COUNCIL MEETING MINUTES
JANUARY 15, 2020 — 6:00pm

CALL TO ORDER: Mayor England
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Evans
INVOCATION: Bishop Derek Tuttle from The Church of Jesus Christ of Latter-day Saints.
COUNCIL PRESENT: Ryan Lewis, Melanie Evans, Roger Hernandez, and Dan Heiner
STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Tom Holmes, Public Works
Director Rodney Burch, Police Chief Bill Guiberson, Planning and Development Director Devin
Hillam, Senior Planner Don Matson, Fire Chief Merlin Miller, Human Resource Director Scott
Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers.
APPROVAL OF MINUTES: January 8, 2020.
Councilmember Heiner motioned for approval of the Council Meeting minutes.
Councilmember Lewis seconded motion for approval of minutes.
Roll Call: Lewis -yes, Evans -yes, Hernandez -yes, Heiner -yes, motion passed.
GENERAL BUSINESS:
Approval of I" Amended Frasure Industrial Park I" Addition Short/Final Plat.
(Council will discuss the application and if it meets City code).
Chris Street represented the applicant. Mr. Street stated that this application would
combine two lots from the Frasure Industrial Park I" Addition and a portion of art
unplatted parcel. Mr. Street also stated that the applicant was requesting a waiver to not
provide the required 33ft of right of way for the undeveloped portion of Valenty Road.
Senior Planner Don Matson stated that there was an existing building located in the
required right of way. Mr. Matson also stated that this application had been reviewed by
City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code.
Councilmember Hernandez asked about access to the surrounding properties. Mr.
Matson stated that all the properties can develop an access from Ward Street without the
connecting street as proposed on the Functional Class Road Map.
Councilmember Lewis motioned for approval of the I" amended Frasure Industrial Park I"
addition short plat, granting the waiver to not provide right of way for the undeveloped portion
of Valenty Road as shown on the Functional Class Road Map,
Councilmember Hernandez seconded motion for approval.
Roll Call: Evans -yes, Hernandez -yes, Heiner -yes, Lewis -yes, motion passed.
2. Assignment of Improvement Agreement CDA/City.
(Council will discuss assignment of building ownership from ICCU parcel purchase).
Public Works Director Rodney Burch stated that the City of Chubbuck and the
Chubbuck Development Authority (CDA) participated in a land acquisition from ICCU
for the New City Hall and surrounding CDA parcels. There is an existing building that is
now split by the new property lines with a portion of the building lying on City property
and a portion on CDA property. To simplify the use of or disposal of the building, the
building needs to be assigned to one entity. The attached agreement assigns the
improvements to the City who may choose to relocate the building for EMS training
facilities or dispose of the building in accordance with Idaho Code.
Councilmember Heiner motioned for approval of the assignment of improvement agreement
between the Chubbuck Development Authority and the City of Chubbuck.
Councilmember Evans seconded motion for approval.
Roll Call: Hernandez -yes, Heiner -yes, Lewis -yes, Evans -yes, motion passed.
3. Approval of Update to the Personnel Policy.
(Council will discuss the updates to the Personnel Policy).
Human Resource Director Scott Gummersall presented changes to the City's
personnel policy.
Councilmember Evans motioned for approval of the updated personnel policy.
Councilmember Hernandez seconded motion for approval.
Roll Call: Heiner -yes, Lewis -yes, Evans -yes, Hernandez -yes, motion passed.
4. Approval of Records for Destruction.
(Council will discuss the destruction of City records).
City Clerk Joey Bowers presented the records for destruction.
Councilmember Hernandez motioned for approval of records for destruction as presented.
Councilmember Evans seconded motion for destruction.
Roll Call: Lewis -yes, Evans -yes, Hernandez -yes, Heiner -yes, motion passed.
CLAIMS:
1. City of Chubbuck claims for January 15, 2020 as presented to Mayor England and
Council.
Councilmember Heiner motioned to approve the City of Chubbuck Claims as presented.
Councilmember Lewis seconded motion for approval.
Roll Call: Evans -yes, Hernandez -yes, Heiner -yes, Lewis -yes, motion passed.
