COUNCIL PRESENT: Ryan Lewis, Melanie Evans, Roger Hernandez, and Dan Heiner
STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Tom Holmes, Public Works
Director Rodney Burch, Police Chief Bill Guiberson, Planning and Development Director Devin
Hillain, Senior Planner Don Matson, Fire Chief Merlin Miller, Human Resource Director Scott
Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers.
GENERAL BUSINESS:
1- Title 18 Administration Chapter and PUD rewrite presentation
Planning and Development Director Devin Hillam presented some inconsistences in
City Code and proposed solutions. These inconsistences include variances, public
hearings, conditional use pennits, and rezones. Idaho Code for variances requires
notification to adjacent property owners, whereas City Code requires notification to all
property owners within 300ft. Idaho code also only requires one public hearing for most
land use applications. City Code requires two, one with the Land Use and Development
Commission and one with the City Council. Mr. Hillam stated that the Association of
Idaho Cities legal staff recommends holding only one public hearing to help increase
resident input at the Land Use level, and to help decrease public frustration. City Staff
recommended removing the required public hearing before City Council, unless the
residents' petition for a public hearing, and then that public hearing would go before the
City Council, Idaho Code also requires a process to request a reconsideration before a
decision goes to district court. City Code currently does not have a set process for an
applicant to request a decision reconsideration. City Code also does not address items to
consider when approving a rezone, text amendment, annexation, and a comprehensive
plan. City Staff recommended that Council should also add the following as a
consideration factor for an annexation application; that the income generated by property
taxes would exceed long term cost to the City, associated with maintenance, provision of
services, and facilities, and that the advantages for both the City and applicant out way
the disadvantages.
Senior Planner Don Matson presented changes to the City's current planned unit
developments (PUD). These changes would help create a higher quality product for both
design and amenities. City Staff recommended setting eligibility requirements for an
application to qualify for a PUD and increasing open space requirements to 15% of the
gross area. Mr. Matson also stated that the current density calculation is both outdated
and confusing to developers and City Staff.
Councilmember Lewis was concerned about removing the City's elected officials
from the public hearing process. Councilmember Evans wanted to set landscaping
requirements as a PUD qualification.
2- Discussion about Pocatello's request to rename a portion of Chubbuck Road.
Planning and Development Director Devin Hillam presented that the City of Pocatello
had applied with Bannock County to change the name of Chubbuck Road from
Fairgrounds Road east to Venture Way. Bannock County has asked for input from the
Council since a corner of Fairgrounds Road is in the Chubbuck city limits.
The Council recommended talking to Bannock County about the City de -annexing
Fairgrounds Road back into the County. This would allow the County to be able to make
the decision on the City of Pocatello's application to change the name of that portion of
Chubbuck Road, which currently resides within the County's jurisdiction.
3- Discussion about Bannock County's request to rename Fairgrounds Road.
Planning and Development Director Devin Hillam presented that Bannock County
wants to change the name of Fairgrounds Road, to reflect the sites status of not having a
fairground. The new name is currently undetermined.
The Council recommended talking to Bannock County about the City de -annexing
Fairgrounds Road back into the County. This would allow the County to be able to make
the decision on the rename of Fairgrounds Road, which currently resides within the
County's jurisdiction.
4- Discussion about Draft Area of City Impact Agreement Ordinance and Boundary
Planning and Development Director Devin Hillam presented the City's current area of
impact with Bannock County. The City is currently in renegotiations with Bannock
County to include properties east of interstate 15. Bannock County would like the City's
area of impact to be pulled back. Mr. Hillam presented a new proposed area of impact for
the City of Chubbuck that both City Staff and Bannock County staff is in agreeance. This
new area of impact would pull back the western border to align with the City's next
significant phase of sewer improvements, and would expand and include the areas of
impact east of 1-15. Mr. Hillam also stated that City Staff feels like this would allow the
City to work with Bannock County to adopt policies and procedures that would match the
City's standards for streets, curb, gutter, sidewalk, streetlights, traffic control signs, and
street names, dry lines to be installed, and for utility connections to consent to future
annexation. The downside the City will most likely see an increase in County
developments just outside of the City's area of impact.
