RESOLUTION PROVIDING ASSURANCE OF COMI'LIANCE WFI'[I TIlE RELOCATION ASSISTANCE PROVISIONS OF TIlE UNIFORM RELOCA'rlON ASSISTANCE AND REAL PROPERTY ACQUISITION POL].CIES ACT OF 1970 WHEREAS, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, P.L. 91-646, (hereinafter called the "Act") establishes uniform policies for the fetr and equitable treatment of individuals, partnerships, corporations, or associations (hereinafter called "displaced persons") who are displaced as a result of Federal and 'federally assist, cd programs; and WHEREAS, the Act is applicable to various programs and projects receiving financial assistance from & Federal Agency such as the Department of Housing and Urban Development (hereinafter called "HUD")' and WHEREAS, this governia$ body seeks financial assistance pursuant to a project(i)' , or a program(s) identified below, which project(s) or program(s) (hereinafter called the "Undertaking(s)") is subject to the Act and is administered by HUD; and WHEREAS, the activities for which such assistance is sought will involve dis- placement occurring on or &fret January 2, 1971, the effective date of the Act; and ~iEREAS, Section 210 of the Act requires the receipt of certain assurances before the h.ead of a Federal agency can provide financial asiistance to pay all or part of the cost of any p~ogram or project which will result in displacement as defined in the Act. NOW, THEREFORE, be it resolved by this governtr~ body: That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, provided through the adoption of this resolution, with the following assurances regarding conduct by this body of the undertaking(s) for which Federal financial assistance is sought: Fair and reasonable relocation payments and m~sist&nCe shall be provided in accordance with Sections 202~ 203, and 20~ st th~ Act and applicable HUD regulations in effect at the time of displacemeut~ to or for dis- placed persons whose displacement occurs ss 'a ~esult of the un, creaking; e Relocation assistaflce programs offering the services described in Section 205 of the Act shall be provided to such displaced persons in the manner pr.ovided under applicable HUD regulations in effect at the time of dis- placement; Within a reasonable period of time prior to displac~nt, decent, safe, and sanitary replacement dwellings will be availabl~ to displaced pe~sons in accordance with Section 205(c)(3) of the Act; The relocation process will be carried out in such a manner as to provide displaced persons with unif0~m and consistent services, and repl&cement housing will b~ available and the s~m~ range of choices with respect to such housing will be offered to all displaced persons regardless of race, color, religion or national orilin pursuant to Title VI of the Civil Rights Act of l$6i (~2 U.S.Co 20SOd), Title VIII of the Civil ~lghts Act of 1968 (12 U.S.C, 3§01 et seq.), and ~xecutive Order 11063 (27 F.R. 11527): The costs of providing relocation payments and assistance to the public body's undertaking(s) shall be borne in accordance with Section 211 of the Act; The public body hereby gives assurance that it has authority under applicable State and local law to comply with Section 210 of the Act, notwlthstandl~.~ any provision s~t forth in the financial assistance agreement(s) b~tween this body and HUD, and this connection b~reby authorizes the provision to HUD of the opinion of its legal counsel to that affect. Affected persons will be adoquately infomaed of the benefits, policies and procldures provided in the regulations of the Departlflent of Housing and U~ban Development (36 F.R. 8785). The Mayor ' or Council President (Prin6ipal gxecutiw~. Offi~ial) (Appropriate Alternative Official) of this public body is hereby authorized and directed to execute such amend- ment(s) to the applicable financial assistance agreement(s) between this body and H~D and to execute, furnish and be bound by such additional docu- mentation as may be required in order to co/nply with the Act as the Secretary of Housing and Urban Development shall determine necessary to effectuate or implement the assursnces provided hereunder. C. This document is hereby made a part of and is incorporated in the financial assistance agreement(s) between this public body and HUD for the undertaking(s) identified below and shall be deemed to supersede any provisions(s) in said a~reement(s) to the extent that such provision(s) may conflict with tha ......... assurances or agreement(s) provided hereunder.
