Jackson, Yes; Rebecca Berls, Yes; Mike Schwartz,
Yes; Motion carried.

APPLICATION FOR A CONDITIONAL USE PERMIT - STAFF REPORT
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON JUNE 8, 2021
SUMMARY
DESCRIPTION: An application for a Change in Land Use District from Limited Residential (R-2) to Commercial
General (C-2) on approximately .25 acres of land. Subject property is in the NE 1/4 of the NW 1/4 of Section
3, Township 6 South, Range 34 East of the Boise Meridian, Idaho, and is part of a larger parcel generally
located west of Yellowstone Ave and north of Briscoe Road in Chubbuck, Idaho. The Comprehensive Plan
Future Land Use map designates this area as Medium Density Residential, with the bulk of the property
designated as Commercial. Type of Action: Recommendation.
STAFF FINDINGS: After review the application, Staff finds that it likely meets the requirements for the
Change in Land Use District.
• The Comprehensive Plan Future Land Use map designates this area for Medium Density
Residential land uses and development.
• Properties to the west and south are large lot single family dwellings, a large mobile home
park is on the north side, and land to the east is under consideration for a CUP to allow multi-
family development in the C-2 zone.
• The remainder of the development site (2.2 acres) is already in the C-2 zone; this request
would bring the entire project into a single zone and prevent this portion from being cut off
from street access.
• The applicant has met City Code requirements to be heard for a change in land use district.
• Staff recommends approval of the request.
FACTS
BACKGROUND: This request will precede a request for a CUP on the remaining area (2.45 acres total) for
multi -family development in the C-2 zone. Most of the overall site is farmland and never before
developed.
TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the
evidence and by applying law to the facts; decisions shall be based on the standards for approval).

Yellowstone Village Narrative
City of Chubhuck staff,
I am requesting that the Y, acre {approx.10%) of proposed Yellowstone Village be changed from
zoning R-2 to C-2 so that the entire piece have the same zoning. Currently the comprehensive plan land
use map does not align with each other in this area. The zone change would put the entire piece in the
same zone, If the N, acre piece was not changed from R-2 to G2, then this small % acre piece would be
left land locked and unusable. The change would not affect any other jurisdictions. Also, the access
Point would be the same, so the change should support the proposal without creating other issues
offsite.

Additional Policies Relevant to the Application
Staff has identified the following goals, objectives, and policies as potentially applying to this application, decision
makers should evaluate the following summaries and determine if they are applicable to the proposal and if
others can be identified from the Plan. Summaries of goals, objectives, and policies may not be verbatim.
CHAPTER 5: TRANSPORTATION
GOAL 5.1 PROVIDE FOR SAFE AND FREE-FLOWING TRAFFIC FOR ALL MODES OF TRANSPORTATION
OBJECTIVE
5.1.1 Increase the efficiency of functional class roads
POLICY
No policy was included in the Comprehensive Plan for this objective; however the City promotes
efficiency and safety on collector and arterial roads by following approved design standards and
access management guidelines
COMMENT
Briscoe Rd is designated a collector; additional right-of-way will be part of the dedications with the
plat application.
CHAPTER 9: NATURAL RESOURCES
GOAL 9.5 PRESERVE FARMLAND WITHIN THE REGION
OBJECTIVE
9.5.1 Preserve prime farmland for productive agricultural use for as long as is practical
POLICY
f. Within agricultural zoning districts, limit residential densities to an average of no more than
one dwelling per 40 acres. For new rural development in agricultural districts, use lot -size
averaging to cluster homes on small lots while maintaining large parcels for agricultural use
COMMENT
The project is consuming 2.5 acres of farmland, adjacent to Yellowstone.
* The Comprehensive Plan includes several strategies with the policies in certain chapters.

