CALL TO ORDER: Mayor England PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Heiner COUNCIL PRESENT: Roger Hernandez, Dan Heiner, Ryan Lewis, and Melanie Evans. STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Tom Holmes, Public Works Director Rodney Burch, Police Chief Bill Guiberson, Planning and Development Director Devin Hillam, City Planner Paul Andrus, Fire Chief Merlin Miller, Human Resource Director Scott Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers. APPROVAL of MINUTES: February 5, 2020. Councilmember Heiner motioned for approval of the Study Session and Council Meeting minutes. Councilmember Lewis seconded motion for approval of minutes. Roll Call: Hernandez -yes, Heiner -yes, Lewis -yes, Evans -yes, motion passed. GENERAL BUSINESS: 1. Approval of Bilyeu Div. 6 Final Plat. (Council will discuss the application and if it meets City code). Mitch Greer Rocky Mountain Engineering represented the applicant. Mr. Greer presented a 13 lot residential development. Mr. Greer stated that this development currently does not have access to secondary irrigation. The developer has installed the internal infrastructure, and will pay an agreed upon cash in lieu for his portion of a future pumping station. City Planner Paul Andrus stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval, conditional upon the cash in lieu for secondary irrigation. Councilmember Lewis motioned for approval of Bilyeu Estates Div. 6 Final Plat. Conditional upon that this development provide a cash in lieu for an irrigation pump and distribution network in the amount of $750 per lot that will be collected with the building permit fees, and establish a guarantee to the City for completion of needed infrastructure to supply adequate pressure for secondary irrigation, and construction plans/drawings to be accepted by the City Engineer. Councilmember Hernandez seconded motion for approval with conditions. Roll Call: Heiner -yes, Lewis -yes, Evans -yes, Hernandez -yes, motion passed. 2. Acceptance of Offer of Dedication for Integrity Estates Phase 3. (Council will discuss if all city requirements have been inspected and completed). Public Works Director Rodney Burch stated that all city requirements had been completed and recommend approval. Councilmember Evans motioned for acceptance of offer of dedication for Integrity Estates Phase 3 Councilmember Heiner seconded motion for acceptance. Roll Call: Lewis -yes, Evans -yes, Hernandez -yes, Heiner -yes, motion passed. 3. Acceptance of Offer of Dedication for Chubbuck Medical Center Div. 1. (Council will discuss if all city requirements have been inspected and completed). Public Works Director Rodney Burch stated that all city requirements had been completed and recommend approval. Councilmember Hernandez motioned for acceptance of offer of dedication for Chubbuck Medical Center Div. 1. Councilmember Evans seconded motion for acceptance. Roll Call: Evans -yes, Hernandez -yes, Heiner -yes, Lewis -yes, motion passed. 4. Adoption of Ordinance 809 Linden Ave. Change of Land Use District. (Council will discuss a change in land use from Residential (R-2) to Commercial (C-2) on .4 acres). Planning and Development Director Devin Hillam presented an ordinance for a zone change from Residential (R-2) to Commercial (C-2). Councilmember Hernandez motioned for the waiver of three readings, including the reading of one time in full for Ordinance 809. Councilmember Heiner seconded motion for waiver. Roll Call: Heiner -yes, Evans -yes, Lewis -yes, Hernandez -yes, motion passed. Councilmember Heiner motioned for adoption of Ordinance 809. Councilmember Evans seconded motion for adoption. Roll Call: Evans -yes, Lewis -yes, Hernandez -yes, Heiner -yes, motion passed. 5. Adoption of Ordinance 810 ICCU Change of Land Use District. (Council will discuss a change in land use from Residential (R-2) to Commercial (C-2)). Planning and Development Director Devin Hillam presented an ordinance for a zone change from Residential (R-2) to Commercial (C-2). Councilmember Hernandez motioned for the waiver of three readings, including the reading of one time in full for Ordinance 810. Councilmember Heiner seconded motion for waiver. Roll Call: Heiner -yes, Evans -yes, Lewis -yes, Hernandez -yes, motion passed. Councilmember Heiner motioned for adoption of Ordinance 810. Councilmember Evans seconded motion for adoption. Roll Call: Evans -yes, Lewis -yes, Hernandez -yes, Heiner -yes, motion passed. 6. Adoption of Ordinance XXX Annexation & Zone Change from Agriculture (A) to Residential (R-2). (Council will discuss the annexation of 17.4 acres with Residential (R-2) Zoning, and a change in land use of .2 acres from Agriculture (A) to Residential (R-2). This business item was removed from the agenda. 7. Appeal the Denial of a Day Care License for Irma Vega. (Council will discuss the denial of a day care license by the Chubbuck Police Department). Chief Bill Guiberson presented the reasoning for the denial of the application. Irma Vega explained her situation, and her misunderstanding with the application. Ms. Vega stated that she did have prior daycare experience, and had been approved by the Chubbuck Police for a day care license in 2017. Councilmember Hernandez motioned for denial of the appeal for a day care license. Councilmember Heiner seconded motion for denial. Roll Call: Lewis -yes, Heiner -yes, Evans -yes, Hernandez -yes, motion passed. CLAIMS: City of Chubbuck claims for February 19, 2020 as presented to Mayor England and Council. Councilmember Evans motioned to approve the City of Chubbuck Claims as presented. Councilmember Hernandez seconded motion for approval.
