S 0 'i', U T I 0 N WHEREAS, the Idaho Transportation Department, Division of llighways of the State of Idaho has submitted a Cooperative Traffic Signal Agreement stating obligations of the State and the City of Chubbuck in the installation of a traffic signal at the intersection of Yellowstone Avenue (US 91) and Chubbuck Road in the corporate limits of the City of Chubbuck. WHEREAS, the allotment of State funds for the installation is .contingent upon compliance with the laws governing State Highways and State Highway traffic, availability of necessary right-of-way, adequate provisions for the maintenance of the completed installation and the establishment of traffic control measures and means of enforcing them. NOW THEREF~, BE IT RESOLVED: 1. That the Cooperative Traffic Signal Agreement is hereby accepted and approved. 2. That the Mayor and City Clerk are authorized to execute the Agreement on behalf of the' City of Chubbuck. 3. The duly certified copies of this resolution shall be furnished to the Division of Highways. CERTIFICATION I hereby certify that the above is a true copy of a Resolution passed at a regular, duly called, special (x out non-applicable term) meeting of the City Council, Chubbuck, Idaho held on Aumlst 13, , 19 74 ' STATE OF IDAHO Idaho Transportation Department, Division of Highways Cooperative Traffic Signal Agreement ST 1032(545) Yellowstone Avenue (US 91) & Chubbuck Road ~hubbuck This AGREEMENT, made and entered into this ~d~ day of ~~n~ . , 19 ~, by and between the Idaho Transportation Department, Division of Highways, party of the first part~ hereinafter called the State, and the City of Chubbuck, hereinafter called the City as second party. WITNESSETH: WHEREAS, ~n accordance with the Manual on Uniform Traffic Control Devices for Stree~ and Highways, as adopted by the State, warrants and vehicular safety considerations exist to justify the installation on the urban extension of the State Highway System within the City of Chubbuck at the intersection of Yellowstone Avenue (US 91) and Chubbuck Road; and, WHEREAS, the traffic signal installation will be installed in conjunction with State Highway Project ST 1032(545) and in conformance with the plans listed as Exhibit "A" attached to and made a part of this Agreement; and, WHEREAS, authority for this agreement is established by Section 40-120 of the Idaho Code; and, WHEREAS, the parties are agreeable to assuming portions of the costs and obligations of the installation as hereinafter set forth; and, NOW THEREFORE, in consideration of the several promises to be faithfully performed by each party as hereinafter set forth, the parties do hereby mutually agree as follows: SECTION I, That the State will: 1. Furnish and install all materials listed in the attached cost estimate to provide a complete traffic signal installation. - 2 - 2. Assume ownership of the following signal equipment: con- troller, accessories and cabinet, vehicle and pedestrian signal heads. 3. Furnish, upon request by the City, with the exception of lamp renewal, at no cost to the City, replacement parts for the signal equipment listed in Item 2, deemed necessary to maintain standard operation of the equipment, Replacement parts shall consist of individual parts rather than the equipment as a unit. 4. Upon request of the City, at City's expense, perform the necessary matntemance to provide standard operation of the traffic signal installations. SECTION II, That the City ~rlll: 1. Assun~ 50 percent of all construction and engineering costs. 2. Assume ownership of all the traffic control items not included in Section I, Item 2, namely: poles~ conduit, signal cable, miscellaneous hardware. 3. A~rees to assume all operation and maintenance responsibilities and the costs thereof except as provided in Section I, Item 3 and will be required to maintain the traffic signal equipment as installed, in continuous operation in conformance with warrants justifying its existence and the requirements of the Manual on Uniform Traffic Control Devices for Streets and Highwa~s, as adopted by the State. However, if at any time the City fails to maintain the installation in conformance with the above requirements, the necessary maintenance Will be done by the State. The City agrees to reimburse the State for all costs so incurred. 4. The City agrees to hold harmless the State against suits, actions, or claims of any character, brought because of injury or damages sustained or received by any person, persons, or property, resulting from -3 - or allegedly resulting from, failure of the City to maintain the install- ation in conformance with the requirements of this agreement. 5. Not use signal poles or mastarm without prior concurrence of the State for any other purpose than to support the signal equipment. SECTION III, That: 1. The traffic signal equipment will not be altered or abandoned without prior comcurrence of both parties. 2. The City agrees to pay. to the State prior to commencement of the signal installation the sum of $2,518.00, which is 50 percent of the total estimated cost of the installation. 3. That this agreement shall become effective on the first date mentioned above and shall remain in full force and effect until amended or replaced upon the mutual consent of the Parties hereto. iN WITNESS WHEREOF, the Parties have caused these presents to be executed, the Party of the First Part by its State Highway Administrator attested to by its Secretary and the Seal of the Idaho Transportation Department affixed thereto, and the Party of the Second Part by the Mayor, attested to by the City Clerk and the Seal of the City affixed thereto.