APPLICATION FOR A CONDITIONAL USE PERMIT - STAFF REPORT
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON JUNE 8, 2021
SUMMARY
DESCRIPTION: An application for a Conditional Use Permit to build multifamily residential buildings on
approximately 2.45 acres of land in the Commercial General (C-2) zone (90%) and Limited Residential (R-
2) zone (10%). The R-2 portion is under concurrent application for a change to the C-2 zone (see
companion notice regarding zone change request).
The subject property is in the NE 1/4 of the NW 1/4 of Section 3, Township 6 South, Range 34 East of the
Boise Meridian, Idaho, generally located at the northwest corner of Yellowstone Ave and Briscoe Rd in
Chubbuck, Idaho. Type of Action: Decision.
STAFF FINDINGS: After reviewing the application and related materials, staff finds that it likely meets the
standards established by the City for a Conditional Use Permit (CUP).
Residential developments, including multifamily buildings, may be permitted in the Commercial
General (C-2) zone.
The Design Review Committee has reviewed the site plan and requested revisions from the
developer; the committee's recommendations are reflected in the site plan included with this
report.
o The committee directly reviews and approves such details as parking, landscaping, access,
utility services, and sanitation.
o The Land Use and Development Commission may approve other or more stringent
conditions on the proposal.
CUP follows a request for a zone change on a small part of the site (10%, or 2.45 acres).
The applicant has met City Code requirements to be heard for a CUP.
Staff recommends approval of the proposed multi -family land use and general site plan.
FACTS
BACKGROUND: The project site is at the corner of Yellowstone and Briscoe. Briscoe is designated a collector
street in the Comprehensive Plan Functional Road Classification System, so additional right-of-way will be
dedicated with the plat. ITD will widen Yellowstone along the eastern side of the property when the New
Day/Siphon Road intersection is improved. This site includes an older brick home facing Yellowstone that
will be torn down.
Yellowstone Village CUP

evidence and by applying law to the facts; decisions shall be based on the criteria and standards for
approval per sections 18.28.040 and 18.28.050 of City Code). The Commission may approve with or
without conditions, may table a decision, or may deny the application.

STANDARDS FOR REVIEWING A CONDITIONAL USE PERMIT
The following code regarding CUPS should be used in evaluating and weighing the application:
18.28.040 C. Criteria and Standards: The following criteria and standards shall be applied in
determining whether to grant or deny any application under the terms of this title for a conditional use
permit, and in considering and defining the conditions (if any) to be imposed upon a conditional use
permit granted hereunder:
The use for which such permit is sought must not be injurious to the neighborhood or
otherwise detrimental to the public health, safety or welfare.
Analysis: The proposal is greater density than other development along Briscoe Road, but the
site is at the eastern terminus and should have minimal impact to the rest of the street. Final
design of landscaping, fencing, and lighting will reduce impact on adjacent single family home.
2. The permit sought shall not produce an adverse impact on the economic values of adjacent
properties.
Analysis: Staff is not aware of any negative economic impact to adjacent properties that would
be caused by the proposed use. Final design of landscaping, fencing, and lighting will also
reduce impact on adjacent single family home.
The permit sought shall not produce a negative impact on transportation facilities, public
utilities, schools, public parks or the natural environment any greater than had the strict terms
of this title been satisfied.
Analysis: Staff believes if there is any negative impact on transportation facilities, public utilities,
schools, public parks or the natural environment, it would be no greater than if the strict terms

of the zoning code were satisfied (without granting a CUP). The access to the facility will align
with Belva Lane to reduce turning conflicts at the intersection.
4. Account shall be taken of noise and traffic conditions in the vicinity of the land for which the
permit is sought.
Analysis: Staff believes the potential noise, and number of trips per day, are likely less than
many other uses allowed in the General Commercial (C-2) zone. Multi -family homes typically
generate 7 trips per day (single family homes generate an average of 70 trips/day).
Account shall be taken of the character and use of the buildings and land adjoining and in the
vicinity of the property for which the permit is sought, together with the number of persons
residing or working in such buildings or upon said land; and the permit, if granted, shall not
work an unreasonable hardship upon surrounding property owners by virtue of its physical
nature or by the impact of changes made in the landscape of said land.
Analysis: The building elevations and site plan are different from current conditions, but well
within what is expected in the C-2 zone. With a single access near the eastern terminus of
Briscoe Rd there should be no unreasonable hardship.
6. Account shall be taken of the aesthetic qualities of the proposed use and surrounding lands.
Analysis: The buildings are "attached" and are not typical of standalone 4-plexes. They are
aesthetically pleasing and will complement the Yellowstone corridor.
7. Account shall be taken of the support or opposition expressed by persons entitled to receive
notice of the conditional use permit application.
Analysis: No written comments have been received as of this writing.
The applicant shall show that he has taken all reasonable steps to comply with the strict terms
of this title. If the applicant can show that the uses "allowed" under this title are not feasible,
such showing shall support an application for a conditional use permit.
Analysis: There is a very high demand for housing within the city and Portneuf Valley. While
there may be permitted commercial uses suitable for the site, there is greater demand for the
residential at this time.
9. Adverse impact on other development within the city shall be minimized as far as possible.
Analysis: There is likely no evidence of impact on other development in the city. There is a need
for more housing in the region — additional residents to Chubbuck can bring benefits to local
businesses. After the ITD project to widen Yellowstone is complete, his site will be connected by
sidewalk to Chubbuck's commercial core.
10. The sequence and timing of any development conditionally permitted hereunder may be
controlled as appropriate.
Analysis: There is likely no need to control the sequence and timing of the project. The applicant
will yet need to complete the platting process before building.
11. The duration of any development conditionally permitted hereunder may be controlled.
Analysis: Because these are permanent buildings with little potential to change their use there
should be no reason to control the duration of the development.

