PUBLIC HEARING An application for annexation of approximately 9.64 acres of land into the City of Chubbuck and to include the property in the Limited Commercial (C-1) Zone. The Comprehensive Plan Future Land Use map designates this area for Mixed Use development and a small portion for Medium Density Residential development. Property is in the SW % of Section 4, Township 6 South, Range 34 East of the Boise Meridian, Idaho. The affected property is generally located at the northeast corner of Philbin Road and Chubbuck Road. Type of Action: Recommendation to Council. (Action item) Mitchel Greer, RMES 600 E. Oak, representing the applicant. Property is located at the north east corner of Chubbuck and Philbin and is roughly 10 acres. The city has extended to the west of the property quite a ways. There have also been discussions about commercial development for the property to the south. Greer stated they originally submitted a request to break the zoning into two segments, C-2 zone and R- 4 zone but that raised a lot of concerns with residents so they pulled that request and came back with something a little more cohesive with neighborhood and are now requesting C-1 zoning. C-1 allows for a few uses on the property but a multitude of uses available would require additional processes to accommodate and that way they can get additional input from the public. The property is located on two of the larger arterial streets in the city and which is where people and businesses like to locate. In the very southwest corner of the property they would like to have a neighborhood style convenience store that would complement the neighborhood and general area. Smaller business/office type uses would back up against Bilyeu Estates and they would allow for buffering there. There is an existing home on the property and they have had a couple of proposals to purchase and use as daycare which fits in C-1 zoning. Greer stated the property should be in city and the zoning is consistent with the comprehensive plan. Greer added that there was some concern about the existing trees and that there is a plan for Philbin and Chubbuck to be widened and those trees will be removed anyway. Berls asked what is planned for the northern section of property. Greer stated there are no specific plans. At one time they had proposed quad villas but nothing is planned other than the existing home that will be some sort of commercial use, likely a daycare. Matson, Planning Manager, provided the Staff Report and stated that the future land use map it is marked for mixed use and supports C-1 zone. There is about 1/3 of an acre next to residential properties that is in medium density area but isn't feasible to make that small of an area a different zone. More appropriate to have the bulk of the property under one zone. Site has frontage on both roads, water and sewer already available. Property meets annexation requirements and meets standards for change in land use district. C-1 is appropriate as a transitional zone between the neighborhood and commercial zoning. Most every land use would come back to the Commission for a public hearing so neighbors will still have a voice. Staff is comfortable with the proposal and support the project. Berls asked for further explanation on how it would be required to come back. In 18.08.40 Berls stated that under C-1 a lot of things are automatically permitted. Matson clarified the items Berls was referring to were for C-2 zone. C-1 only allows for a few uses and all others would need a conditional use permit. Berls asked what a non-residential production building is. Matson explained it is a modular/pre fab building and add that there are standards for manufactured buildings as well. Berls stated she still didn't like the non-residential production buildings. Matson stated that you normally don't see a lot of those in non-residential but they would still have to meet design standards. Mendenhall opened the public hearing. Frank Nuding, 6346 Old Branch Road, testified in favor of the application. Nuding stated he is the realtor working on behalf of the Pahl family on the project. They don't anticipate putting any 10,000 square foot buildings or modular buildings of any kind on the property. Greer has laid out what they'd like to see and will follow existing ordinances and they feel it meets the master plan for the City of Chubbuck. David Hall, 4893 Hiram, testified neutral to the application. Hall stated his property is right next to the property in question. Hall stated they are grateful it has come back as C-1 as opposed to C-1 and R-4. Hall stated he was speaking on behalf of Hiram Street and submitted a few written pages as well. They support the annexation and C-1 zoning. The biggest thing Hall asked the Commission to pay specific attention to was in 18.08.10 in C-1, to the interface between commercial and residential uses and the common boundary. Hall referenced 18.12.020 section C about side and rear yard requirements abutting a residential district. 