PgOPI'iIUIY ACQUISITION POLICIES ACT OF 1970 %~EREAS, the Uniform gelocation Asuintat~ce and Real Property Acquisition Policies Act of 1970, P.L. 91-646, (hereinafter referred to as tim "Act") establishes un,form policies for the fair and equitable treatment of persons displ~ced as a result of Federal and federally assisted programs~ as well as uni£orm policies on real property acquisition practices w~th respect to such programs; and I~IlEREAS~ the Act has application to programs and projects receiving Federal financialassistance from 'the Department of llousing and Urban Development; and ~IEREAS, the activities for s~ich such assistance is sought will involve land acquisition occurring after January 2, 1971, the effective date of the Act; and i~IiEREkS~ Section 305 of the Act requires the provision of certain assurances before the he~d of a Federal agency can approve any grant to) or contract or agree- ment with a State agency~ under which Federal financial assistance rill be available to pay all or ~art of the cost of any program or project which will result in real property acquisition subject to the requirements of the Act. NO~, THEREFORE~ be it resolved by the governing body of the (State Agency) as follo~s: The (State Agency) hereby assures that it has authority under state la~ to comply ~lth Section 305 of the Act and agrees that~ notwithstanding any provision set forth in'(Identify contract(s) or agreement(s) for 'project(s) in question)~ _project Project or Contract No. In acquiring real property in connection with the foregoing identified projects~ contracts or agreements~ the (State AEency) will be guided ti'the greatest extent practicable under state law~ by the land acquisi- ti,,, eolicies sc't ~ut u;~d~:r Section 301 cf the Act and file provislc~;. of Section 302 thereofl Property o~mers will be paid or reimbursed for necessary expenses as specified in Sections 303 and 304 of the Act; aud., ® Affected persons wiII be adequately informed of the benefits, policies and procedures provided in the regulations of the Department of Housing and Urban,Develop~nt~ The costs to the (State Agency) of providing payments and assistance thereunder shall be borne in accordance'with Section 211 of the Act. The (title of Chief Executive Officer) is authorized to execute such amendment to the above identified contract(s) and such additional docu- ments, ~hich the (State A~ency) agrees to furnish and be bound by as the Sec~et&ry of Houaint and Urban Developmen~ shall determine necessary to effectuste~or i~plement the assurances provided hereunder. The (title of Chief Executive Officer) is authorized to execute this document in t~o counterparts for each of the above'identified contracts and this docu-. ment shall be made a part of and incorporated in said contract(s), and the provisions hereof shall be deemed to supersede any provision in any contract identified above to the extent that any such provision conflicts ~£th 'the assurances'or agreements provided hereunder.