12. Any permit granted hereunder may contain provisions for assuring that the development is
maintained properly.
Analysis: The common areas will maintained, including stormwater basin, landscaping, and
recreation area.
13. Any permit granted hereunder may designate the exact location and nature of the permitted
development.
Analysis: The applicant will be required to meet all codes for building, site, landscaping, access,
storm water and site development, as well as conditions placed by the Design Review
Committee.
14. Any permit granted hereunder may require the provisions for on site or off site public facilities
or service.
Analysis: Staff does not find that any additional public facilities or services other than the
standard requirements are needed.
15. Any permit granted hereunder may require more restrictive standards than those otherwise
required by this title.
Analysis: Staff does not find that stricter standards would need to be met as it will have required
landscaping and meet applicable standards.
16. Notwithstanding the time deadlines established elsewhere in this title for processing
applications, the city council may, if it deems such action necessary, require studies of the social,
economic, fiscal and environmental effects of the proposed conditional use prior to the
granting or denying of the application therefor, and the applicable time deadline shall be
extended accordingly.
Analysis: Staff does not find likely cause for additional studies to be required.
18.28.050: CONSISTENCY WITH COMPREHENSIVE PLAN:
No variance shall be granted, nor any conditional use permit issued, nor any revision to this title
adopted, unless such action is consistent with the city's comprehensive plan.
STAFF RECOMMENDATION
Staff recommends approval of the proposed multi -family land use and general site plan.

Section 10, Township 6 South, Range 34 East of the Boise Meridian, Idaho, generally located at 295 E
Chubbuck Road in Chubbuck, Idaho. Type of Action: Decision.
STAFF FINDINGS: After reviewing the application and related materials, staff finds that it likely meets the
standards established by the City for a Conditional Use Permit (CUP).
• Multi -family buildings are conditionally permitted in the General Commercial (C-2) zone.
• The Design Review Committee has reviewed the site plan and requested revisions from the
developer; the committee's recommendations are reflected in the site plan included with this
report.
o The committee directly reviews and approves such details as parking, landscaping, access,
utility services, and sanitation.
o The Land Use and Development Commission may approve other or more stringent
conditions on the proposal.
The applicant has met City Code requirements to be heard for a CUP. If the CUP is approved,
the developer's next step will be to apply for a plat.
Staff has sent notices to neighbors, as well as posting a sign on site with flyers, and published
notices in the Idaho State Journal and on the internet.
• Staff recommends approval of the multi -family use and site plan.
FACTS
BACKGROUND: The site has had various uses over time, including a dairy, and currently sheds are sold from
the property. It is immediately north of the new City Hall building. The current address is on Chubbuck
Road, but access will be only from Burley Drive.
TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the
evidence and by applying law to the facts; decisions shall be based on the criteria and standards for
approval per sections 18.28.040 and 18.28.050 of City Code).