40 foot required but is allowed to be reduced 50% with fences and landscaping. Hall requested that be incorporated with a 20 foot landscape buffer to transition from R-2 to C-1 to help mitigate any noise and light filtration. Request was to maintain 40 foot setbacks and 20 foot buffer. No testimony in opposition. Mendenhall closed the public hearing brining the meeting back to the Commission. Mendenhall clarified that the application is for annexation and zoning and that design specifics will come back at a later date and will have to comply with ordinance. Holm asked for additional information about the widening of Philbin Road. Matson stated it is a couple years off but it will include widening of the intersection and a round -about. They have secured some of the right of way for the round -about. Some improvements will happen with this project and some with the development across the street. Hillam, indicated that project would likely happen between 2022 and 2023. Berls commented that she feels it's appropriate to annex and asked if the buffering issue would be addressed in the platting stage. Mendenhall stated that any variance to setbacks would be something they would file an exemption for and it would come before the Commission for a recommendation to Council. After that it also has to go through the Design Review Committee. Attorney Holmes clarified that it is not an exemption, it is part of the design of the project which will be taken care of by Design Review and City Staff when reviewing the project to make sure it's in compliance. Any change from code beyond that would be an exemption. Holmes added that it would be unusual to have an exemption from landscaping or buffering particularly between a commercial and residential zone. Mendenhall added that if the proposed project didn't fit within the criteria it would have to come back for a conditional use permit. Mendenhall entertained a motion. Stoddard moved to recommend approval of application of annexation and C-1 zoning as presented. Holm seconded. With all commission members understanding the motion they voted. Roll Call Vote: Dan Stoddard, Yes; Rebecca Berls, Yes; Carrie Holm, Yes; Jason Mendenhall, Yes Motion carried. 2. A proposal by city staff to delete existing section of City Code, 18.12.030.N Permit Procedures for Residential Rental Dwellings, and replacing it with a new Chapter 18.10 Accessory Dwelling Units (ADUs), setting forth a new purpose, procedures, standards, and other criteria for future ADUs within the City of Chubbuck; to amend section 18.08.040 General Controls to clarify the process for neighbors comment on ADUs, and to amend section 18.12.040.A Miscellaneous Supplemental Controls to include ADUs. Type of Action: Recommendation to Council. (Action item). Matson stated this item has been discussed in the last few meetings and briefly described the attached exhibits. The changes will make the ADU definition and requirements more clear. Mendenhall asked about page 5 exhibit 3. The schedule for C-1, single household, duplex, four plex and apartments are all conditionally permitted. How they would outright permit an ADU if everything is conditionally permitted. Matson stated if it is something like a caretaker residence it would fall under there the code presented is clearer about how they would incorporate an ADU into non-residential dwelling. Mendenhall opened the public hearing. No testimony. Mendenhall closed the public hearing brining the meeting back to the Commission. Berls stated that city staff has done a good job to rewrite the code. Mendenhall entertained a motion. Berls moved that based off everything presented to recommend approval of changes to city code 18.12.30, 18.10 for accessory dwelling units, 18.08.40 for general controls, and amend 18.12.40 miscellaneous supplemental controls to include ADU's. Smith seconded. With all commission members understanding the motion they voted. Roll Call Vote: Carrie Holm, Yes; Brady Smith, Yes; Mike Schwartz, Yes; Dan Stoddard, Yes; Rebecca Berls, Yes; Jason Mendenhall, Yes. Motion carried. GENERAL BUSINESS No items. Matson thanked those who participated in the downtown survey. They have received 185 responses so far. If they haven't done the survey Matson encouraged them to do so; survey is posted on Nextdoor, Facebook and Twitter. Mendenhall entertained a motion to adjourn; Schwartz made the motion. Smith seconded. All voted to adjourn at 7:51pm. Jason Mendenhall, Chairperson Kami Morrison, Office Administrator This meeting was available to the public electronically and by phone. PRELIMINARY REVIEW OF COMPLIANCE WITH SECTION 18.12.050 SUPPLEMENTAL CONTROLS FOR SELF-SERVICE STORAGE FACILITIES The application will be regulated by Design Review regarding the requirements of storage facilities. Access to streets, style and design of buildings, maximum size (3 acres), roadways, fences, landscaping, structure area, and lighting. The Commission may provide input on these and any additional feature that may help guide the design review process, such as exterior walls, building exterior general appearance, setbacks, etc.. STANDARDS FOR REVIEWING A CONDITIONAL USE PERMIT The following code regarding CUPs should be used in evaluating and weighing the application: 18.28.040 C. Criteria and Standards: C. Criteria And Standards: The following criteria and standards shall be applied in determining whether to grant or deny any application under the terms of this title for a conditional use permit, and in considering and defining the conditions (if any) to be imposed upon a conditional use permit granted hereunder: PO Box 5604 — 5160 Yellowstone Avenue, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 CHUBBUCK www•CityofChubbuck.us 1 0 R H 0 The use for which such permit is sought must not be injurious to the neighborhood or otherwise detrimental to the public health, safety or welfare. Staff Analysis: The neighborhood includes two churches residential homes and future site owned by the school district. Staff finds that as presented there is likely no evidence that the use for which the permit is sought would be injurious to the neighborhood nor public health, safety or welfare. 