CALL TO ORDER: Mayor England COUNCIL PRESENT: Ryan Lewis COUNCIL PRESENT VIA ZOOM: Roger Hernandez, Melanie Evans, and Dan Heiner. STAFF PRESENT: Mayor Kevin England, City Attorney Tom Holmes, and City Clerk Joey Bowers. STAFF PRESENT VIA ZOOM: Public Works Director Rodney Burch, and Planning and Development Director Devin Hillam. APPROVAL OF MINUTES: April 1, 2020. Councilmember Lewis motioned for approval of the April 1, 2020 Council Meeting minutes. Councilmember Evans seconded motion for approval of minutes. Roll Call: Hernandez -yes, Lewis -yes, Heiner -yes, Evans -yes, motion passed. GENERAL BUSINESS: Acceptance of City Hall Project Bids. (Council will discuss award of construction bids). Public Works Director Rodney Burch presented the City had received 62 bids relating to 26 subcontracts for the construction of the new City Hall. Mr. Burch also reviewed the funding mechanism that the Council approved in October 2019 for this project, the police station renovation and the new animal control facility. To move forward with the new City Hall project the City needs to execute a guaranteed maximum price (GMP) contract with CM Company in the amount of $9,992,747. This contract will allow the CM Company which had previously been selected as the City's Construction Management General Contractor (CMGC), to proceed with final negotiations and contracts with the 26 subcontractors and to commence with construction. Councilmember Lewis asked about the time line for each of these three projects and how those time lines affects the certificates of participation. Mr. Burch stated that the certificates of participation that is the funding mechanism for these three projects requires the City to complete all three projects within three years. The police renovation and the new animal control facility will go out for bid next year just prior to the completion of the new City Hall. Councilmember Heiner motioned for approval of the guaranteed maximum price contract with CM Company in the amount of $9,992,747. Councilmember Hernandez seconded motion for approval of contract. A review of a proposal by City Staff to replace existing Chapter 18.28 Administration of the Land Use Ordinance with a rewritten chapter 18.28 Administration and to amend section 17.12.080.G of municipal code to increase the number of preliminary plat agency review time from 10 calendar days to 10 business days, following a public hearing and recommendation of approval by the Land Use and Development Commission on March 10, 2020. Planning and Development Director Devin Hillam presented some inconsistences in City Code and these proposed solutions would align City Code more closely with Idaho Code's Local Land Use Planning Act (LLUPA). These inconsistences include variances, public hearings, conditional use permits, and rezones. Idaho Code for variances requires notification to adjacent property owners, whereas City Code requires notification to all property owners within 300ft. Idaho code also only requires one public hearing for most land use applications. City Code requires two, one with the Land Use and Development Commission and one with the City Council. Mr. Hillam stated that the Association of Idaho Cities legal staff recommends holding only one public hearing to help increase resident input at the Land Use level, and to help decrease public frustration. City Staff recommended removing the required public hearing before City Council, unless the residents' petition for a public hearing, and then that public hearing would go before the City Council. Idaho Code also requires a process to request a reconsideration before a decision goes to district court. City Code currently does not have a set process for an applicant to request a decision reconsideration. City Code also does not address items to consider when approving a rezone, text amendment, annexation, and a comprehensive plan. City Staff recommended that Council should also add the following as a consideration factor for an annexation application; that the income generated by property taxes would exceed long term cost to the City, associated with maintenance, provision of services, and facilities, and that the advantages for both the City and applicant out way the disadvantages. CLAIMS: 1. City of Chubbuck claims for April 15, 2020 as presented to Mayor England and Council. Councilmember Lewis motioned to approve the City of Chubbuck Claims as presented.