Analysis: The proposal would clean up the site (reducing weeds, dust, and potential for brush
fires) and provide more housing in the downtown area, where a mixture of uses is desired. Staff
does not believe it would be injurious to the neighborhood nor public health, safety or welfare.
2. The permit sought shall not produce an adverse impact on the economic values of adjacent
properties.
Analysis: Development of the parcel with residential uses will bring more customers within
walking distance of the various businesses along Chubbuck Road.
The access to the facility will be
from Burley Drive.
PO Box 5604 — 5160 Yellowstone Avenue, Chubbuck, ID 83202
208.237.2430 — Fax 208.237.2409
CHUBBUCK www•CityofChubbuck.us
1 0 0 H 0
Arbor Court CUP
4. Account shall be taken of noise and traffic conditions in the vicinity of the land for which the
permit is sought.
Analysis: Staff believes the potential noise, and number of trips per day, are likely less than
many other uses allowed in the General Commercial (C-2) zone. Multi -family homes typically
generate 7 trips per day.
Analysis: The current condition of the lot is bare ground with the abandoned foundation. The
project will likely improve the looks of the area rather than detract from property values.
Account shall be taken of the aesthetic qualities of the proposed use and surrounding lands.
Analysis: The building elevations are more in line with desired architecture in the downtown
than are typically found in R-4 zone developments.
There is a need
for more housing in the region — additional residents to Chubbuck can bring benefits to local
businesses. This site is within walking distance of Chubbuck's commercial core.
10. The sequence and timing of any development conditionally permitted hereunder may be
controlled as appropriate.
Analysis: There is likely no need to control the sequence and timing of the project. The applicant
will yet need to complete the platting process before building. As soon as the proper permitting
is complete the developer hopes to begin construction, and be complete within 7 months
thereafter.
11. The duration of any development conditionally permitted hereunder may be controlled.
Analysis: The developer will need to complete the platting process before receiving building
permits, perhaps by the end of the summer. He estimates construction time will be about seven
months long..

12. Any permit granted hereunder may contain provisions for assuring that the development is
maintained properly.
Analysis: Applicant intends to have a property manager in charge of maintenance, including
landscaping and snow removal.
13. Any permit granted hereunder may designate the exact location and nature of the permitted
development.
Analysis: The applicant will be required to meet all codes for building, site, landscaping, access,
storm water and site development, as well as conditions placed by the Design Review
Committee. The site is currently addressed at 295 E Chubbuck Rd.
Analysis: A stormwater study is required for the development. Staff does not find likely cause for
any additional studies to be required.

Date: April 27, 2021
Applicant, Daren Crockett, presenting project again before the Committee, with edits.
• Project originally had 11 units and is now down to 7 with only 2 with backs to Burley Dr.
• Units against Burley are 10' from the easement/right of way.
• Large grass area in the middle to allow for traffic flow and fire and sanitation truck turnaround.
• There is now a 25' drive area and 35' in corners.
• Each unit has a garage, outside parking spot in front of it and one in front of door.
• 3 parking stalls per unit plus a few extras within the development
• Storm water retention in middle grass area
• Buildings are all interior facing
• No access from Chubbuck road, existing entry way cut into curb, but will not be used
• No access to the south, traffic flows internal and back out to Burley
1. Traffic Safety and Traffic Congestion: (ingress, egress, off-street parking, unloading)
• Distance from Chubbuck to access on Burley, using existing entrance, is approximately 240ft.
• Requirement for sight triangle on an arterial is 15' back from curb line, building is 20' back. Meets
requirement.
• Have engineer look at 35' internal turn radius for truck turns
• Applicant will paint 'no parking' around island area to prevent congestion
• Applicant will paint traffic arrows for directional flow — design as one way
2. Traffic Studies, Utility Studies: (as requested)
3. Drainage: (storm & surface water, to be engineered, retained on site)
• Will need to see design
4. Pretreatment / Nonresidential Waste Water Permit: (grease or oil/silt separator)
• None
5. Development Agreement (when needed)
• Yes
6. Structures and Site Layout: (exterior design, buffering, fencing, dumpster enclosure)
• Exterior design is the same as previously discussed. Will add dormers, pop -outs and different colors,
may also do rock fascia on walls.
• Committee's biggest concern was the back of buildings facing Burley. Suggestion is to make the backs
look similar to the fronts.
• Applicant only plans for fencing along the west side of the property
• Recommendation to move dumpster location to the north side of driveway (front loading)
7. Building Department: (professionally approved plans, ADA compliance, dumpster enclosure)
• Sanitation trucks are front load
• Dumpster location needs to be moved 10' off easement/right of way
• Recommendation to make adjustments with internal design to dumpster location, grassy area and
landscaping along Burley
• Have surveyor finish drawings, show elevations, windows, colors, etc.