2. The permit sought shall not produce an adverse impact on the economic values of adjacent properties. Staff Analysis: Staff is not aware of any negative economic impact to adjacent properties caused by the proposed use. Property will be maintained and secured with a caretaker on site. 3. The permit sought shall not produce a negative impact on transportation facilities, public utilities, schools, public parks or the natural environment any greater than had the strict terms of this title been satisfied. Staff Analysis: The evidence suggests that the negative impact on transportation facilities, public utilities, schools, public parks or the natural environment would be no greater than if the strict terms were satisfied. The access to the facility will be from Hiram. 4. Account shall be taken of noise and traffic conditions in the vicinity of the land for which the permit is sought. Staff Analysis: The evidence suggests that the trips per day could be less than other allowed Limited Commercial (C-1) uses of the site. The research shows that the trips per day for storage units are commonly calculated at 2.5 per 1000 square feet. Applicant provided trip generation information that is provided in the packet. 5. Account shall be taken of the character and use of the buildings and land adjoining and in the vicinity of the property for which the permit is sought, together with the number of persons residing or working in such buildings or upon said land; and the permit, if granted, shall not work an unreasonable hardship upon surrounding property owners by virtue of its physical nature or by the impact of changes made in the landscape of said land. Staff Analysis: The buildings will be pleasing, maintained and compliment the surrounding uses; the current residential uses and churches, and the proposed commercial uses and future school. 6. Account shall be taken of the aesthetic qualities of the proposed use and surrounding lands. Staff Analysis: The use and buildings likely should complement the surrounding uses. Even though some may not envision this to be the most desirable use for the property, the application meets the minimum requirements of the city code. Building elevation drawings in the application show a facility with more aesthetic appeal than any other in Chubbuck. Landscaping is provided on the street frontages, also indicated in the elevation drawings. The two landscaped swales will accommodate stormwater runoff. PO Box 5604 — 5160 Yellowstone Avenue, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 CHUBBUCK www•CityofChubbuck.us 1 0 R H 0 7. Account shall be taken of the support or opposition expressed by the persons entitled to receive notice of the conditional use permit application. Staff Analysis: No comments have been received by staff on this project as of this writing. 8. The applicant shall show that he has taken all reasonable steps to comply with the strict terms of this title. If the applicant can show that the uses "allowed" under this title are not feasible, such showing shall support an application for a conditional use permit. Staff Analysis: Self -Storage Facilities and residences are conditionally permitted in a C-1 Limited Commercial zone. A three (3) acre storage facility is the maximum allowed in the Limited Commercial (C-1) zone. 9. Adverse impact on other development within the city shall be minimized as far as possible. Staff Analysis: Staff finds that there is likely no evidence of impact on other development in the city. 10. The sequence and timing of any development conditionally permitted hereunder may be controlled as appropriate. Staff Analysis: The applicant will need to complete the platting process as well as Design Review before building. Staff finds there is likely no need to control the sequence and timing of the project thereafter. 11. The duration of any development conditionally permitted hereunder may be controlled. Staff Analysis: Staff finds that since these are permanent buildings there would be no reason to control the duration of the development. 12. Any permit granted hereunder may contain provisions for assuring that the development is maintained properly. Staff Analysis: As this is an active business the owner has a vested interest in its appearance and maintenance. 13. Any permit granted hereunder may designate the exact location and nature of the permitted development. Staff Analysis: The applicant will be required to meet all codes for building, site, landscaping, access, storm water and site development. 14. Any permit granted hereunder may require the provisions for on site or off site public facilities or service. Staff Analysis: Staff does not find that any additional public facilities or service other than the standard are likely needed. 15. Any permit granted hereunder may require more restrictive standards than those otherwise required by this title. PO Box 5604 — 5160 Yellowstone Avenue, Chubbuck, ID 83202 208.237.2430 — Fax 208.237.2409 CHUBBUCK www•CityofChubbuck.us 1 0 R H 0 Staff Analysis: Staff does not find that stricter standards would need to be met as it will have landscaping and perimeter decorative wall. 16. Notwithstanding the time deadlines established elsewhere in this title for processing applications, the city council may, if it deems such action necessary, require studies of the social, economic, fiscal and environmental effects of the proposed conditional use prior to the granting or denying of the application therefor, and the applicable time deadline shall be extended accordingly. (Ord. 320 § 1, 1989: Ord. 246 § 2, 1983: Ord. 241 § 7-4, 1983) Staff Analysis: Staff does not find likely cause for additional studies to be required. 18.28.050: CONSISTENCY WITH COMPREHENSIVE PLAN: No variance shall be granted, nor any conditional use permit issued, nor any revision to this title adopted, unless such action is consistent with the city's comprehensive plan. In keeping with the spirit of the Comprehensive Plan, the applicant has also applied for C-1 zoning, which has been approved by both the LUDC and City Council. EXAMPLE MOTIONS APPROVAL (WITH CONDITIONS): Having reviewed the petition materials, staff report, and all testimony presented before and by the City in this hearing as part of the record against criteria established by City Code, and having found that those criteria for approving a Conditional Use Permit request are satisfied, I move to approve the Conditional Use Permit as described in the application materials with the following conditions: 1 . ................ This self storage facility will provide a much needed service to the neighborhood by giving residents and businesses the opportunity to store their personal property in a safe, clean, and secure environment. It allows people who do not have enough storage space at home to keep their living spaces more organized, cleaner, safer, and stress free. This fosters public health, safety, and welfare. 2. How will this Application produce a positive impact on transportation facilities, public utilities, public parks or the natural environment? Self storage facilities create a very low traffic count. A facility this size may generate about 50 trips a day.The public utility impact will be the equivalent as one residence. All of the storm water will be retained on site. There will be little impact on public parks having only one residence. Storage units have very little impact on the natural environment. They do not manufacture or produce. These facilities are very quiet. These facilities comply with "dark sky" ordinances when it comes to site lighting. All wall pack lights are shielded downward and controlled by astrological timers. No light pollution. 3. What account has been taken of noise and traffic conditions in the vicinity of the land for which the application is sought? This storage facility will be very quiet. Solid masonry sound wall around the perimeter. Hours of operation will be limited. Traffic impact is very low. Lowest impact of all commercial uses. We will set entry keypads and gates such that stacking of vehicles on the road will be of no concern. 4. What account has been taken of the character and use of the buildings and land adjoining and in the vicinity of the property for which the permit is sought, together with the number of persons residing or working in such buildings or upon said land? How is the proposed development compatible? Storage unit uses will be screened from adjoining properties. There will only be one caretaker (husband and wife) living on site who will manage the facility 24/7. The caretakers become neighbors to the surrounding property owners and will develop a good relationship with them. If issues occur, the caretakers will be able to address them and resolve them in a timely manner. 1 of 3 Revised 1-25-2017 PBA Conditional Use Permit Questionnaire 5. Explain how the permit, if granted, will not work an unreasonable hardship upon surrounding property owners by virtue of its physical nature or by the impact of changes made in the landscape or natural scenery of said land? 1. The height of the buildings will be equal to or less than a two-story residence. 2. The architecture of the residence and storaae buildinas will be eaual to and compatible with surrounding structures. 3. The backs of the storage unit buildings will be architectural masonry and will serve as a perimeter fence. 4. There will be no light pollution. All interior wall pack lighting will be shielded downward 6. What considerations have been given to the aesthetic qualities of the proposed use and surrounding lands? We will be using construction materials that will be equal to or better than surrounding uses and buildinas. All of the front, side, and rear setbacks will be professionally landscaped. This will add more buffer between the surrounding uses and the storage. 7. Address how adverse impacts on other developments within the City have been minimized as much as possible. Low traffic impact. Low site utility impact. Low environmental impact. 8. Describe the sequence and timing of the proposed development. Construction of this project will take place in two phases. Phase one will be office/residence and perimeter buildings which will take one year to complete. Phase two will be the interior buildings. 9. How will the development be properly maintained? Facility will have caretakers living on site 24/7. The caretakers will keep the facility clean, securer quiet, and orderly. The facility will have a state of the art security system with cameras and automated gates for entry and exit. 2 of 3 Revised 1-25-2017 PBA Conditional Use Permit Questionnaire 10 Designate the exact location and nature of the development. East lot of the South East corner of Chubbuck and Philbin. The facility will have an office, residence, and approximately 500 storage units when completely built out. 11. Which on-site or off-site public services are required for this development? (E.g. - Sanitation, Water, sewer, other.) Sanitary sewer for the office/residence. Water for the office/residence and landscaping. Water for fire hydrants. Storm drain will be retained on site. Natural gas, electricity, and communications will also needed. 12. List which, if any, studies of social, economic, or environmental effect have been required of this application. (Examples: Traffic Study, Water or Sewer Capacity Study, Storm -Water Drainage, etc.) No studies have been required at this time. 3 of 3 Revised 1-25-2017 PBA +............................. Trip Generation Exhibit April 7, 2020 TRANSPORTATION ENGINEERING RE: Bear River Storage Trip Generation Memo — Chubbuck, ID The following is a Trip Generation memo for the proposed Bear River Storage units located along Chubbuck Road between Philbin Road and Harm Ave in Chubbuck, ID. The development is proposing a 572 unit storage unit facility. Figure One identifies the site location and Figure 2 shows the proposed site layout. Figure 1: Site Location P.O. Based on the land use assumptions and size of the building, the projected traffic generated by the site is determined. Table 1: Site Trip Generation The results indicate that the proposed development is projected to generate 1 AM peak, 1 PM peak trips and 10 daily trips. Storage units are very low generators of traffic. Both roadway frontages are two-lane road with an approximate capacity of 13,500 ADT. Therefore this project is projected to utilize less than 0.1 % of the roadway capacity. Please let me know if you have any questions. The subdivision proposal complies with the applicable provisions of this title. The current project as proposed meets the applicable provisions of this title. 2. The subdivision proposal complies in principle with all applicable City design standards and development regulations. All lot sizes, rights -of way, roadways, utilities etc. have been designed to comply with the city standards and development regulations. 3. The subdivision proposal complies with all applicable zoning requirements of the underlying zoning district, applicable overlays, and other applicable development standards. The current project is anticipated to be located within a Residential (R-2) zone within the city and will follow all of the parameters, guidelines and development standards that the (R-2) zone requires. 4. All public facilities including streets, sidewalks, curbs, gutters, water, sewer, fire protection, and sanitation services can be provided to the newly created lots and accommodate future extension to adjacent land. The use of a "control strip" intended to control or prevent the future extension of public facilities or development of adjacent land is prohibited. The current layout of the project allows for the extension of public facilities to the west along Sawtooth Street and south along Nordic Drive. There are no areas within this develop that prevent or control access to adjacent lands. 5. If city public works determines that the proposed subdivision will result in significant traffic impacts then a "traffic impact study" will be required as part of the commission's review. A significant traffic impact is generally defined as occurring when: a. A Proposed development or redevelopment of a site will generate 100 or more new peak hour trips, or b. The added volume is equal to 1,000 vehicles per day. The proposed project will only consist of 14 households. Assuming an overall national average of 10 trips per single family household per day (14 x 10 = 140) and 1 peak hour trip per day (14 x 1 = 14), the 140 total trips per day and 14 total peak hour trips per day will not generate enough peak hour trips or total trips to warrant a traffic impact study. 6. The proposal provides for a continuation of a connected transportation system unless topography or natural features prevents connection to abutting streets or property. As stated in item #4, the proposed layout will allow for the extension of public facilities west along Sawtooth Street and north along Nordic Drive. There are no natural features or topography that will prevent future connections. 7. The proposed subdivision provides for bicycle and pedestrian transportation routes and amenities in accordance with Bannock Transportation Planning Organization's adopted bicycle and pedestrian plans. The proposed subdivision will have sidewalks running throughout that connect into the adjoining sidewalks within Park Meadows subdivision. Proposed sidewalks will end at future tie in points to Alpine Crossing 1 B Exhibit 4 future phases to the west and south. This will provide adequate transportation routes for both bicycle and pedestrian traffic to circulate throughout the future neighborhoods. 8. Public utilities are provided to the newly created lots in public rights-of-way or in appropriately sized easements (Ord. 773, 2018) The proposed project will have new water, sewer, storm and irrigation utilities provided within the right-of-way. It will also have a 10' public utility easement provided within the platted subdivision for public utilities i.e. phone, cable, power and gas, to install their infrastructure to provide services to the new facilities that will be built. The results were encouraging — by announcing the survey under all the city's social media platforms (Facebook, Instagram, Nextdoor, Twitter, and the city website) and some direct email, 259 responses were received. SurveyMonkey was used to create the survey and collect the responses. More than half of the respondents also provided comments or suggestions. Over 40 comments were received on the theme ideas, and nearly 200 suggestions on what the "downtown" area could be called. The most evident trends in the results include: Highest preference, as a group, was for themes that influence the atmosphere in the downtown o Friendly for all ages o Emphasis on walkways/ greenbelts o A variety of eateries — sit-down restaurants, food trucks o Spaces for events /festivals of different sizes Further preference for natural themes over historic themes o Street trees / shade throughout o Native flowers and vegetation o River/ streams (water features) Some preference to call it somethings besides downtown 0 45% preferred some other name 0 30% were comfortable with downtown or some other name Attached are the results of the survey, including raw comments.
